and there shall also be elected in each ward in said city, at the same time, in the same manner, and for the same term that aldermen are now elected in the several wards, three assessors, one constable, and one street inspector.

SEC. 2. The officers whose election is provided for in the Powers and duties of cerpreceding section, shall have the same powers, perform the tain officers. same duties, and be subject to the same liabilities as if they had been appointed by the common council of said city, and said officers may be removed for incompetency, or malfeasance in office, in the same manner as justices of the peace in said city may by law be removed.

SEC. 3. AN ACT

To incorporate the Beloit Mechanics' Library
Association.

Be it enacted by the Council and House of Reppesentatives of the Territory of Wisconsin:

SECTION 1. That Alexander Douglas, Charles M. Messer, Thomas McElhenny, Andrew R. Masher, and Madison Chamberlain, and their associates, together with such persons as may hereafter be associated with them, be, and they are hereby created a body politic and corporate, with perpetual succession, by the name of the "Beloit Mechanics' Library Association," and by that name shall be competent to contract and be contracted with, to sue and be sued, to answer and be answered unto, in all courts of law and equity, to have a common seal and to change the same at pleasure, to acquire, hold, possess, and enjoy, and to sell and convey property, both real and personal: Provided, the annual income. of such property shall not exceed three hundred dollars: Provided, that nothing herein contained shall authorize the association hereby created, to purchase, sell, or deal in any property except their library and philosophical apparatus, and such buildings as are necessary for their library, lecture, and school rooms, and property connected therewith.

SEC. 2. That any three of the above named persons shall have power to call a meeting by giving six days' notice thereof, by posting up notices in three public places, in the village of Beloit.

SEC. 3. That said association shall have power to form a constitution, and enact bye-laws for its government, to prescribe the number and title of its officers and to define their powers and duties, and such other powers necessary for governing and promoting the welfare and interest of the said association.

SEC. 4. That all bye-laws, rules, and regulations made Concerning and adopted by the members of this association, for the trans- bye-laws. fer of stock, and all other matters necessarily connected with said association, shall be valid in law.

AN ACT

To legalize the official acts of W. W. Kellogg.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the official acts of W. W. Kellogg, while acting as a justice of the peace for the county of Sheboygan, shall not be deemed invalid on account of any informality or illegality in the election of said Kellogg; but his said acts

'shall be as legal and binding as if his election had been in all

respects conformable to law.

AN ACT

To authorize the construction of a bridge across
Fox river.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That Edward Eastman, Samuel H. Farnsworth, Chester Ford, John Smith, Lucas M. Miller, Henry Gallup, George F. Wright, and Jonathan P. Miller, and suck other persons as shall associate with them, be, and they are hereby incorporated by the name and style of "The Fox River Bridge Company," and by such name may sue and be sued, plead and be impleaded in any court in this territory, and may have a common seal and may change the same at pleasure.

SEC. 2. Chester Ford and Lucas M. Miller are hereby appointed commissioners to receive subscriptions to the capiscription tal stock, and shall open a book of subscription at the store when opened of Miller and Eastman, in the village of Oshkosh, on the first Monday of April, A. D. 1847, which book shall be kept open for three days.

SEC. 3. The capital stock of said company shall be three

thousand dollars, and shall be divided in shares of twenty- Capitlal stock five dollars each.

SEC. 4. The said company shall have power to rest the Powers to use said bridge on the southern bank of said river, and may take so much land as shall be necessary for that purpose: Procided, no unnecessary damage shall be done thereby, and in case the said company and the owners of the land shall be unable to agree upon the price of said land, the said company shall choose one appraiser, and the owners another, and the persons so chosen shall proceed to appraise the said land; and in case the said appraisers cannot agree, they shall choose another appraiser, and the price at which the said appraisers shall appraise the said land shall be paid by said company. SEC. 5. The said company shall have power to make bye- Bye-laws. laws for the regulation of the concerns of the said company : Provided, that the said bye-laws shall not be repugnant to the laws of the United States or of Wisconsin.

SEC. 6. The said company shall have power to build and Bridge where construct a bridge across the Fox river, at Miller's Ferry.

SEC. 7. Said bridge shall not be less than twelve feet Bridge how wide, and shall be constructed with a draw over the channel constructed. of the river, not less than twenty-four feet wide, and the said company shall attend to the said draw, so as to permit boats and vessels to pass through the same, at all times, free of charge, and without unnecessary delay; and shall be commenced within one year, and completed within three years.

SEC. 8. The company shall have power after the completion of the bridge to demand and collect toll for passing the same, as follows: For any vehicle drawn by one horse, twelve and a half cents. For any vehicle drawn by two horses, or oxen, twenty-five cents; and for each additional horse, or ox, six and one-fourths cents. Foot passengers, three cents. For a single horse, six and one-fourth cents. For all animals in droves of less than fifty head, three cents each; and for all over fifty, two cents each: Provided, that hogs. and sheep shall not be charged more than at the rate of one cent per head.
