THREE O'CLOCK P. M. Mr. Darling offered the following resolutions, which were read and agreed to, to wit: Resolved, by the Council and House of Representatives, that the repor of the joint committee appointed to wait upon his Ex. cellency the Governor, and inform him that the two Houses were organized pro tempore, an! ready to receive any communication he might have to make to them, be referred to a joint commitee consisting of three members of each House, to report whether there is any valid objection to the Legislative Assembly's holding its annual session at this time; whether it is expedient to adjourn the session of said Legislative Assembly to some other day; whether the Legislative Assembly ought to take any, an d if any, what action expressive of their views, relative to the course pursued by the Executive as exhibited in said report; and gen. erally to report as they may think the circumstances of the case may require,in relation to the said report, of the said joint com. mittee. Resolved, Further, that said committee be requested to ask the Judges of the Supreme Court, now at Madison, for their opinion whether under the laws of Congress as they now exist a session of the Legislature of Wisconsin can legally be held at the present time, Messrs. Darling, Tripp, and Meeker were appointed of the said committee under the said resolutions on the part of the House. Ordered, That the Council be requested to concur therein From the counties of Rock and Walworth.-Messrs. John Hopkins and James Tripp. From the counties of Dane, Dodge, Green, Jefferson and Sauk. From the counties of Crawford and St. Croix.--Mr. John Manahan. The Clerk stated that a quorum of members was present, and that he would await the pleasure of the house. On motion of Mr. Darling, It was ordered, that a committee of two be appointed to request the Hon. David Irvin, Associate Judge of the Supreme Court, to administer the oath of office to the members present in the Representatives' Hall. tee. Messrs. Darling and Tripp were appointed the said commit. Mr. Darling, from the said committee, reported that they had performed the duty assigned them, and that the Hon. David Ir. vin would shortly appear in the Representatives' Hall in compliance with the request of the House. The Hon. David Irvin appeared in the Representatives' Hall, and administered the oath of office to the following named per. sons, to wit: Messrs. Mason C. Darling, Albert G. Ellis, Andrew E. Elmore, Franklin Z. Hicks, Benjamin Hunkins, John Hopkins, Robert M. Long, John H. Manahan, Robert Masters, Mcses Meeker, Thomas H. Olin, Isaac H Palmer, Jonathan Parsons, Alonzo Platt, Glendower M. Price, Jared Thompson, James Tripp and George H. Walker. On motion of Mr. Parsons, js. The Hon. Albert G, Ellis, of Brown county, was appointed Speaker, pro tem. On motion of Mr. Meeker, Resolved, That the standing rules of the House of Represen. tatives of the last session be adopted for the Government of this House at its present session until others are prepared and adopted. On motion of Mr. Meeker, Resolved, if the Council concur, that the standing joint rules' of the two houses of the last session be adopted for the Government of the two Houses at their present session, until others are prepared and adopted. On motion of Mr. Parsons, J. W. Chubbuck was appointed Doorkeeper pro tem, On motion of Mr. Tripp, Leander Birge was appointed Fireman pro tem. On motion of Mr. Masters, Wadsworth Hayden was appointed Messenger, pro tem. Resolved, That the Clerk transmit a communication to the Hon. the Council informing that body that the House of Representatives is now temporarily organized and ready to proceed to business. Mr. Tripp presented certain documents relating to the election of John M. Capron to a seat in this House. Which was referred to a committee of three, consisting of Messrs. Tripp, Darling and Meeker. A message from the Council by their Secretary: "Mr. Speaker-I am directed to inform this House that the Council are now in organization pro tempore, and ready to proceed to business. On motion of Mr. Walker, Resolved, If the Council concur, that a committee of two be appointed by each House, to wait on His Excellency, the Governor, and inform him that the two houses are organized, pro tempore, and ready to receive any communication he may see fit to make them. tee. Martin and Whiton a committee on their part, to act in conjunction with such committee as may be appointed by this house to wait upon his Excellency the Gover nor, and inform him that the two houses are now temporarily organized, and ready to receive any communication he may have to make to them." On motion of Mr. Darling, John F. Meade was appointed Assistant Clerk pro tem. "Mr. Speaker-I am directed to inform this House, that the Council have concurred in the adoption of the joint rules and orders of the two houses of the last session for their govern. ment at the present session, and until others are adopted. Mr. Walker, from the Joint Committee to which the subject was referred, made the following report, to wit : The joint committee appointed to wait upon his Excellency the Governor, and inform him that the two houses of the Legis. lative Assembly, were temporarily organized, and ready to re. ceive any communication he may have to make to them, re. port, that they have discharged the duty assigned them, and that the Governor informed the committee that, "not conceiving that the Legislative Assembly had authority by law, to meet at the present time, he had on communication to make to them."
