JOURNAL

OF

THE COUNCIL.

First annual session of the fifth Legislative Assembly of the Territory of Wisconsin, begun and holden at Madison, W. T., on the first Monday, being the fourth day of January, one thousand eight hundred and forty-seven. Pursuant to law, at twelve o'clock M. the roll was called by William R. Smith, secretary, when the following members appeared and took their seats, to wit:

From the county of Racine-Frederick S. Lovell,
From the county of Walworth-Henry Clark.

From the county of Rock-Andrew Palmer.

From the counties of Iowa and Richland-William Singer, From the county of Grant-Orris McCartney.

From the counties of Green, Dane and Sauk-Alexander L. Collins.

From the counties of Dodge and Jefferson-John E. Holmes. From the county of Milwaukee-Horatio N. Wells. From the counties of Washington and Sheboygan-Chauncey M. Phelps.

From the counties of Manitowoc, Brown, Calumet, Winnebago, Fond du Lac, Marquette, Portage and Columbia-Mason C. Darling.

From the county of Waukesha-Joseph Turner.

The secretary announced that all the members of the coun

cil were in attendance, except Mr. Marshall M. Strong, of Racine county, and Mr. Benjamin Manahan, of Crawford county.

A quorum of members being present,

The oath of office was then administered to all the members present, by the Hon. David Irvin, one of the judges of the supreme court of the territory.

On motion of Mr. Lovell,

The council proceeded to organize by the appointment of officers pro tempore.

Whereupon,

On motion of Mr. Wells,

Mason C. Darling was appointed president pro tem.
On motion of Mr. Collins,

William R. Smith was appointed secretary pro tem.
On motion of Mr. Lovell,

Eugene S. Turner was appointed assistant secretary pro

tem.

On motion of Mr. Turner,

Edgar R. Hugunin was appointed sergeant-at-arms pro

tem.

On motion of Mr. Wells,

William Reynolds was appointed messenger pro tem.

On motion of Mr. Holmes,

James Rogan was appointed fireman pro tem.

Mr. Wells ofd the following resolution:

"Resolv

at the rules of the former session of the council be opted as the rules of the present session, until others are adopted;"

Which was considered and adopted.

A message was received from the house of representatives, as follows:

"Mr. President-I am directed to inform you that the house of representatives have organized pro tempore, and are now ready to proceed to business; and that Messrs. Morrow and Haight have been appointed a committee on the part of the house to act in conjunction with a similar committee to be appointed on the part of the council to wait upon his Ex

cellency the Governor, and inform him that the two houses are temporarily organized and ready to receive any communication he may have to make to them."

Mr, Wells offered the following resolution:

Resolved, (the house concurring,) That the standing joint rules of the two houses of the last session be adopted as the joint rules of the two houses for the present session, until others are adopted;"

Which was considered and adopted.

Mr. Lovell offered the following resolution :

Resolved, That the secretary be instructed to inform the house of representatives of the organization of the council, pro tempore, and that the council is now ready to proceed to business;"

Which was considered and adopted.

The president appointed Messrs. Lovell and Clark the committee on the part of the council to act in conjunction with the committee appointed on the part of the house of representatives to wait upon the governor and inform him of the organization of the two houses, and that they are now ready to receive any communication he may have to make to 'them.

And the said committee having performed the duty assign ed to them, reported

"That the governor had informed the committee that he would in person communicate to the two bes in the representatives' chamber, to-morrow at twelve ney M." Mr. Wells offered the following resolution. 7

Resolved, That the secretary of the counci. be directed to make out and furnish to the members of the council certificates of their mileage as soon as practicable;"

Which was considered and adopted.

Mr. Lovell offered the following resolution:

Resolved, That a committee of three members be apappointed to revise the rules of the council, and report as early as practicable;"

Which was considered and adopted, and

Messrs. Lovell, Wells and Collins appointed such commit

tee.
