Mr. Hamilton moved to amend the resolution by striking out the latter clause of the said resolution.

And pending the question thereon, a motion was made by Mr. Hamilton to adjourn until two o'clock, P. M.

Which was disagreed to.

A motion was then made by Mr. Hamilton to lay the resolu tion on the table.

Which was determined in the negative.

The question then recurred on striking out the last clause of the said resolution, and was determined in the affirmative.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. Crossman, Elmore, Hamilton Long, Masters, Olin, Parsons, Platt, Walker and Ellis, [Speaker.]--10.

Those who voted in the negative, are

Messrs. Darling, Hunkins, Judson, Thompson, Tripp, and Trowbridge-6.

The question was then taken on the passage of the resolution, and it was unanimously determined in the affirmative,

And then the House adjourned until 2 o'clock, P. M.

TWO O'CLOCK, P. M.

A message was received from the Council, by their Secre tary:

"Mr. Speaker-I am directed to inform this House that the Council have this day concurred in the joint resolution relative to the appointment of a joint committee to wait upon His Excellency the Governor, with an amendment, and have appointed

Messrs. Crocker and Barber of the committee on their part un der said resolution."

The resolution contained in the foregoing message was taken up and the amendment of the Council thereto, concurred in. Ordered, That the Council be acquainted therewith. Mr. Hunkins, by leave, introduced the undermentioned resolution, which was read the first and second times, to wit: No. 2. "Resolution relative to stationery."

A message from the Council by their Secretary.

"Mr. Speaker :-I am directed to inform this House, that the Council have negatived "Resolution relative to a message to be sent to the Executive," by striking out all after the word "resolved."

On motion of Mr. Elmore,

The House adjourned until half past 3 o'clock, P. M.

HALF PAST THREE O'CLOCK, P. M.

Mr. Darling from the committee appointed for the purpose made the following report:

The joint committee appointed by the two Houses to wait upon his Excellency the Governor, and inform him that the Le. gislative Assembly is now in session pursuant to adjournment, respectfully report :

That they have discharged the duty imposed upon them, and were informed by his Excellency, that he was of the opinion he had formerly expressed, and had no communication to make to the Legislative Assembly, except a copy of his proclamation convening the Legislature on the sixth day of March next, which

On motion of Mr. Hamilton,

The said report together with the proclamation of the Gover. nor, were ordered to be referred to a select committee of five. The Speaker appointed Messrs. Hamilton, Tripp, Darling, Walker and Trowbridge the said committee.

And then the House adjourned until half past 6 o'clock, P. M.

HALF PAST SIX O'CLOCK, P. M.

Mr. Hopkins from the county of Rock and Walworth appear. ed and took his seat.

Mr. Darling presented the certificate of election of the Hon. David Agry to a seat in the House of Representatives, from the county of Brown and the counties thereto attached, and moved that he be admitted to his seat after being sworn by the Speaker. The motion was agreed to.

Thereupon Mr. Agry appeared at the Clerk's table, was sworn by the Speaker, and took his seat.

On motion of Mr. Masters,

The vote referring the report of the joint committee appoint. ed to wait upon his Excellency the Governor, &c., together with the proclamation of the Governor, was reconsidered and the motion to refer the same ordered to lie on the table.

Mr. Hamilton from the committee appointed to examine into the situation of the library, and enquire whether the Librarian. bas contracted for wood, stationery, candles, &c. made the fol. lowing report:

The committee appointed pursuant to resolution to examine the library and enquire, &c. beg leave to report that they adopted the following letter to

Librarian,

SIR-This day the House of Representatives passed the following resolution, "Resolved that a committee of three be appointed to examine into the situation of the library, and enquire whether the Librarian as required by law, had contracted for the delivery of the annual amount of wood, Stationery and Candles, required for the use of the Legislative Assembly; and if so, of whom? what quantity of each, and at what prices? and whether there has been a delivery of any part or the whole of such purchases. Also further to enquire whether there is any of the stationery now on hand which was delivered to the late Librarian at the close of the last annual session; and if so, what kind and quantity?

The chair appointed Messrs. Hamilton, Darling and Hunkins said committee.

We would therefore in accordance with our duty request to be informed when it will be convenient to you that we shall proceed to examine the library and at the same time to hand to us an answer to the enquiries made in the resolution.

To Messrs. HAMILTON, DARLING and HUNKINS,

Gentlemen-Your favor of the 2nd inst. has been received, in which you desire to be informed when it will be convenient for me that you should proceed to examine the library, and hand you an answer, &c.

In reply I have only to say that it will afford me great pleas

ure, and be entirely convenient to give the information desired on the sixth day of March, eighteen hundred and forty-three.

The committee again on the third of February addressed the Librarian another letter, to wit:

HOUSE OF REPRESENTATIVES,

Madison, Feb. 3, 1843.

SIR-Your note of this morning in reply to ours of yesterday inclosing a resolution of enquiry was duly received.

After fully considering its contents, allow us to say, that we deem it not such an answer as was contemplated by the House of Representatives in the passage of the resolution. The House is desirous to obtain the information immediately to enable it to procure wood, stationery, &c. for the present use of the House, should these articles not be on hand, we therefore urge, that an earlier day be fixed for us to visit the library and that you make immediate answers to the questions propounded by the resolution. Your obedient serv'ts,

To this letter the committee have not as yet received an an. swer. Your committee hve deemed it their duty merely to make a statement of facts and leave it to the House to decide what course ought to be pursued. They cannot, however refrain from remarking that the Librarian appointed the 6th day of March to receive your committee and answer the several inquiries, and his subsequent delay in replying to their letter of
