At eleven o'clock and fifty minutes P. M. Mr. Hager moved to adjourn. The Chair decided the motion out of order.

Mr. Hager appealed from the decision of the Chair.

Upon the question, "Shall the decision of the Chair stand as the judgment of the Senate?" the ayes and noes were demanded by Messrs. Fowler, O'Connor and Larkin, and the Senate so ordered, by the following vote:

On motion of Mr. Banvard, and by unanimous consent, the vote by which the report of the Committee of Conference on Assembly Bill No. 657 was adopted, was reconsidered.

REPORTS.

Mr. Banvard presented the following report:

Mr. PRESIDENT: Your Joint Committee of Conference, to whom was recommitted Assembly Bill No. 657-An Act making appropriations for the support of the civil Government of the State of California, for the twenty-second and twenty-third fiscal years, commencing on the first day of July, eighteen hundred and seventy, and ending on the thirtieth day of June, eighteen hundred and seventy-two-have had the same under consideration and agree upon the following report:

By rejecting Senate amendment "for each District Agricultural Society, two thousand dollars."

Also, for the State Agricultural Society, strike out "eight thousand dollars," and insert "six thousand dollars."

Also, for clerk hire in the Adjutant-General's office, strike out the words "thirty-six hundred dollars," and insert "three thousand dollars." Also, reject Senate amendment providing "for salary of the Lieutenant-Governor, as Warden of the State Prison, seven thousand three hundred dollars."

Also, reject Senate amendment providing "for the payment of Guardian of the Yosemite Valley and Mariposa Big Tree Grove, and incidental expenses, to be expended under the direction of the Governor, two thousand dollars."

All of which is respectfully submitted.

Mr. PRESIDENT: Your Joint Committee of Conference, to whom was referred Assembly Bill No. 680-An Act entitled an Act making appropriations for the support of the several charitable institutions therein specified, during the twenty-second and twenty-third fiscal years, commencing with the first day of July, eighteen hundred and seventy, and ending with the thirtieth day of June, eighteen hundred and seventytwo, inclusive-would respectfully recommend the Senate to recede from its former action in regard to the several amendments proposed to the said Act, and unanimously recommend the adoption of the following report:

That the several sums below enumerated be appropriated as follows: For the Protestant Orphan Asylum of Sacramento, fifteen hundred dollars.

For the St. Joseph's School of Sacramento, fifteen hundred dollars. For the Protestant Orphan Asylum of San Francisco, eight thousand dollars.

For the Ladies' Protection and Relief Society of San Francisco, twelve thousand dollars.

For the Sisters of Mercy Hospital of Los Angeles, one thousand. dollars

Your joint committee would also respectfully recommend that the sum of twenty-five hundred dollars be appropriated to the Roman Catholic Female Orphan Asylum of San Francisco, and twenty-five hundred dollars to the Boys' Orphan Asylum of San Rafael.

All of which is respectfully submitted.

Mr. O'Connor, from the Committee on Engrossment, made the following report:

Mr. PRESIDENT: The Committee on Engrossment have examined and find correctly engrossed Senate Bill No. 488-An Act to amend an Act entitled an Act to amend section eighty-two of an Act entitled an Act to provide revenue for the support of the Government of this State, approved May seventeenth, eighteen hundred and sixty-one, approved April twenty-seventh, eighteen hundred and sixty-three.

Also, substitute for Senate Bill No. 292-An Act entitled an Act in relation to dealers in second hand merchandise.

Also, Senate Bill No. 371-An Act to amend an Act entitled an Act concerning crimes and punishments, passed April sixteenth, eighteen hundred and fifty.

On motion of Mr. McDougall, the rules were suspended for the consideration of Senate Bill No. 548, heretofore reported from the Assembly, with amendments.

On motion, the amendments made by the Assembly were concurred in by the Senate.

The President of the Senate presented the following report from the State Prison Directors:

To the Honorable Legislature of the State of California:

The undersigned, Directors of the State Prison, in accordance with the provisions of an Act of the Legislature, approved March ninth, eighteen hundred and sixty-eight, entitled an Act to authorize the Board of State Prison Directors to recommend the pardoning of convicts in the State Prison, hereby recommend the following named persons, now confined in the State Prison, for Executive clemency:

In view of the crowded condition of the cells at the prison, and the fear that the appropriation will not admit of the erection of additional ones the coming year, the Directors may have extended the above list somewhat beyond the limits which they otherwise might have done. It will be seen, however, that quite a number of those recommended have very nearly served out their terms of sentence, the Directors believing that the moral effect of a pardon and restoration to citizenship, even upon the eve of the expiration of their term of imprisonment, would do good.

All of which is respectfully submitted.
