The Senate then advised and consented to the nominations, as per message, of the persons for inspectors of the state prison, by the following:

The nominations for commissioners, under the act to vacate the seat of justice for the county of Branch, were then confirm

Mr. Witherell moved to refer the nominations of Nathaniel Bacon and Edwin Lawrence, for prosecuting attorneys in their respective counties, to the committee on the judiciary; which was not agreed to, the following being the vote:

The Senate then advised and consented to the said nominations of Nathaniel Bacon and Edwin Lawrence, as aforesaid,

The motion heretofore made, to re-consider the vote by which the nomination of Henry H. Brown, for notary public, for Wayne county, was rejected, was put, and prevailed. The said nomination was then confirmed, by the following vote:

Mr. Witherell withdrew the motion he made in a former session, to re-consider the vote by which the nomination of David Wallingford for notary public for the county of Calhoun, was confirmed.

Mr. Drake, from the committee on the judiciary, to whom was heretofore referred the nomination of David L. Johns, of Calhoun county, to be prosecuting attorney for the county of Barry; and also, the nominations of Fletcher Ransom, Alexander H. Scott, David B. Webster and William Welch, to be masters in chancery for Kalamazoo county, reported the same back and recommended that the Senate reject that of David L

Johns, on the ground of his residing in a county other than that for which the said office is intended; and the committee further recommend that the other nominations be confirmed.

The vote being then taken on the nomination of David L. Johns, it was advised and consented to, as follows:

The Senate then advised and consented to the other four nominations, just reported back by the judiciary committee, by

The Senators were all present, and were called to order by Senator Gidley, President, pro tem.

The following message was announced from the Executive; To the Senate:

I hereby nominate David Adams, of Jackson county, to be agent of the state prison.

The nomination, by this message, was advised and consented

to, by the following vote:

A committee of two were appointed, consisting of Messrs. Witherell and LeRoy, to wait upon the Executive and see if he wished to make any more nominations to the Senate the present session.

After a short absence the committee reported the discharge of the duty, and informed the Senate that the Executive would send in one other nomination forthwith.

The President, pro tem., announced the following message from the Executive:

To the Senate:

I hereby nominate Edwin S. Lathrop, to be commissioner to superintend the construction of the state prison.

Executive Office, April 1, 1840.

The Senate confirmed the same, by the following vote:
