a purpose. And I cannot but notice the fact, that since these Resolutions were introduced, the Assembly has found it neces. sary, to meet the demands of the public creditors for debts incurred by the Legislature in former years, to pass a law to levy a direct Tax upon real and personal property, which will when collected amount to several thousand dollars. And other laws have been passed at the session authorizing increased taxation in the towns and counties; and I am unwilling to see them further increased or to give occasion therefor by the passage of these Resolutions.

The question being on the passage of the said resolution. ferred to in the foregoing message, it was put in these words: "will the house on reconsideration pass the resolution?" and it passed in the affirmative, two thirds voting therefor. And the ayes and noes were taken and are as follows: Ayes--Messrs. Crossman, Darling, Elmore, Hamilton, Hicks, Hopkins, Hunkins, Judson, Long, Manahan, Masters, Meeker, Olin, Platt, Parsons, Price, Thompson, Tripp, Trowbridge, Walker and Ellis [Speaker,]-21.

Noes--Messrs. Agry, Capron, Palmer and Van Vleet—4.
So the resolution was passed.

The message from the Governor returning to the Council the bill entitled "an act to provide for the payment of the expenses of the Legislative Assembly," with his objections thereto which had been re-considered and passed by the Council, was read and is as follows:

"To the Legislative Council:

The bill entitled "an act to provide for the payment of the expenses of the Legislative Assembly,"which originated in the Council and was received by me this morning, 1 return with

out my signnture, and I respectfully state the following objec tions thereto

The 117th No. of the act of Congress of the 18th of May, 1842, provides" that the Legislative Assembly of no Territory shall hereafter, in any instance or under any pretext whatever exceed the amount appropriated by Congress for its annual ex. penses."

The appropriation by Congress for these expenses for the half year beginning the 1st of January and ending the 30th of June 1843, is nineteen thousand two hundred and seventy five dollars. The amount appropriated by this bill is, $10,693,97; and pay and mileage of the members is $8,683,30; amounting in all to the sum of nineteen thousand, three hundred and seventy dollars and twenty-seven cents.

The items for expenses previous to the first of January, amount to six thousand and seventy-one dollars and thirty.five cents."

These appear to me to be palpable violations of the above act of Congress.

There are many items in the bill for which no estimate was made by the Secretary of the Treasury; and also many others, which exceed those estimates. Of these I have only time to notice that they amount to more than six thousand dollars.

The estimate made for printing for the House, Council and Executive department, was three thousand dollars; and this bill gives for printing [and newspapers, for which there was no estimate,] five thousand, two hundred and five dollars and fifty-six cents; I object to this too, that it does not contain the proper or usual sum for printing for the Executive Depart. ment; and it allows a greater price for printing, than that for which other printers offered to perform the work. We are re. quired by law, I think, to have the printing done in the cheapest and best manner; and I can discover no justification for reject.

The following items are for the illegal sessions held in December and January last; and it must be fully known to every one that the application to Congress to allow pay for those ses. sions was not granted. They are "To allow Albert G. Ellis, as speaker, the sum of forty-two dollars for the session of December 1842 and January 1843.-"To Moses M. Strong, for services as President of the Council, eighty-four dollars. "To Morgan L. Martin, for services as President of the Council, eighty-four dollars."

The act of Congress of the 29th of August 1842, provides that "no payment shall be made or allowed unless the Secretary of the Treasury shall have estimated therefor, and the object been approved by Congress.

In the adjustment of said accounts [of the Secretary of the Territory] no charge for the services of a greater number of of ficers and attendants shall be allowed than for one Secretary and assistant Secretary or clerk, one sergeant.at.arms, or doorkeeper, one messenger, and one fireman for each house of the Legislature."

All of these provisions are violated by the provisions of this bill; und believing that the officers of the Treasury must and will reject them, I cannot but regard them as an addition of their amount to the public debt of the territory created by charges of a similar character in former years.

Mr. Hamilton moved that the same do lie on the table.

And pending the question thereon, the following message

"Mr. Speaker-The Council have adopted a resolution relative to an examination of the Marine and Fire Insurance Company, also, a resolution relative to a report from the secretary of the Territory-in which resolutions the concur. rence of the house is asked.

The Council have refused to concur in the amendments made by the house to joint resolution relative to printing the Laws and Journals.

The Council have appointed a committee consisting of Messrs. Newland and Rountree to confer with a committee on the part of the House, which they ask to be appointed, in relation to the disagreement of the two houses on bill No. 58, [C. F.] “A bill to provide for the payment of certain Territorial debts therein named."

The question was then put on the motion of Mr. Hamilton to the said bill on the table, and was determined in the nega. tive.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. Capron, Elmore, Hamilton, Hicks, Hopkins, Jud. son, Palmer, Thompson Tripp, and Van Vleet,-10.

Those who voted in the negative are,

Messrs. Agry, Crossman, Darling, Hunkins, Long, Manahan, Masters, Mecker, Olin, Platt, Parsons, Price, Trowbridge, Walker and Ellis [speaker]-15.

The question then recurred on the passage of the said bill and being put in these words: "Will the House on reconsideration pass the bill?" it passed in the affirmative, twenty mem bers (more than two thirds) voting therefor.

And the ayes and noes were taken thereon, and

Those who voted in the affirmative, are

Messrs. Agry, Crossman, Darling, Elmore, Hicks, Hankias Judson, Long, Manahan, Masters, Meeker, Olin, Platt, Parsons;

Price, Thompson, Trowbridge, Van Vleet, Walker and Ellis [speaker)-20.

Those who voted in the negative, are

Messrs. Capron, Hamilton, Hopkins, Palmer and Tripp--5.

The amendments of the Conncil to bill No. 33, [H. of R. file,] "a bill for the relief of the inhabitants of the town of Fond du Lac," were severally read and concurred in.

The action of the Council on "Joint Resolution relative to printing the laws and Journals" being read

The house insisted on their amendments to the said resolution.

On motion of Mr. Hamilton,

Ordered, that a committee of conference be appointed there.

Messrs. Hamilton & Darling were appointed the said com mittee.

Ordered, That a conference be requested.

On motion of Mr. Thompson,

Ordered, that a committee of conference be appointed to confer with the committee appointed by the Council on the disagreemeut relative to bill 58 [Council file] "a bill to provide for the payment of certain territorial debts therein named."

Messrs. Thompson and Meeker were appointed the said committee.

Ordered, that the Council be acquainted therewith.

The following resolution from the Council was read and pass. ed, to wit:

Resolved, by the Council [the House concurring] that the secretary of the Territory be requested to report to the Legis. lative Assembly at its next annual session the amount of bills or drafts by him issued in pursuance of an act entitled an act to authorize the issuing of drafts or bills for the payment of the
