Met according to adjournment.

The resolution from the House of Representatives,authorizing his Excellency the Governor,to appoint a Commissioner or Commissioners to co-operate with an Engineer of the United States, was read the third time.

Resolved, that this resolution pass.

Ordered, that the Clerk notify the House of Representatives accordingly.

A message from the House of Representatives by Mr. Chadwick, their Clerk.

Mr. President-The House of Representatives have passed a resolution prescribing the manner of proceeding in balloting for the choice of Senator from this State to the Congress of the United States; in which they request the concurrence of the Senate.. And he withdrew.

The resolution prescribing the manner of proceeding in balloting for the choice of Senator to the Congress of the United States-was read a first and second time; and,

On motion of Mr. Handerson,

Ordered, that said resolution be referred to a select committee to consider and report thereon; and that

Messrs. Handerson, Burgin and Claggett, be said committee.

Mr. Handerson, from the committee to whom was referred the resolution prescribing the manner of procecding in balloting for the choice of Senator, &c. reported said resolution with an amendment: add the following proviso

"Provided nevertheless, That if the House of Representatives after balloting three several times, shall not effect a choice of a Senator on their part, notice thereof shall be given to the Senate, and the Senate may proceed to elect a Senator on their part, and give notice thereof to the House." Which amendment was agreed to by the Senate.

On motion of Mr. Handerson,

Ordered, That the rules of the Senate be so far dispensed with that said resolution be read a third time at the present time..

On the question, Shall the resolution pass as amended, the ayes and noes were required by Mr. Claggett :

Messrs. Brodhead, Burgin, Peirce, Bean, Bowers, Harvey, Handerson, Johnson, Webster-9.

Those who voted in the negative, areMessrs. Claggett, Chandler-2.

Yeas 9-Nays 2.

So the question was carried in the affirmative, and the resolution passed.

Ordered, That the Clerk notify the House of Representatives accordingly.

A message from the House of Representatives by Mr. Chadwick, their Clerk:

Mr. President-I am directed to inform the Senate that the House of Representatives do not concur in the amendment proposed by the Senate to the resolution prescribing the manner of proceeding in balloting for the choice of Senator. And he withdrew.

On motion of Mr. Peirce,

Ordered, that said resolution lic on the table.

Adjourned to 3 o'clock afternoon.

Mr. President-The House of Representatives have passed a resolution authorizing His Excellency the Governor to draw on the Treasury for any sum of money, not

otherwise appropriated, to defray the expenses of the ex

pected visit of Gen. Lafayette to this state; also à resolution in favor of Robert Neal, Commissary General; in which they request the concurrence of the Senate. And he withdrew.

The resolution authorizing His Excellency the Governor to draw on the Treasury for expenses which may be incurred on the expected visit of Gen. Lafayette to this State, was read a first and second time; and,

On motion of Mr. Peirce,

Ordered, that said resolution be referred to a select committee; and that said committee consist of Mr. Peirce, Mr. Handerson and Mr. Bean.

The resolution allowing Robert Neal the sum of two hundred seventy-six dollars and twenty-two cents, was read a first and second time; and,

On motion of Mr. Handerson,

Ordered, that said resolution be referred to the committee of claims.

On motion of Mr. Brodhead,

The Senate resumed the consideration of the resolution prescribing the manner of proceeding in balloting for the choice of Senator from this State to the Congress of the United States.

Resolved, That said resolution be indefinitely postpon

Ordered, that the Clerk notify the House of Representatives accordingly.

Mr. Peirce, from the committee on the resolution from the House, authorizing His Excellency the Governor to draw on the Treasury for expenses which may be incurred in the expected visit of Gen. Lafayette, reported said resolution with an amendment; which amendment is in the following words: Sixth line, after word appropriated, insert "not exceeding the sum of three thousand dol lars."

On motion of Mr. Chandler,

Resolved, that the word three be stricken out of the amendment, and that the word five be inserted; so that the resolution as amended will read thus :

Resolved by the Senate and House of Representatives in General Court convened, That His Excellency the Governor be and he hereby is authorized and empowered to draw on the Treasury for any sum of money not otherwise appropriated,not exceeding the sum of five thousand dollars, to defray the expenses of the expected visit of General Lafayette to this State, to be expended in such manner as the committee of arrangements, appointed by the Senate, and House of Representatives, shall direct.

Ordered, that the Clerk notify the House of Representatives accordingly.

Mr. Burgin, from the committee on claims, to which was referred the resolution allowing Robert Neal the sum of two hundred and seventy-six dollars and twenty-two cents, reported the resolution without amendment.

Resolved, That the rules of the Senate be so far dispensed with that this resolution be read a third time at the present time. The resolution was accordingly read a third time and passed.

Ordered, that the Clerk notify the House of Represenatives accordingly.

Adjourned to 9 o'clock to-morrow morning.

FRIDAY, JUNE 10, 1825.

Mr. Chandler, from the committee on unfinished business, reported the following subjects left unfinished at the last session of the Legislature, viz.

1. A resolution granting Lewis E. Merrill one hundred acres of land.

2. A bill entitled an act to ascertain the settlement of town paupers.

3. An act to incorporate sundry persons by the name of President, Directors and Company of the Pemigewassett Bank.

4. A report of the committee which was directed to inquire into the expediency of prescribing the manner of holding elections for Senators to Congress, agreeably to the Constitution of the United States.

.. 5. Petition of Phinehas Parkhurst, praying that personal property, not in the town where the owner lives, may be taxed to the owner where he resides.

6. A bill entitled an act to alter in part, the dividing line between the towns of Concord and Boscawen.

7. An act requiring the selectmen of the several towns of this State to ascertain and return to the Secretary's office the number of legal voters in their respective

towns.

On motion of Mr. Chandler,

Ordered, that said report lie on the table.

On motion of Mr. Webster,

Ordered, that the petitioners for the Pemigewassett Bank, have liberty to withdraw from the files of the Senate the bill on that subject together with the accompanying papers.

A message from the House of Representatives by Mr. Hubbard :

Mr. President-I am directed to inform the Senate, that the House of Representatives have made choice of the honorable Levi Woodbury as a Senator, to represent this State in the Congress of the United States, six years from the third day of March last; and to request the concurrence of the Senate. And he withdrew.

On motion of Mr. Claggett,

Ordered, that eleven o'clock this forenoon be the time assigned, at which the Senate will go into consideration of the vote of the House of Representatives electing the honorable Levi Woodbury Senator from this State in the Congress of the United States.
