SEC. 4. SEC. 5. It shall be the duty of the first director, under the reg. Their duties. ulations of the corporation, or under the direction of a majority of directors, to sign all contracts or other instruments of writing between said corporation and other contracting parties, and such signature shall be evidence in all cases that all such contracts or in struments of writing were duly executed by and ( for)in behalf of said corporation.

SEC. 6. Said corporation is hereby authorized and empowered to ask and receive, demand, sue for, and recover of all persons navigating said river with rafts of any kind, or flat boats or scows, in case they shall pass over said dam or slide, the sum of Amount of twenty cents for each and every thousand feet for all sawed lum- tolls to be paid ber, and two and a half cents for each and every thousand shingles that may be carried over on any rafts or boats, and all rafts

SEC. 7. In case of refusal of the persons navigating such Tolls may be rafts to pay the toll, said corporation may sue for and collect the sued for. same either by attachment of the raft, or by action of debt against any person intrusted with the property of said raft either as owner or assignee or navigator, and in any suit brought to recover any such toll, the process may be by warrant against either of the parties herein before mentioned,

SEC. 9. Said dam shall be commenced within one year, and be completed within two years from the date of the passage of this act, and if not so begun and completed, all rights hereby vested in said corporation shall cease and determine.

SEC. 10. The stockholders of the said company shall be individually liable in their private property for all debts against the company.

SEC. 11. Whenever the navigation of the said river shall render it necessary, the said corporation shall construct a lock of sufficient dimensions to permit all boats and vessels navigating the said river, to pass without obstruction or delay, by paying the lawful tolls therefor.

SEC, 12. The Legislature may at any time alter, amend or repeal this act.

AN ACT to authorize school district No. four, in Sheboyagan county, to lay an additional tax for building a school house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin.

SECTION 1. That it shall, and may be lawful for the trustees of school district No. four, in the county of Sheboyagan, to levy a tax on the taxable property of said district, in addition of the present tax now allowed by law, not to exceed one per cent on the last assessment roll, for the purpose of erecting or finishing a school house in said district.

SEC. 2. The said tax shall be collected and returned in the same manner that is now provided by law for the collection of the tax for building school houses: Provided, that two thirds of the legal voters in said school district, who may be present at a school meeting duly called by the trustees of the same for that purpose, shall vote in favor of the tax authorized by this act.

SEC. 3. It shall be the duty of the trustees of said school dis

trict to give notice of any meeting to be called by them for the purpose of levying the said tax, by posting up written or printed notices of the same, in three of the most public places in said district, at least ten days previous to the time of holding said meeting. AN ACT to authorize school district number one, in the the town of Cassville, county of Grant, to levy a tax for building or purchasing a school house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin.

SECTION 1. That the inhabitants of school district number. one, in the town of Cassville, county of Grant, who are qualified voters at any school meeting in said district, may vote a tax to be levied on all the taxable property in said district, not to exceed the sum of four hundred dollars, for the purpose of building or purchasing a school house in said district: Provided, that two Proviso. thirds of the legal voters of the same, who may be present at any meeting duly called by the trustees for that purpose, shall vote in favor of the tax authorized by this act.

AN CCT to authorize the county of Brown to levy a tax for the purpose of building a poor house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. The board of supervisors of the county of Brown, are hereby authorized and empowered to raise by tax, on the taxable property of said county, a sum not exceeding three thousand dollars for the purpose mentioned in the first section of an act of the revised Statutes of this Territory entitled "an act to define the general powers of counties and for other purposes:" Provided, that the said board, shall not levy to exceed two mills on the dollar of the taxable property in said county, in any one year.

AN ACT to change the time of holding the District Court in the Counties of Dodge, Brown and Fond du Lac, in the third Judicial District.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the district court for the county of Dodge, shall hereafter be holden on the second Monday of May and the fourth Monday of September.

SEC. 2. That the district court for the county of Brown, shall hereafter be holden on the third Monday of May and the first Monday of October.

SEC. 3. That the district court for the county of Fond du Lac, shall hereafter be holden on the fourth Monday of May and the second Monday of October.

SEC. 4. All acts or parts of acts contravening the provisions of this act are hereby repealed.

SEC. 5. That all writs, summons, process, indictments, recogto be consider- nizances and all other proceedings in said courts which now are, or may hereafter and before the times of holding the courts respectively mentioned in this act, be made returnable in any of the said courts, at any time hereafter, shall be considered as returnable at the times fixed in this act for holding the next ensuing

terms of said court, and all causes adjourned, continued, or noticed for trial or argument, shall be held to be for trial or argument at the times fixed by this act for holding the next ensuing terms of said courts in said counties respectively.

SEC. 6. This act shall take effect on the first day of March

next.

AN ACT relating to the Rochester dam.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the act to authorize Levi Godfrey, Philo Belden and Hiland S. Hulburt to build and maintain a dam on Fox river, approved March 29, 1843, shall not be so construed as to authorize any person to build or maintain any dam, which shall raise the water so high as to cause it to flow back upon any water power upon the same stream above said dam, or in any wise to injure the same; and so much of said act as might be so construed, is hereby repealed.

SEC. 2. This act shall take effect from its passage.

AN ACT to amend an act entitled "An act to incorporate the trustees of the Village of Mineral Point," approved January 11th, 1844.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the north west quarter of section five, in town Boundaries four of range three, east of the fourth principal meridian, in the extended. county of Iowa, in said territory, shall constitute a part of the vil lage of Mineral Point, in the same manner that it would have done if it had been included among the several tracts of land mentioned in the first section of the act of which this is amendatory.
