AN ACT

For the relief of Samuel Bacon.

WHEREAS, The state of Nebraska is justly indebted to Preamble. Samuel Bacon in the sum of $3,151.84 for services rendered and money expended by him as principal of the Nebraska Institute for the Blind; therefore,

Be it enacted by the Legislature of the state of Nebraska :

SECTION 1. Three thousand one hundred and fifty-one Appropriation dollars and eighty-four cents ($3,151.84) be and the same is hereby appropriated out of the general fund in the treasury to pay said Samuel Bacon, which shall be paid by warrant of the auditor of public accounts upon the state treasury as other claims are paid. AN ACT

Providing for the redemption of certain school lands in Pawnee county from tax sale.

WHEREAS, The county commissioners of Pawnee Preamble. county in July, 1873, levied taxes for that year on the N-W of section 14, and the s-w of section 23, and the

Appropriation to refund taxes.

s-w of section 25, all being in township No. 3 north, of range No. 11 east, containing 480 acres, and the s-w

of section 18, in township 1 north, of range nine east, and the s-w of section 1, and the s-w of the N-E and the south of the N-w section 26, township 3 north, of range 10 east, and all of section 17, and the north of section 20, in township 3 north, of range 11 east, containing 1,400 acres, such lands having been deeded before that date to the state of Nebraska by David Butler, and at the date of said levy were owned by the state as school lands; and

WHEREAS, Such lands upon which the taxes so levied were sold at tax sale in September, 1874, for the taxes levied by said commissioners, amounting to the sum of $291.44 for state taxes; and

WHEREAS, The county treasurer has made to said purchasers, at said tax sales, a deed for all of said lands, and it is necessary to remove the cloud thereby cast upon the title, in order that the state may sell or lease said lands as other school lands are sold or leased; therefore

Be it enacted by the legislature of the State of Nebraska:

SECTION 1. That the state auditor be and he is hereby authorized, upon the presentation of proper vouchers by the grantees in the tax deeds or their assignees, to draw his warrant on the general fund of the state, in their favor, for the sum of $291.44 taxes levied for state purposes on said lands for the year aforesaid, and the said sum of $291.44 is hereby appropriated out of any funds in the treasury not otherwise appropriated for that purpose.

SECTION 2. WHEREAS, An emergency exists, therefore be it enacted that this act shall take effect and be in force from and after its passage.

AN ACT

To legalize the incorporation of the city of David City, in Butler county, Nebraska, and all acts and ordinances of the council thereof, and the acts of officers thereof.

SECTION. 1. That the ordinance of the town council Ordinances of David City of the town of David City, in Butler county, Nebraska, validated. passed and approved March 18, 1878, incorporating the said town of David City as a city of the second class, "under the name of the city of David City," be and the same is hereby declared legal and valid in all respects.

SEC. 2. That all acts and ordinances of the city same. council thereof, passed since the passage and approval of the said ordinance incorporating the same, proper to be done and enacted by the city council of a city of the second class, be and the same are hereby declared legal and valid in all respects.

SEC. 3. That all acts and things done and performed Acts of officers by any of the proper officers of the said city since the passage and approval of the said ordinance incorporating the same as aforesaid, proper and lawful to be done and performed by the officers of a city of the second class, be and the same are hereby declared legal and valid.

SEC. 4. An emergency exists, therefore be it enacted To take effect. that this act shall take effect and be in force from and

after its passage.

AN ACT

For the relief of Mrs. Harriet Gantt.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the sum of three hundred and thirty-eight dollars and forty-three cents be and the same hereby is appropriated out of any money in the treasury not otherwise appropriated to pay the claims of Mrs. Harriet Gantt, widow of the late chief justice, for services rendered by her said husband.

SEC. 2. The auditor of public accounts is hereby authorized, upon the presentation of proper vouchers, to draw his warrant on the state treasury in favor of Mrs. Harriet Gantt for the amount herein appropriated.

SEC. 3. Whereas an emergency exists, therefore, be it enacted that this act shall take effect and be in force from and after its passage.

Preamble.

AN ACT

For the relief of Thomas L. Griffey and E. K. Valentine.

WHEREAS, Thomas L. Griffey was by the state board of canvassers declared elected judge of the sixth judicial district; and they having issued to him a certificate of election to said office, he entered upon and discharged the duties of said office from the 6th day of January, until the 23d day of November, 1876, at which time he

was ousted from said office by reason of a decision of the supreme court declaring E. K. Valentine duly elected to said office; and

WHEREAS, The said E. K. Valentine, by reason of said decision is entitled to the emoluments of said office during all of the said time, and the said Griffey having drawn the salary of said office for the first (1st), second (2d), and third (3d) quarters of said year, and said E. K. Valentine having drawn no part thereof; and

WHEREAS, The said Thomas L. Griffey having performed the duties of said office from October 1st, until November 23d, 1876, under said certificate of election without pay; therefore,

Be it enacted by the Legislature of the State of Nebraska:

for T. L. Griffey

SECTION 1. That the sum of three hundred and sixty- Appropriation three dollars be and the same is appropriated out of the state general fund for the payment of said claim to said Thomas L. Griffey.

for E. K. Valen

SEC. 2. That the sum of one thousand eight hundred Appropriation and seventy-five dollars be and the same is appropriated tine. out of the state general fund for the payment of said

claim to said E. K. Valentine.
