ed leave to sit again thereon, and report bill No. 34 back to the House without amendment.

Leave was granted to the committee of the whole, to sit again on bills No. 27 and 37.

Ordered That bill No. 34 do lie on the table.

On motion of Mr. Trowbridge,

The House resolved itself into the committee of the whole House, Mr. Darling in the chair, having under consideration the undermentioned bill from the Council, to wit:

No. 37, a bill to alter the boundaries of certain towns in the counties of Racine and Rock."

After some time spent therein, the committee rose and reported the same back to the House with an amendment,

Which was eoncurred in, and the bill ordered to third read. ing.

And then the House adjourned until 3 o'clock, P. M.

THREE O'CLOCK, P. M.

Mr. Elmore appeared and took his seat.

Mr. Long, from the committee on enrolled bills, reported the following to be correctly enrolled, to wit:

“An act to authorize Claudon Stoughton and Luke Stough. ton to build and maintain a dam across the Rock river, and also to authorise Anson W. Pope and Virgil Pope to build and maintain a dam across said stream," and

"An act to legalize the official acts of James H. Lockwood." The Speaker signed the same and they were ordered to be presented to the President of the Council for his signature.

The speaker laid before the House a communication from the Milwaukee and Rock River canal company;

Which was read and ordered to lie on the table.

Mr. Darling from the committee on territorial affairs to which the communication of the clerk of the Supreme court of the Territory, was referred report the following resolution : . Resolved, by the Council and House of Representatives of the Territory of Wisconsin, That the Clerk of the Supreme Court be allowed the use of wood for his office, at the expense of the Territory, to be provided by the Superintendent of Territorial property.

Mr. Hamilton moved to amend the resolution by adding thereto the following, to wit: "without any expense to the tory."

Here the Speaker ruled the resolution out of order, ground that it conflicted with the "joint resolution relative to wood furnished for the Legislative Assembly," already passed at the present session.

Agreeably to notice previously given, and by leave, Mr. Platt, introduced

Bill No. 44, entitled "a bill to repeal the charter of the Wis. consin Marine and fire insurance company."

Which was read the first and second times,

On motion of Mr. Hamilton,

The House took up for consideration, the

"Preamble and resolution relative to the resignation of the members of the Assembly,"

With the amendments of the committee of the whole house thereto.

And pending the question on adopting the said amendments Mr. Darling moved to postpone the further consideration of the subject until the fourth Monday of September next.

Mr. Crossman moved that Mr. Judson be excused from voting. Which being put, was disagreed to.

The question was then taken on postponing, and it passed in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative are,

Messrs. Agry, Bartlett, Crossman, Darling, Elmore, Hopkins, Hunkins, Judson, Long, Manahan, Masters, Meeker, Olin, Tripp, Trowbridge Van Vliet, Walker and Ellis (Speaker)-18. Those who voted in the negative, are

Messrs. Capron, Hamilton, Hicks, Palmer, Platt, Parsons, and Thompson-7.

On motion of Mr. Olin,

No. 8, (C. F.) entitled "a bill to establish a territorial road from Prairie du Chien to Lake Superior.'

Was taken up, and the amendments of the Council thereto, read

When the first, second and fourth of the said amendments were concurred in, and the third amendment non-concurred in. Mr. Darling then offered the following amendment to the 4th amendment of the Council, to wit:

Sec. That Wm. R. Hish, Alonzo Raymond, and Narciss Juneau, be and are hereby appointed commissioners to lay out a Territorial road, from Milwaukee to Fond du Lac, via. Menomonee Falls; and the said commissioners are hereby authorized to adopt the survey of any road or part of road previously laid out on said route.

And the question being put thereon, it passed in the affirmative.

Mr. Crossman from the delegation of the counties of Dane, Green, Jefferson, Dodge, and Sauk, to which two petitions on the subject were referred, reported

Bill No. 45, entitled "a bill to provide for completing a roof on the capitol and for other purposes."

The said bill was then read the first and second times.

Mr. Palmer, by leave, presented a petitton of the county com. missioners of Dane county, praying that the Territorial tax now due from said county may be remitted. 1

Which was read and referred to the committee on Territorial affairs.

Mr. Crossman, by leave, submitted the following resolution: Resolved, That the Clerk furnish a list of the names of the members of this House to the Post Master at this place, and that the postage on all letters and papers received by members, (of which they may desire to pay by marking their names on such letters or papers as may be sent) shall be defrayed out of the money appropriated to defray the expenses of the Legislative Assembly.

Mr. Hamilton moved to amend the resolution by striking out the words "sent and."

Which being put was agreed to.

Mr. Hamilton then moved further to amend the resolution by striking out the following words "of which they may desire to pay by marking their name on such letters or papers as may be sent."

Which being put was agreed to.

Mr. Thompson moved that the said resolution be indefinitely postponed.

On motion of Mr. Darling,

Mr. Elmore was excused from voting on the question,

Which was then put, and it passed in the negative.

The question then recurred on the passage of the resolution,

and being put it passed in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative are

Messrs. Crossman, Hamilton, Hicks, Hopkins, Judson, Long Manahan, Masters, Meeker, Platt, Parsons, Price, Tripp, Trowbridge, Van Vleet, Walker and Eilis, [speaker]—17.

Those who voted in the negative are,

Messrs. Agry, Bartlett, Capron, Hunkins, Olin, Palmer, and Thompson,--7.

Mr. Palmer, by leave, presented the account of C. D. Finch for candles for the use of the Assembly which was referred to the committee on Legislative expenditures.

On motion of Mr. Tripp,

The House took up for consideration bill No. 26 [C. F.] entitled "a bill to repeal certain parts of the several acts concerning the militia."

Mr. Tripp made a motion that the House recede from their amendment to the said bill.

And the question being put thereon, it pased in the negative. So the House insisted on their amendment,

An appointed Messrs. Hamilton and Tripp a commmittee of conference thereon.

Ordered, that a conference be requested.
And then the house adjourned.

The Speaker laid before the House a communication from Julius P. B. Mac Cabe, asking that the secretary of the Territory be authorised to subscribe for the Wisconsin Gazetteer for
