(H. 68.) Mr. Hall, from the Committee on Roads, to which was referred the bill entitled "An act to incorporate the Vermont and Canada Rail Road Company," reported in favor of the passage of said bill, with amendments; which amendments were adopted, and said bill was read the second time.

Ordered, That it be engrossed and read the third time.

(H. 58.) Mr. Crowley, from the General Committee, to which was referred the bill entitled "An act relating to Public Squares and Commons," reported in favor of the passage thereof; and said bill was read the second time.

Ordered, That it be engrossed and read the third time to-morrow morning.

A message from the Senate by Mr. Clarke, their Secretary:

MR. SPEAKER:-The Governor has announced to the Senate that he has this day approved and signed the bill (S. 27) entitled "An act in addition to Chapter 18 of the Revised Statutes, entitled 'Of Common Schools.'"

The Senate have considered the resolution from the House of Rep resentatives, providing for a meeting of the Joint Assembly to elect three Directors, a Superintendent, and Chaplain of the State Prison; and also a Commissioner of the Insane Asylum, and have passed the same in concurrence.

The Senate have passed bills of the following titles, in which they request the concurrence of the House of Representatives, namely:

(S. 33.) "An act altering the name of Howard Parker Johnson." (S. 21.) "An act to amend the Charter of the Burlington Mill Company."

(H. 42.) Mr. Stevens, from the Judiciary Committee, to which was referred the bill entitled "An act to expedite proceedings in Chancery," reported that said bill ought not to pass.

And the question was put, Shall the bill be read the second time? and was determined in the negative.;

And said bill was rejected.

(H. 35.) Mr. Stevens, from the Judiciary Committee, to which was referred the bill entitled "An act in relation to the competency of Witnesses," reported in favor of the passage of the same, and said bill was read the second time; when, on motion of Mr. Stevens, said bill was recommitted to the Judiciary Committee.

(S. 24.) Mr. Hall, from the Committee on Roads, to which was referred the bill from the Senate entitled "An act relating to the laying out

of Highways, in addition to Chapter 20 of the Revised Statutes," reported that the same ought to pass; and said bill was read the second time, and Ordered, To be read the third time to-morrow morning.

(H. 71.) Mr. Swift, from the Judiciary Committee, to which was referred the bill entitled "An act for the relief of the town of Berlin," reported in favor of the passage of the same, and said bill was read the second time.

-Ordered, That it be engrossed and read the third time.

(H. 99.) Mr. Swift, from the Judiciary Committee, to which was referred the bill entitled "An act in relation to the organization of School Districts in unorganized Towns and Gores," reported in favor of the same, with an amendment; which amendment was adopted, and the bill read the second time.

Ordered, That it be engrossed and read the third time to-morrow morning.

Mr. Jones of Chelsea, from the Committee of Claims, to which was referred the account of Warren Bliss against the State for expense incurred in apprehending a felon, reported that the same ought not to be allowed.

Mr. Chase of Franklin moved to recommit said account to the Committee of Claims; which motion was agreed to.

(H. 109.) Mr. Russell, from the Judiciary Committee, to which was referred the petition of L. E. Pelton and others, praying that lands held under a durable lease, may be assessed to the landlord, reported that the prayer thereof ought not to be granted, but that, in the opinion of said Committee, the lessors, in all cases where by the terms of the lease, the lessee pays the taxes on the land, ought to be assessed for the rents; and for that purpose reported a bill entitled "An act in addition to an act relating to the Grand List,' approved November 1, 1841;" which bill was read the first and second time; and it was

Ordered, That it be engrossed and read the third time to-morrow morning.

(S. 28.) Mr. Rice, from the Committee of Ways and Means, to which was referred the bill from the Senate, entitled "An act in amendment of Chapter 107 of the Revised Statutes, entitled Of Salaries and Fees,' reported adversely to the passage thereof.

Mr. Thomas moved the reference of said bill to the Judiciary Committee; which motion was lost.

Mr. Thomas moved to lay said bill on the table; which motion was agreed to, and said bill was

Ordered, To lie on the table.

(H. 30) and (H. 110.) Mr. Hall, from the Committee on Roads, to which were referred the petition of C. W. Fenton and others, praying for the grant of a Rail Road from Bennington to the South line of the State, and the bill (H. 30) entitled "An act to incorporate the Rutland and Bennington Rail Road Company," reported as a substitute for said bill (H.30), a bill (H. 110) entitled "An act to incorporate the Western Vermont Rail Road Company," which bill No. 110 was adopted as a substitute for said bill No. 30, and was read the first and second time.

Said bill (H. 110) was amended, on motion of Mr. Button.

Mr. Thomas moved further to amend said bill by adding the following section :

"Sec. 29. This act shall at all times be subject to any future Legislature, to alter, amend or repeal the same, as the public good may require."

Mr. Barlow moved to lay said bill and amendment on the table; which motion was disagreed to.

Mr. Rice moved to amend said amendment, by adding thereto the following proviso:

"Provided, That no repeal or amendment shall be made which shall essentially injure or infringe the rights of the Corporation."

And the question being taken, it was decided in the negative.

And the question was stated from the chair, Shall the bill be amended as moved by Mr. Thomas?

On which question, the yeas and nays having been demanded by Mr. Thomas, were taken, and were as follows;

Mr. Hammond moved to amend the 1st Section by striking out the words "East or West of Otter Creek';" which amendment was disagreed to by the House.

AFTERNOON.

The Speaker announced the appointment of the following gentlemen as the Select Committee on the resolutions introduced this forenoon by Mr. Swift, concerning the powers of the Vermont Central Rail Road Company, namely: Messrs. Swift, Rice, Adams of Grand Isle, Stcddard, Barlow.

On motion of Mr. Crowley,

Leave of absence for the remainder of the session from and after tomorrow was granted to Mr. Bebee, the Representative of the town of Sandgate.

(H. 111.) Mr. Swift introduced a bill entitled "An act relating to the expenses of Courts and of Criminal Proceedings."

Which was read the first time and referred to the Committee of Ways and Means.

(S. 28.) The bill from the Senate entitled "An act in amendment of Chapter 107 of the Revised Statutes, entitled 'Of Salaries and Fees," which was this forenoon ordered to lie on the table, was taken up and

recommitted to the Committee of Ways and Means, on motion of Mr. Rice.

The petition of William Steele and others, and the petition of Lucius Freeman and 54 other citizens of Barnard, praying for the establishment of County Houses of Correction, were presented, and referred to the Select Committee raised on former petitions on the same subject.

(H. 112.) Mr. Goodhue introduced a bill entitled "An act in amendChapter 18 of the Revised Statutes, in relation to the investment of the Surplus Revenue by the towns."

Which was read the first time and referred to the Committee on Education, on motion of Mr. Adams of Grand Isle.

(H. 110.) The House resumed the consideration of the bill entitled "An act to incorporate the Western Vermont Rail Road Company;" which was pending at the adjournment this forenoon.

Mr. Thomas moved an amendment to said bill; when,
