ty-two, thence north along said quarter section line and along the line dividing the section number five, in said township, to the post in the centre of said section five, thence north and west, by the most feasible and suitable route, until it intersects the said road from Green Bay, south of Mad Creek.

SEC. 7. That Urban D. Meacham, Sewal Smith and Jacob Burget, be and they are hereby appointed commissioners, with powers to vacate and re-lay a Territorial road from the east end of the Crossway near Potters Lake, to the east line of Walworth county, and establish said road where it is now travelled, or on such other line as they may deem expedient and just.

SEC. 8. That Warren Chase, Semore Wilcox and Abraham Brawley, be and they are hereby appointed commissioners to lay out and locate a Territorial road from W aupon, in the county of Fond du Lac, by the way of Ceresco, to the county seat of Portage county.

SEC. 9. That David Powers, Daniel F. Melendy and Loyal H. Jones, be and they are appointed commissioners to lay out and locate a Territorial road, beginning on the Territotial road in sec tion thirty five, of town six north, range seventeen east, being in the town of Ottaway, and running the most direct and feasible route to Prairieville, Milwaukee county.

SEC. 10. That John B. Skinner, Sr., Patrick Malone and Robert Leach, be and hereby are appointed commissioners to lay out and locate a Territorial road, beginning at the dwelling house of John B. Skinner, Iowa county, and running thence on the nearest and best route to intersect the Military road at or near the dwelling house of Patrick Malone, in Dane county, thence to Dekora, in Portage county.

SEC. 11. That John H. Bingham, John Moore and William Jones, be and hereby are appointed commissioners to lay out and locate a Territorial road from Monroe, the county seat of Green county, upon the nearest and best route to Janesville, the county seat of Rock county.

SEC. 12. That Jared S. Walsworth, Nelson Strong and Samuel R. Merrill be, and are hereby appointed commissioners to lay out and establish a Territorial road, beginning at the dwelling

house of Jared S. Walsworth in the county of Portage, running

upon the best route to Grand Rapids, and from thence to the coun

ty seat of said county.

SEC. 13. That Aaron Boughton, Andrew Colter and Hiram

Brown, be and hereby are appointed commissioners to lay out and locate a Territorial road, beginning at Sugar river bridge on section twenty-eight, in town number three, of range number nine east, from thence on the nearest and best route to the ridge contiguous to the quarter post between sections twenty-two and twenty-three, of town three of range nine, thence on the nearest and best route to Janesville, the county seat of Rock county.

SEC. 14. That Ezra Durgan, Eleazer McKinster and Hiram Brown, be and hereby are appointed commissioners to lay out and establish a Territorial road, beginning at Exeter, in Green county, thence [on] the nearest and best route to Beloit, ir Rock county.

SEC. 15. That Daniel Baxter, John Moore and James Camp. bell, are hereby appointed commissioners to re-survey, locate and establish that part of a Territorial road, being in the county of Green, commencing on the south side of section thirty-one, town one north, range nine east, in the county of Green, and running thence to Madison, in the county of Dane.

SEC. 16. That E. B. Wollcott, John Bannister and Charles Higgins, be and they are hereby appointed commissioners to lay out a Territorial road from Milwaukee to Fond du Lac, by way of the easterly bend of Milwaukee river, in Washington county, passing as nearly as may be the center of said county compatible with a proper location of said road on ground most suitable for that purpose.

SEC. 17. That Benjamin Labareo, Martin Rich and James A. Williams, are hereby appointed commissioners to lay out and establish a Territorial road, commencing at Watertown, by the way of the county seat of Dodge county, and thence by the most practicable route to Fond du Lac.

SEC. 18. That Albert S. Story, Uriel S. Wardsworth and Ma> jor Platt, be and are hereby appointed to lay out a Territorial road from Sheboyagan, in Sheboyagan county, on the most direct and

practicable route, by the county seat of Dodge county, to Madison.

SEO. 19. That Elbert Dickinson, Jacob Dickinson and Horace Dodge, be and are hereby appointed commissioners to lay out and establish a Territorial road from Madison, on the most practicable route, by the way of Fountain Prairie to Fox Lake.

SEC. 20. That E. B. Brown, Charles H. Dailey, and Edward West,be and hereby [are] appointed commissioners to lay out and establish a Territorial road from Summit, in Milwaukee county, on the most direct and practicable route, to Fond du Lac.

SEC. 21. That Albert S. Story, David Giddings and Theodore Conkey, be and are hereby appointed commissioners to lay out and establish a Territorial road from Sheboyagan, by the most direct and practicable route to Fond du Lac.

SEC. 22. That Warren Chase, Samuel W. Beall and P. V. Sang, be and are hereby appointed commissioners to lay out and establish a Territorial road from Fond du Lac, by the way of Ceresco, on the best route to Fort Winnebago.

SEC. 23. That Wooster Harrison, Isaac C. Loomis and Theodore Conkey, are hereby appointed commissioners to lay out and establish a Territorial road from Washington Harbor, in Washington county, to Fond du Lac.

SEC. 24. Thomas C. Smith, Ezekiel Houton and Lafayette Hill, be and are hereby appointed commissioners to lay out and establish a Territorial road commencing at Columbus, in Portage county, to Dekora, in the same county.

SEC. 25. That Richard F. Rising, Allen Perkins and George S. Clark, are hereby appointed commissioners to lay out a territorial road from Aztalan, in Jefferson county, by Nashua, in Dodge county, to intersect the road leading from Ten Mile Creek to Fox Lake, at or near the place where said road crosses Shaw's Brook.

SEC. 26. That Major Platt, Richard F. Rising and Jeremiah Drake, are hereby appointed commissioners to lay out a Territori torial road from Columbus, in Portage county, to Washara, in Dodge county, thence on the most practicable route, to strike the Watertown and Fox Lake road at or near Major Pratt's.

SEc. 27. That part of a Territorial road leading from Ažtalan, in Jefferson county, by Peck's Rapids Settlement, and Isaac Noyes', to Wilcoxe's, in Fond du Lac county, authorized by the Legislative Assembly, at its session in 1842, '3, which lies between Aztalan and Noyes', is hereby established according to the survey made by Victor M. Adams, under Isaac Noyes and Benja. min Cluson, as commissioners.

SEC. 28. That Isaac Noyes, Seymour Wilcox and Barnabas Hinkley are hereby appointed commissioners to lay out and estab lish a Territorial road from Isaac Noyes', in Dodge county, to Seymour Wilcox's, in Fond du Lac.

SEC. 29. That so much of a Territorial road which was laid out and established from Prairieville, in Milwaukee county, to Fort Atkinson, in Jefferson county, in pursuance of the ninth section of an act entitled "An act to provide for laying out the several Territorial roads therein named," approved January 15, 1842, as lies between a point in said road at the angle stake on the south west quarter of section nine, in Prairieville, aforesaid, and the ter. mination of said road on the south east quarter of section three, near the academy in said Prairieville, be and the same is hereby discontinued. SEC. 30. That Robert R. Cowan, E. M. Williamson and Richard Palmer, are hereby appointed commissioners to lay out and establish a Territorial road, commencing at Janesville in the county of Rock, and running thence on the east side of Rock rivė er to the old Indian ford, (so called) across the Rock river in the town of Fulton, thence on the nearest and most practicable route to the Catfish Mills on the Catfish river, thence by the nearest and most practicable route to Madison, in the county of Dane.

SEC. 31. That Jacob P. Brown, C. D. Finch and Thomas M. McCaughey, be and are hereby appointed commissioners to view and make such alterations in the Territorial road leading from Madison, in Dane county, by the way of Columbus and Beaver Dam to Waupun, in the county of Fond du Lac, as they may deem necessary and proper.

SEC. 32. That Benjamin Funk, George Wiley and Joseph Payne, be, and they are hereby appointed commissioners to lay out and establish a Territorial road, commencing in the county of Iowa, at the north east corner of section thirty-five, in township number one, of range three east, rnnning thence east to the east

bank of Spafford's branch, thence eastwardly by the bridge on the Pecatonica river a short distance below the forks, thence on the nearest and best route to Monroe, in the county of Green.

SEC. 33. That Henry II, Camp, Orrin Hazeltine and Luther Parker, be, and are hereby appointed commissioners to lay out and establish a Territorial road, commencing on section sev enteen, in the town of Vernon, Milwaukee county, on the Milwau kee and Mukwanego road, thence running in an easterly direction and ending on section seventeen in the town of Muskego, on the Milwaukee and Mukwanego road..

SEC. 34. That Thomas L. Summers, A. K. Stearns and Jacob Linzie, are hereby appointed commissioners to lay out, and establish a Territorial road from Janesville, via Exeter to Mineral Point.

SEC. 35. That P. M. Johnson. John Sacket and Timothy Hale, are hereby appointed commissioners to lay out and estab. lish a Territorial road from the county seat of Washington county to Hustis Rapids on Rock river..

SEC. 36. That William Sherman, Adam E. Ray and Philip V Bovee, are hereby appointed commissioners to lay out a Territori. al road, commencing at such point in the town of Eagle, in the county of Milwaukee, as they shall deem the interests of the public require, and running thence the nearest and best route by the way of Spring Lake to Prairieville in said county.

SEC. 37. Said roads shall be laid out and returns made agreeable to the provisions of "an act to provide for laying out and opening Territorial roads, and for other purposes," passed January 11th, 1840: and when so laid out shall be public highways agreeable to the terms of said act, and each of the aforesad boards of commissioners, are hereby authorized to adopt as part of the roads hereby authorized, any part of such public roads heretofore laid out as shall be suitable and proper.

1.SEC. 38. Whenever damages could be legally claimed by any person through whose land a Territorial road may be laid, or proposed to be laid,if said road had been a town or county road.the commissioners shall proceed to ascertain the damages in the same man. ner that the town or county authorities would have ascertained the same if said road was a town or county road, and all duties required of the town or county clerk in such cases, in the case of laying a Territorial road may be performed by one of the commissioners;
