SEC. 14. That township number nineteen, north of range fifteen east, north of Fox river, and the south half of township nineteen, north of ranges numbers sixteen and seventeen east, and fractional township eighteen of ranges sixteen and seventeen east, north of Fox river, in Winnebago county, be organized into a separate town by the name of Winnebago, and that the first town meeting be held at the tavern house of L. M. Miller; and that for temporary township purposes, town twenty, north of ranges fourteen and fifteen east, be attached to the town of Winnebago.

SEC. 15. That township thirteen, north of ranges eighteen and nineteen east, in Fond du Lac county, shall constitute a separate town, and shall be known by the name of Auburn, and the first town meeting shall be held at Crouch's mill house.

SEC 16. That township number four, north of range number twenty east, in the county of Racine, is hereby set off into a separate town by the name of Norway, [and] that the first town meeting in such town shall be holden at such place in said town of Norway as the town clerk of the town of Raymond shall by three written notices direct; [and] it shall be the duty of said town clerk to cause said notices to be posted up in three of the most public places in said town of Norway, at least three weeks before the (said) first Tuesday of April next.

SEC. 17. That all that part of the county of Winnebago embraced in the following towns, viz: fractional township number seventeen and eighteen in range fourteen east, and also township seventeen in range fifteen, be and the same are hereby set off and organized into a separate town by the name of Rushford, and that the first town meeting shall be held at the house of L. M. Parsons.

SEC. 18. The said several towns shall be entitled to all the rights and privileges [to] which other towns are entitled by law, and the next town meetings in the said towns shall be held at the time prescribed by law for holding town meetings.

Sec. 19. That in case any town established by this or If towns neglect to orany act passed during the present session, shall neglect organize to be refuse to organize and elect town officers at the April town otherwise meeting, in such case it shall be the duty of the clerk of the board of supervisors of each county to attach such town to some adjoining town which is organized; and such town, for all purposes, shall be considered a part of the town to which it is attached for the time being, anything in any law to the contrary notwithstanding.

SEC. 27. That the thirteenth section of the act to which this is amendatory which entitles the three supervisors of the town of Madison to a seat in the county board of supervisors, approved February 2, 1846, is hereby repealed.

SEC. 28. That township number six, north of number eight, east, in Dane county, shall constitute a separate town by the name of Verona, and the first town meeting shall be held at the school house, in said town.

SEC. 29. That townships numbers eight and nine, north of ranges numbers nine and ten, in Dane county, shall constitute a separate town by the name Windsor, and the first town meeting shall be held at the house of Horace Lawrence.

SEC. 30. That township number nine, north of ranges numbers seven and eight, east, in Dane county, shall constitute a separate town by the name of Clarkson, and the first town meeting shall be held at the house of John Clark.

SEC. 31. That township number seven, north of range number seven, east, shall constitute a separate town by the name of Cross Plains, and the first town meeting shall be held at the house of John W. Thomas.

SEC. 32. That township number fifteen, north, and the south half of township (of) number sixteen, north of range number nineteen, east, in the county of Fond du Lac, be, and the same is hereby set off into a separate town by the name of Forest, and that the first town meeting be held at the house of George Chase, in said town.

SEC. 33. That sections number thirty-one, thirty-two, thirty-three, thirty-four, thirty-five, thirty-six, and the south half of sections numbers twenty-five, twenty-six, twenty-sev en, twenty-eight, twenty-nine, and thirty, in township number eleven, north of range number fourteen, east, in the county of Dodge, be, and the same is hereby attached to the town of Lowell, and shall hereafter be known as a part of

said town.

SEC. 34. That township number thirteen, north of range Le Roy.. number sixteen, east, in the county of Dodge, be, and the same is hereby attached to the town of Le Roy, and shall

hereafter form a part of the said town of Le Roy.

Sac. 35. That the name of the town of Bark River, in the Cold Spring. county of Jefferson, is hereby changed to that of Cold Spring, and shall hereafter be known by that name, and the next town meeting shall be holden at the tavern of D. B. Peck, in the village of Cold Spring.

SEC. 36. That township seventeen, north of ranges six- Brighton. teen and seventeen, east, and the fraction of township eighteen, in range sixteen, lying south of Fox river, in Winnebago county, be organized into a separate town, by the name of Brighton, and the first town meeting shall be held at the house of John Smith.

SEC. 37. That that part of Fond du Lac county embraced in township fifteen and the south half of township sixteen, of ranges numbers eighteen and nineteen, be organized into a separate town by the name of Taycheedah, and that the first town meeting be held at the school house in Taycheedah.

SEC. 38. That so much of any law or laws of this territory as conflict with the provisions of this act, be, and the laws repentsame are hereby repealed, and the said several towns incorporated in this act shall be entitled to, and enjoy all the rights and privileges of other towns in this territory.

SEC. 40. That township one, north of range ten, east, in the county of Rock, shall constitute a separate town, and shall be known by the name of Avon, and the first town meeting shall be held at the house of William Crippen, on the first Tuesday in April next, at the time fixed by law.

AN ACT

To provide for taking the depositions of persons out of the territory to be used before justices of the peace.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the depositions of persons out of the territory of Wisconsin, to be used in cases before justices of the peace, within this territory, may be taken in the same manner, and under the same regulations as depositions are now authorized by law to be taken of persons within this territory, and shall be subject to the same exceptions: Providel, that in no case shall more than forty days' notice of the taking such depositions be required to be given to the adverse party.

SEC. 2. In cases of appeals from any decision or judgment of a justice of the peace, the deposition taken under this, or any other law of the territory, and used before the justice on the trial before him, may be used in the court to which such appeal shall be taken, in the same manner, and subject to
