OF THE

HOUSE OF REPRESENTATIVES,

FIRST SESSION OF THE FOURTH LEGISLATIVE ASSEMBLY OF THE TERRITORY OF WISCONSIN :

BEGUN and held at Madison, the Seat of Government, on Mon. day, the fifth day of December, in the year of our Lord one thousand eight hundred and forty-two; being the day fixed by law for the annual meeting of the said Asssembly:

On which day, at 12 o'clock meridian, the House of Representatives was called to order by John Catlin, the Chief Clerk. and the roll being called, the following named members, who had presented certificates of their election, answered to their names and severally took their seats, to wit:

From the County of Brown and counties thereto attached.Messrs. Albert G. Ellis, and Mason C. Darling.

From the counties of Milwaukee and Washington.—Messrs. Andrew E. Elmore, Benjamin Hunkins, Thomas H. Olin, Jonathan Parsons, Jared Thompson and George H. Walker..

From the counties of Rock and Walworth.-Messrs. John Hopkins and James Tripp.

From the counties of Dane, Dodge, Green, Jefferson and Sauk. Messrs. John Hopkins and James Tripp.

From the county of Iowa.-Messrs. Robert M. Long and Moses Meeker.

From the county of Grant.-Messrs. Franklin Z. Hicks, Alonzo Platt and Glendower M. Price.

From the counties of Crawford and St. Croix.--Mr. John

Manahan.

The Clerk stated that a quorum of members was present, and that he would await the pleasure of the house.

On motion of Mr. Darling,

It was ordered, that a committee of two be appointed to request the Hon. David Irvin, Associate Judge of the Supreme Court, to administer the oath of office to the members present in the Representatives' Hall.

Messrs. Darling and Tripp were appointed the said commit.

Mr. Darling, from the said committee, reported that they had performed the duty assigned them, and that the Hon. David Ir. vin would shortly appear in the Representatives' Hall in compliance with the request of the House.

The Hon. David Irvin appeared in the Representatives' Hall, and administered the oath of office to the following named per. sons, to wit:

Messrs. Mason C. Darling, Albert G. Ellis, Andrew E. Elmore, Franklin Z. Hicks, Benjamin Hunkins, John Hopkins, Robert M. Long, John H. Manahan, Robert Masters, Mcses Meeker, Thomas H. Olin, Isaac H Palmer, Jonathan Parsons, Alonzo Platt, Glendower M. Price, Jared Thompson, James Tripp and George H. Walker.

On motion of Mr. Parsons,

The Hon. Albert G, Ellis, of Brown county, was appointed Speaker, pro tem.

On motion of Mr. Meeker,

Resolved, That the standing rules of the House of Represen. tatives of the last session be adopted for the Government of this House at its present session until others are prepared and adopted.

On motion of Mr. Meeker,

Resolved, if the Council concur, that the standing joint rules' of the two houses of the last session be adopted for the Government of the two Houses at their present session, until oth ers are prepared and adopted.

On motion of Mr. Parsons,

J. W. Chubbuck was appointed Doorkeeper pro tem,

On motion of Mr. Tripp,

Leander Birge was appointed Fireman pro tem.

On motion of Mr. Masters,

Wadsworth Hayden was appointed Messenger, pro tem.
On motion of Mr Darling,

Resolved, That the Clerk transmit a communication to the Hon. the Council informing that body that the House of Representatives is now temporarily organized and ready to proceed to business.

Mr. Tripp presented certain documents relating to the election of John M. Capron to a seat in this House.

Which was referred to a committee of three, consisting of Messrs. Tripp, Darling and Meeker.

A message from the Council by their Secretary:

"Mr. Speaker-I am directed to inform this House that the Council are now in organization pro tempore, and ready to proceed to business.

On motion of Mr. Walker,

Resolved, If the Council concur, that a committee of two

The journal of yesterday was read.

Mr. Masters presented the certificate of election of Lyman Crossman to a seat in this House.

Mr. Meeker presented the certificate of the election of William S. Hamilton to a seat in this House, and moved that the said members on being sworn by the Hon. D. Irvin, be admit. ted to their seat.

Which was agreed to.

Messrs. Masters and Meeker were appointed a committee to ask the attendance of the Hon. David Iryin, to administer the oath of office to the members not sworn.

Mr. Tripp from the select committee to which the docu. ments were referred relative to the right of John M. Capron to a seat in this House, made the following report, viz:

"Your committee appointed to inquire into the right of John M. Capron to a seat in this house, Respectfully report that they have examined the papers and documents relating to the same, and find that ninety-three votes were returned from the town of Beloit, as having been cast for J. M. Capron, which return was made by an error of the clerk of the board of election for the said town of Beloit; as the said ninety-three votes were given for John M. Capron, as abundantly appears by the affidavits of the board of election of said town; and in adding the aforesaid ninety three votes which were returned for J. M. Capron to those returned for John M. Capron, we find a majority of seventeen votes for John M. Capron over Juduthan Spooner, who obtained the certificate of election to the seat, which is claimed by John M. Capron; and that said John M. Capron has a majority over either of the other unsuccessful candidates, viz: Augustus C. Kinne, Nathaniel Bell and George B. Hall."
