RESOLUTIONS.

MORRILL, Chairman.

The rules were suspended, and Mr. Pendegast had leave to introduce the following resolution:

Resolved, That J. H. Kernan, J. A, Phipps, R. R. Patten, Robert Briggs and E. Covington, Assistant Enrolling Clerks of the Senate, be and are hereby allowed, each, one week's additional pay, for extra service performed in the enrolling office, payable out of the Contingent Fund of the Senate; and the Controller of State is hereby authorized and directed to draw his warrant in favor of each of the above named persons, for the amount due him, and the State Treasurer is directed to pay the

same.

Mr. Comte offered the following amendment:

Resolved, That the Assistant Enrolling Clerks of the Senate, appointed prior to the twenty-eighth day of March, eighteen hundred and seventy, be and they are hereby allowed one week's extra pay, each, payable out of the Contingent Fund of the Senate.

Mr. Curtis moved to lay the whole subject matter on the table. Upon which the ayes and noes were demanded by Messrs. Curtis, O'Connor and Larkin, and the Senate refused, by the following vote:

AYES-Messrs. Comte, Conly, Conn, Curtis, Hunter, Irwin, Larkin, O'Connor, Tompkins, Turner, Wand and Wing-12.

NOES-Messrs. Beach, Chappell, Farley, Green, Gwin, Hutchings, Kincaid, Lawrence, Lewis, Maclay, McDougall, Morrill, Pacheco, Roberts and Tweed-15.

Mr. Irwin raised the point of order, that under joint rule number twenty, the resolution cannot be entertained except by unanimous

consent.

The Chair decided the point of order to be well taken.

By Mr. Tompkins:

Resolved, That the President and Secretary of the Senate be authorized and directed to examine and approve the Journal of this day's proceedings of the Senate.

Adopted.

By the same:

Resolved, That a committee of three be appointed by the Chair to wait upon his Excellency the Governor, and inform him that the Senate is about to adjourn sine die, and inquire whether he has any further communications to make to the Senate.

Adopted.

Pursuant to the above resolution, the President appointed Messrs. Tompkins, Lewis and Farley as such committee.

By Mr. Tweed:

Resolved, That the sum of one hundred dollars be appropriated out of the Contingent Fund of the Senate and allowed to W. J. Lewis, for attendance at Sacramento City before the Committee on Corporations, as a witness and expert in the matter of Senate Bill No. 62, and that the Controller be authorized to draw his warrant and the Treasurer to pay the same.

Also, Senate Bill No. 620-An Act amendatory of and supplemental to an Act entitled an Act to repeal the several Acts incorporating the City of Benicia and to provide for the government thereof, approved April eighteenth, eighteen hundred and fifty-nine.

Also, Senate Bill No. 100-An Act for the relief of John H. Smith. Also, Senate Bill No. 657-An Act to provide for the construction and maintenance of toll roads within the State of California.

Also, Senate Bill No. 666-An Act to empower the City and County of San Francisco to aid in the construction of the Southern Pacific Railroad, and other purposes.

Also, substitute for Senate Bill No. 607-An Act to create a Board of Water Commissioners for the City of Los Angeles, and to define their powers and duties.
