The question was then taken on adopting the resolution as amended, and it was determined in the negative.

On motion of Mr. Capron, and by the unanimous consent of the House, the bill was amended as follows, to wit:

By inserting "Be it enacted by the Council and House of Representatives of the Territory of Wisconsin," and by striking out in the first line of the first section, the word "second," and inserting in lieu thereof, the word "first."

The bill was then passed and the title thereof agreed to.

Mr. Long from the committee on enrolled bills, reported the following to be correctly enrolled, to wit:

"An act to amend an act entitled an act to incorporate the village of Racine."

Which was signed by the Speaker and ordered to be presented to the President of the Council for his signature.

Bill No. 18, (C. F.] entitled "a bill to provide for the elec. tion of territorial printer."

Was taken up, when

On motion of Mr. Platt,

A call of the House was made and the sergeant.at-arms directed to notify the absent members that their presence was required in the House.

The absent members having appeared

Further proceedings in the call of the House were dispensed with.

Mr. Hamilton then moved to amend the said bill by inserting in the second section, after the word "sufficient," the word

Mr. Hamilton moved to amend the said bill by striking out in the ninth line of the fourth section, the words "and the," and inserting instead thereof, the word "time."

A message from the Council by their Secretary:

"Mr. Speaker: The Council have passed the following en titled bills, No. 12, "a bill to amend an act to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession in said lands approved January 4th, 1842." No. 24, "a bill to authorize Clauden Stoughton and Luke Stoughton to build and maintain a dam across Rock River, and also to authorise Anson W. Pope

and Virgil Pope to build and maintain a dam across said stream," in which the concurrence of this house is asked.

The Council have also concurred in the (amendment of this House to the amendment of the Council to bill No. 35, (C F.) entitled "a bill relating to Dodge county."

The Council have passed this day bill No. 28, (C F) “ to legalise the official acts of James H. Lockwood," in which the concurrence of this house is asked."

Mr. Platt moved to strike out the word "sixty" in the fourth section of said bill, and insert instead thereof the word "ninety." Which was disagreed to.

Mr. Platt then moved to insert the word "print" after the word "shall" in the fifth section.

Which was disagreed to.

Mr. Hamilton moved to strike out the word "sixty" in the sixth section and insert instead thereof the word "fifty." Which being put was determined in the negative.

And the ayes and noes being called for,

Mr. Olin moved to amend the motion by striking out the words "sixty-two and a half,” and inserting in lieu thereof the words "fifty six."

Which being put was determined in the negative.

The question then recurred on the motion of Mr. Hamilton, Which being put was determined in the negative.

A motion was made by Mr. Hamilton to amend the bill in section six, by striking eut "twenty-five" after the word "journal," and inserting "twelve and a half."

And the question being put, it passed in the negative.

A motion was then made by Mr. Hicks, to amend the bill by striking out in the sixth section the first, second, third, fourth, and fifth lines, to the word "copy," and inserting :

"The superintendent of territorial property shall cause to be published in two public newspapers in the territory a notice for sealed proposals to be received on the fifteenth day of April next, also hereafter on the first day of the annual meeting of the Legislature, for doing the public printing, and the same shall give security for the performance of his contract in a bond as hereinbefore provided for in this act.

Mr. Olin moved to strike out "the Territory," and insert "Madison,"

Which was accepted by Mr. Hicks.

And pending the question on the adoption of the said amendment,

Mr. Hopkins moved that the bill and amendment do lie on the table.

And the question being put, it passed in the negative.

And the ayes and noes being called for,

Those who voted in the affirmative, are
