Mr. Farley moved to reconsider the vote by which Senate Bill No. 654 was passed.

Mr. Mandeville moved to indefinitely postpone the motion to reconsider.

Mr. Beach had leave to introduce the following concurrent resolution :

Resolved by the Senate, the Assembly concurring, That leave of absence from the State be and is hereby granted to Matthew Woods, Sheriff of Yuba, for the space of four months, to be selected by himself, during the term for which he was elected; provided, that he shall first obtain the consent of the Board of Supervisors of said county and all the sureties on his official bond, and leave a competent deputy in the office.

Mr. Green made the following report:

Mr. PRESIDENT: Your committee, to whom was referred Senate Bill No. 602-An Act providing for the payment of the balance of the judgment in favor of Tristam C. Gilman against the County of Contra Costa, State of California-have had the same under consideration, and report the same back and recommend that it be indefinitely postponed.

Mr. PRESIDENT: The Committee on Counties and County Boundaries, to whom was referred Senate Bill No. 507-An Act to create the County of Summit, etc.-have considered the same, and now report it back and recommend its indefinite postponement.

Mr. Banvard, from the Finance Committee, made the following report:

Mr. PRESIDENT: Your Committee on Finance have had under consideration Assembly Bill No. 395-An Act concerning revenue; also, Assembly Bill No. 341-An Act to amend an Act entitled an Act to amend an Act entitled an Act to provide revenue for the support of the Government of this State, approved May seventeenth, eighteen hundred and sixty-one, approved March thirtieth, eighteen hundred and sixtyeight-and recommend that they do not pass.

Mr. Banvard had leave to introduce the following resolution:

Resolved, That the Controller of State is hereby authorized and directed to draw his warrants upon the State Treasurer, and the Treasurer is authorized to pay the following sums out of the Contingent Fund of the Senate, viz To J. W. Mandeville, twelve hundred dollars; to E. W. Roberts, twelve hundred dollars, and to Elam Covington, two thousand one hundred and twenty dollars, for services on the Investigation Committee for inspection of State offices, appointed by the Senate at the seventeenth session of the Legislature.

Adopted.

On motion of Mr. Tompkins, Assembly Bill No. 568 was taken out of Assembly messages, the same having been reported, Assembly refusing to concur in the amendments made by the Senate.

The Senate refused to recede from their amendment to section two of said bill, and recede from their amendments to section thirty-two.

On motion of Mr. Wand, the rules were suspended for consideration of the following resolutions, reported from the Committee on Contingent Expenses:

Resolved, That Senators Maclay, Wilson and Chappell, each, are hereby entitled and allowed the sum of one hundred and ninety dollars, mileage while in discharge of committee duty in locating the State Normal School.

Adopted.

Resolved, That the sum of one hundred dollars be appropriated out of the Contingent Fund of the Senate, and allowed to William J. Lewis, for attendance at Sacramento City before the Committee on Corporations, as a witness and expert in the matter of Senate Bill No. 62.

Referred to the Committee on Contingent Expenses.

On motion of Mr. Roberts, the further consideration of the resolutions was postponed until Monday next.

I have to inform your honorable body that I have approved Senate Bill No. 469-An Act authorizing the publication of certain legal notices in a State paper, printed at the seat of government of the State of California.

Also, Senate Bill No. 347-An Act to amend an Act entitled an Act to authorize the City Council of the City of Oakland to improve the streets, lanes, alleys, courts and places in the said city, approved April fourth, eighteen hundred and sixty-four.

Also, Senate Bill No. 640-An Act concerning the construction of the State Capitol, in the City of Sacramento.

Also, Senate Bill No. 522-An Act making an appropriation for deficiency in the appropriation made for twentieth and twenty-first fiscal years, ending July first, eighteen hundred and seventy.

Also, Senate Bill No. 624-An Act to authorize the City of San José to sell certain bonds and use the proceeds thereof in purchasing sites for public school houses.

Also, Senate Bill No. 289-An Act to better define the boundary line between Fresno and Mariposa Counties.

Also, Senate Bill No. 59-An Act to provide for the appointment of a Reporter of the Supreme Court, and to define his duties and compensa

tion.

Also, Senate Bill No. 298-An Act concerning the City of Vallejo, and to ratify and confirm a certain ordinance of the Trustees thereof.

Also, Senate Bill No. 453-An Act to empower the County of San Joaquin to aid in the construction of the Stockton and Visalia Railroad. Also, Senate Bill No. 455-An Act to establish and maintain public pounds for the better securing estrays and other stock in the several townships of the County of San Mateo.

Also, Senate Bill No. 48-An Act for the relief and support of the California Labor and Employment Exchange.

Also, Senate Bill No. 603-An Act to provide for the liquidation of all claims against the State not otherwise provided for by law.

Also, substitute for Senate Bill No. 130-An Act supplementary to and amendatory of an Act entitled an Act to survey and dispose of certain salt marsh and tide lands belonging to the State of California, approved March thirtieth, eighteen hundred and sixty-eight.

McNeal, Commissioners, under the provisions of an Act entitled an Act to establish pilots and pilot regulations for the ports of San Francisco, Mare Island, Vallejo and Benicia, approved March twenty-second, eighteen hundred and seventy-and respectfully ask your honorable body to confirm the same.

To the Senate of the State of California:

I deem it my duty to communicate to your honorable body the reasons why messages returning two bills, whose titles are hereinafter given, failed of being delivered yesterday to the Senate.

The bills referred to, are: Substitute for Senate Bill No. 293-An Act authorizing the parties therein named, their associates and assigns, to construct and maintain a ship canal from the City of Stockton to deep water on the San Joaquin River; and Senate Bill No. 258-An Act to make, open and establish a public street in the City and County of San Francisco, to be called Montgomery Street South, and to take private lands therefor.

Messages stating the reasons for withholding approval of these bills were prepared and signed before the adjournment of the Senate, and were transmitted through the usual channel to the Senate Chamber before the customary hour of adjournment. The Senate having, by an adjournment until the next day, prevented the delivery of the messages and the return of the bills, they have failed to become laws, and will not, therefore, be deposited in the Secretary of State's office, to be certified as required in the case of bills which become laws by lapse of time without return to the house in which they originated.

I have thought it proper to communicate the facts in the case to your honorable body, and to ask respectfully that this message be spread upon the Journals of the Senate. H. H. HAIGHT,
