And after some time spent therein, the committee rose and reported the preamble and resolution offered by Mr. Darling without amendment, and the preamble and resolutions introduced by Mr. Walker, with amendments.

Mr. Hamilton moved to amend the report of the committee by striking out in the first resolution, the words, "the 6th of March next."

Mr. Elmore moved to amend the amendment by striking out the words "to adjourn to the"

Which was disagreed to.

The question was then taken on striking out the words, "the sixth day of March next," and decided in the negative. Ayes 5, noes 13.

And the ayes and noes being called for,

Those who voted in the affirmative, are

Messrs. Agry, Hamilton, Long, Masters, and Platt-5.

Those who voted in the negative, are

Messrs. Crossman, Darling, Elmore, Hunkins, Hopkins, Jud. son, Olin, Parsons, Thompson, Tripp. Trowbridge, Walker, and Ellis (Speaker.)—13.

Mr. Judson moved to amend the report of the committee of the whole, by striking out the first, second, and third clauses of the preamble.

Mr. Hamilton moved to amend the motion by striking out the whole of the preamble.

Mr. Agry asked to be excused from voting, and the House refused to excuse him.

The question was then taken and determined in the negative. And the ayes and noes having been called for,

The question was then taken on striking out the first four sec tions of the preamble and was determined in the negative. Mr. Darling moved to amend the report by striking out the words, " we deem it advisable to," and insert in lieu thereof, the words, "when we adjourn we"

Which was agreed to.

The question then recurred on agreeing to the report of the committee as amended,

And it was decided in the affirmative.

Mr. Darling moved a re-consideration of the vote just taken on the passage of said resolutions,

Which was determined in the negative,

The question was then put on the motion of Mr. Darling,
And was decided in the affirmative.

Mr. Judson moved to amend the preamble and resolutions by striking out all after the word "whereas," where it first occurs, and inserting the preamble and resolutions offered by Mr. Darling;

Which was disagreed to.

Messrs. Agry, Hamilton, and Judson-3.

Those who voted in the negative, are

Messre. Crossman, Darling, Elmore, Hopkins, Hunkins, Masters, Olin, Parsons, Platt, Thompson, Trowbridge, Walker, and Ellis, (Speaker)-13.

Mr. Darling moved to amend the first resolution, by inserting after the word "resolved," the words "the Hon. Council concurring."

Mr. Hamilton moved a call of the House,

Which was made;

And a quorum being present, further proceedings in the call of the House were dispensed with.

The amendment moved by Mr. Darling was then agreed to. Mr. Hamilton moved a division of the question on the passage of the resolutions, and insisted that the vote ought to be taken on each resolution.

The Speaker decided that the question was not divisable, inasmunh as the committee of the whole had passed upon both the preamble and resolutions, and the House after both the preamble and resolutions had been amended in committee, had agreed thereto.

Mr. Hamilton appealed from the decision of the chair.

And the question was put, "shall the decision of the Speaker stand as the judgment of the House?"

And determined in the affirmative.

And a division being called there were ayes 9, noes 5.

Mr. Hamilton moved to strike out the first section of the preamble, which was negatived.

And the ayes and noes having been called for,

The House voted unanimously in the negative.
Mr. Darling called the previous question:

Which was sustained by the House.

And the main question was then put on the passage of the prc. amble and resolutions and determined in the affirmative.

And the ayes and noes having been called for,

Those who voted in the affirmative, are

Messrs. Crossman, Darling, Hopkins, Hunkins, Masters, Olin, Parsons, Thompson, Tripp, Trowbridge, Walker and Ellis, (Speaker)-12.

Those who voted in the negative, are

Messrs. Agry, Hamilton, Judson, Long, and Platt-5

So the preamble and resolutions were passed.

Ordered, That the Council be requested to concur therein.

Mr. Darling moved to lay the preamble and resolutions re

ported by him, on the table.

Which was agreed to.

On motion of Mr. Tripp,

The House adjourned until half past 6 o'clock, P. M.

HALF PAST SIX O'CLOCK, P. M.

A message from the Council by their Secretary:

"Mr Speaker-I am directed to inform this House that the Council have concurred in Preamble and Resolutions of the House of Representatives, relative to adjourning the present session until the sixth day of March next, with amendments, in which I am directed to ask the concurrence of this House.

I am also directed to inform you, that the Council have passed, this day, certain joint Resolutions, relative to the adjourn. ment of the Legislative Assembly, in which also the concurrence of this House is asked."

The House took up the resolutions originating in the House and returned with amendments, and the question was put on concurring in the first amendment of the Council to the preamble and resolutions, and unanimously determined in the affirmative. On motion of Mr. Hamilton,

The vote first taken concurring in the first amendment was re-considered.

Mr. Hamilton moved to amend the first amendment of the Council by inserting the following words in lieu thereof:

"Resolved, That the Congress of the United States be reques
