subsequent law impairing the rights thus acquired, impairs the obligation which the contract imposed. I submit to the As sembly whether there is any law of the Territory which eon. ficts with this decision, and which may therefore require amendment.

I avail myself of this occasion to remark that I consider the appointment of civil officers of the Territory by the Council and House of Representatives, the exercise of an authority not gran ted by the acts of Congress, and being an encroachment upon the powers of the Executive, it will become my duty to resist it by such means as the constitution has provided for the Executive to protect itself,

Mr. Capron moved that the said message do lie on the table and that two hundred copies thereof be printed.

Mr. Elmore called for a division of the question, when the question was put on ordering the message to lie on the table, and it passed in the affirmative.

Mr. Hamilton moved to amend the remaining part of the mo. tion, so that three hundred copies should be printed

Which being put was disagreed to.

Mr. Darling then moved to amend so that the usual number of copies should be printed.

Which was disagreed to.

Mr, Hamilton then moved that five hundred copies be ordered to be printed.

Which being put was determined in the negative.

And the ayes and noes being called for,

Messrs. Capron, Hamilton, Thompson and Ellis, [Speaker]

Those who voted in the negative, are

Messrs. Agry, Bartlett, Cossman, Darling, Elmore Hicks, Hunkins, Judson, Long, Manahan, Masters, Meeker, Olin, Platt, Parsons, Price, Tripp, Trowbridge and Van Vleet-19.

The question then recurred on ordering two hundred copies to be printed, and being put, it was determined in the affirmative.

Messrs. Darling, Elmore, Long, Parsons and Walker-5. Mr, Walker, by leave presented the account of P. C. Hale for stationery.

Referred to the committee on Legislative expenditures,

Mr. Crossman gave notice that he should on a future day ask leave to introduce a bill to establish and provde for the use of a uniform orthography of the name of this Territory.

On motin of Mr. Capron,

The House adjourned until to-morrow at 9 o'clock, A. M.

Tuesday, March 28, 1843.

A message from the Council by their Secretary:

"Mr. Speaker: The Council have passed bill No. 15, (of this house) entitled "a bill to amend an act entitled an act to incorporate the village of Racine," with several amendments, in which they ask the concurence of this house.

They have also passed a bill, No. 32, entitled, "an act to change the name of certain towns in Walworth county,'in which the concurrence of this house is asked.

Mr. Hamilton presented the account of Robert Dougherty for recording the enumeration of Iowa county, which was Referred to the committee on territorial expenditures.

Mr. Trowbridge gave notice that he would on a future day ask leave to introduce bills of the following titles, to wit:

"A bill to repeal the act to incorporate the State Bank of Wisconsin," and

"A bill to repeal certain acts therein named."

Mr. Walker gave notice that he should on a future day ask leave to introduce a bill to amend an act entitled "an act concerning the time of commencing actions."

Agreeably to previous notice, and by leave, Mr. Crossman introduced bill Mo. 26, entitled "a bill to establish and provide for the use of a uniform orthography of the name of this Terri. tory.

Which was read the first and second times.

Mr. Crossinan, from the committee on engrossed bills, reported to be correctly engrossed. bill

No. 12, entitled "a bill supplementary to an act entitled an act eoncerning judgments and executions."

Mr. Meek er gave notice that he should on a future day ask

leave to introduce a bill to repeal all acts for the licensing the sale of intoxicating drinks.

Bill No. 12, (H.of R. file) entitled "a bill supplementary to an act entitled an act concerning judgments and executions," was read the third time, when Mr. Hamilton asked and obtained the unanimous consent of the house to amend the bill as follows, to wit:

Insert in the enacting clause "of the Territory of Wisconsin.' The bill was then passed and the title thereof agreed to.

The message from the Council was taken up, when the undermentioned bill was read the first and second times, to wit: No. 32, [C. F.] entitled "an act to change the names of cer. tain towns in Walworth county."

Bill No. 15, [H. of R. file] entitled "a bill to amend an act entitled an act to incorporate the village of Racine," which was returned from the Council with amendments, was considered the amendments of the Council read, and severally concurred in. Mr. Olin offered the following resolution which was adopted, to wit:

Resolved, That the clerk of the House of Representatives call on the Hon. the Council for a certain petition in relation to the division of the town of Troy.

On motoin of Mr. Capron,

The House resolved itself into the committee of the whole house, Mr. Bartlett in the chair, having under consideration the following entitled bills of this house, to wit:

No 22. "a bill relating to set offs before justices of the peace." No. 23, "a bill to repeal the 8th section of an act entitled an act to amend an act concerning justices of the peace."

And the undermentioned bill from the Council to wit:

No. 20, entitled "a bill for the preservation of deer in certain counties."

And pending the report of the committee the secretary of the

Council was announced, when the Speaker took the chair and the following message from the Council was received, to wit: "Mr. Speaker-The following resolution has this day passed the Council, of which I am directed to inform this House :

Resolved, That the secretary of the Council be directed to inform the House of Representatives that a bill entitled "a bill to amend an act entitled an act to incorporate the village of Ra. cine," has not passed the Council, and that the return of said bill to the House of Representatives was in consequence of a mistake."

I am further directed to inform this House that the Council have this day passed bill No. 35, "a bill relative to Dodge county," in which the concurrence of this house is requested.

And to transmit to this house a petition of the citizens of the town of Troy relative to a division of the town of Troy.

The committee then resumed its session and after a short time rose when Mr. Bartlett reported that the committee had made some progress on bill No. 20, and desired leave to sit again thereon, and that be had been directed to report bills Nos. 22 and 23 without amendment.

Leave was granted to the committee to sit again on bill No.

On motion of Mr. Capron,

Bills No. 22 and 23 were referred to the committee on the judiciary.

Mr. Trowbridge gave notice that he should on some future day ask leave to introduce a bill to repeal an act entitled " an act to incorporate the Milwaukee manufacturing and hydraulic company," approved March 11th, 183 9.

On motion of Mr. Hamilton,

Mr. Agry was appointed of the committee on the judiciary in
