On motion of Mr. Agry,

The following resolution from the Council was taken up and adopted:

Resolved, by the Council and House of Representatives, That the superintendent of Territorial property be directed not to receive the stationery &c. in the library, which Messrs. J. and L. Ward claim to have been purchased of them, by Almon Lull, late librarian, for the use of the Legislature.

On motion of Mr. Hunkins,

The house took up bill

No. 17, [C. F.] "a bill to incorporate the Prarieville manufacturing company,"

Mr. Hamilton moved to amend the bill by striking out all after the word "reservoir," in the sixth section of said bill to the word "Prairieville" and inserting instead thereof, the following: "erect mills and machinery to be moved by water power, on any land owned by them in the town of,"

Which being put was agreed to.

Mr. Hamilton moved further to amend the sixth section by inserting after the word "estate," the following words: "except undivided interests in any land or real estate."

Which being put, was disagreed to.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. Hamilton, Price, Thompson, Tripp, and Ellis [Spea er]-5.

Those who voted in the negative are

Messrs. Agry, Bartlett, Capron, Crossman, Darling, Hicks, Hopkins, Hunkins, Judson, Long, Manahan, Masters, Meeker, Olin, Palmer, Platt, Parsons, Trowbridge, Van Vliet and Walker, 20.

So the amendment was lost.

Mr. Meeker moved to adjourn,

Which was disagreed to.

The said bill was then ordered to a third reading.

A message from the Council by their Secretary:

"Mr. Speaker-I am directed to inform the House that the Council have concurred in the amendments made by the House to bill No. 18, [C. F.]" a bill to provide for the election of a territorial printer," with an amendment thereto, in which the concurrence of the house is asked."

And then the House adjourned until 2 o'clock, P. M.

TWO O'CLOCK, P. M.

Mr. Hamilton rose to a point of order and inquired whether it was in order for the clerk to transmit to the Council a bill or other paper which had been passed by the House, untill two days thereafter.

The Speaker decided that such had been the practice.

Mr. Capron offered the following resolution which was adop ted, to wit:

Resolved, That Leander Berge have leave of absence until Tuesday the 4th day of April next, and that Alfred Boyles be substituted in his place as fireman for that time.

Mr. Walker moved to suspend the sixteenth rule of this house, with reference to No. 17, [C. F.] entitled "a bill to incorporate the Prairieville manufacturing company,"

And that the same be now read the third time and passed. And the motion was put and determined in the negative.

Those who voted in the affirmative are

Messrs. Crossman, Darling, Hopkins, Hunkins, Long, Manahan, Masters, Olin, Parsons, Trowbridge, Van Vliet and Walk. er, 12.

Those who voted in the negative, are

Messrs. Agry, Bartlett, Capron, Hamilton, Hicks, Judson, Meeker, Palmer, Platt, Price, Thompson, Tripp, and Ellis, [Speaker]-13.

On motion of Mr. Trowbridge,

The house resolved itself into the committee of the whole house, Mr. Judson in the chair, for the con sideation of bill

No. 28, [H. of R. file] entitled "a bill to repeal an act en. titled an act to incorporate the state bank of Wisconsin."

And after a short time spent therein, the committee rose and reported the same back to the house without amendment.

The bill was ordered to be engrossed for the third reading. The house took up for consideration the message from the Council, when the amendment of the Council to bill

No. 18, [C. F.] entitled "a bill to provide for the election of a territorial printer.",

Was read and concurred in.

Mr. Palmer presented the account of David Lambert for pub. lishing in the Wisconsin Enquirer, the laws of the session of

1842.

Which was referred to the conmittee on Legislative expendi

tures.

On motion of Mr. Platt,

The House resolved itself into the committee of the whole House, Mr. Meeker in the chair, having under consideration bills of the following titles, from the Council, viz:

No. 12, "A bill to amend an act to prevent tresspass and other injuries to the possessions of settlers on public lands, and

to define the right of possessions on said lands, approved Jan. uary 4th, 1840."

No. 28, "A bill to legalize the official acts of James H. Lockwood," and

No. 26, "a bill to repeal the several acts concerning the militia, and for other purposes."

After some time spent therein, the committee rose and reported bill No. 26 back to the House with an amendment, and bills No. 12 and 28 without amendment.

Bill No. 26, and the amendment thereto were referred to the committee on the militia.

Bill No. 28, was ordered to lie on the table, and

No. 12 was ordered to the third reading.

On motion of Mr. Platt.

Ordered, That bill No. 19, (C. F.) entitled "a bill to prohibit public shows for gain without a permit, be recommitted to the committee of the whole House.

The House then resolved itself into the committee of the whole House, Mr. Hicks in the chair, for the consideration of said bill No. 19, and the undermentioned bill of this House, to wit:

No. 24, entitled "a bill establishing the rate of interest."

And after some time spent therein, the committee rose and reported bill No. 19 with amendments thereto, and that they had taken no action on bill No. 24.

The amendments to bill No. 19 were disagreed to.

Mr. Darling moved to amend the bill by striking out the words "twenty-five" in the first section and inserting instead thereof the words one hundred."

And the question being put it was determined in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative are,

Messrs. Bartlett, Capron, Crossman, Darling, Hamilton, Hicks, Hopkins, Hunkins, Long, Masters, Meeker, Palmer, Par. sons, Thompson, Tripp, Trowbridge, Van Vleet, Walker and Ellis, [Speaker]—19.

Those who voted in the negative are,

Messrs. Agry, Platt, and Price,-3.

Mr. Parsons moved to amend the bill by striking out the words "animal or animals," in the second line of the first sec. tion.

And the question being put, it passed in the negative.

And the ayes and noes being called for,

Those who voted in the affirmative are

Messrs. Hunkins, Masters, Palmer, Platt, Parsons, Price, Trowbridge Van Vleet and Walker--9.

Those who voted in the negative, are

Messrs. Agry, Bartlett, Capron, Crossman, Darling, Hamilton, Hicks, Hopkins, Long, Meeker, Thompson, Tripp, and Ellis (Speaker)-13.

Mr. Platt moved to strike out all after the enacting clause. And pending the question thereon,

Mr. Darling moved to amend the bill by inserting after the word "peace" in the first section "or clerks of the district court."

Which being put was agreed to.

Mr. Agry then made a motion to amend the bill by inserting the following, to wit: "Provided, that nothing contained in this act shall prevent any board of trustees of any incorporated town from taxing such exhibitions, agreeably to their corporate laws and ordinances, passed in pursuance thereof,"

Which being put was disagreed to.

The question then being on the motion of Mr. Platt, to strike out all after the enacting clause,

A call of the House was made, and
