CHAP. 266.—An act to remove the charge of desertion against Urs Ambrose Nunlist.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War is hereby authorized and directed to remove from the records the charge of desertion against Urs Ambrose Nunlist, alias Urs Nunlist, Company C, One hundred and eighteenth Ohio Volunteer Infantry, and substitute therefor discharged from further military service on June fifth, eighteen hundred and sixty-three, by order of the probate court of Hamilton County, Ohio, on writ of habeas corpus, sued out by his father because he was a minor under the age of eighteen years, and placed in the custody of his father, and issue to him a certificate of honorable discharge as of date June fifth, eighteen hundred and sixty-three, by reason of such habeas corpus proceedings.

CHAP. 267.—An act granting a pension to Levi Danley.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and directed to place on the pension roll the name of Levi Danley, late corporal in Captain McClure's company, Illinois Mounted Infantry Volunteers, in the Black Hawk war of eighteen hundred and thirty-two, and pay him a pension at the rate of twelve dollars per month.

Miller, late a nurse in the United States hospitals dur ing the war of the rebellion.

Moore, late a private of Captain Byram's company (E), of Colonel Benjamin Snodgrass's regiment, North Alabama Mounted Volunteers, in the Seminole Indian war, and to pay him a pension of twelve dollars per month. Fosnot, late of Company A, Nineteenth Wisconsin Volunteer Infantry, and pay him a pension at the rate of thirty dollars per month, in lieu of the pension he is now receiving.

Price. of the Treasury of the United States be, and he is hereby, author-justed. ized and directed to adjust, upon principles of equity and justice, the accounts of Rodman M. Price, late purser in the United States Navy, and acting navy agent at San Francisco, California, crediting him with the sum paid over to and receipted for by his successor, A. M. Van Nostrand, acting purser, January fourteenth, eighteen hundred and fifty, and pay to said Rodman M. Price, or his heirs, out of any money in the Treasury not otherwise appropriated, any sum that may be found due him upon such adjustment.

CHAP. 280.-An act to increase the pension of Edward H. Leib.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and directed to increase the pension of Edward H. Leib, late brevet lieutenant colonel Fifth United States Cavalry, from fifty to seventy-two dollars per month, to date from the passage of this act, on account of increased disabilities rendering constant personal attendance and assistance

necessary.

CHAP. 281.—An act to pension Charles W. Geddes for services rendered in the war with Mexico.

Be it enacted by the Senate and House of Representatives of the Charles W. Geddes. United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and required to place the name of Charles W. Geddes, of Washington, District of Columbia, on the pension roll, on account of services on board the United States steamer General Taylor, during the war with Mexico, subject to the limitations and regulations of the pension laws of the United States in pensioning the survivors of the war with Mexico. CHAP. 292.-An act for the relief of D. H. Mitchell,

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay to D. H. Mitchell, out of any moneys in the Treasury not otherwise appropriated, the sum of nine thousand two hundred and seventy dollars and eighty-three cents, in full satisfaction for seven thousand four hundred and sixteen and sixty-seven one-hundredths bushels of corn delivered to the assistant quartermaster at Fort Harker, Kansas, during the months of November and December, in the year eighteen .hundred and sixty-eight, and during the months of January, February, March, and April, in the year eighteen hundred and sixty

nine.

CHAP. 293.-An act to amend the act of Congress approved September twentyninth, eighteen hundred and ninety, authorizing the President to restore Tenedor Ten Eyck to the Army and place him on the retired list.

Be it enacted by the Senate and House of Representatives of the Tenedor Ten Eyck. United States of America in Congress assembled, That the act of Congress approved September twenty-ninth, eighteen hundred and ninety, entitled "An act to authorize the President to restore Tenedor Ten Eyck to his former rank in the Army and to place him on the retired list of army officers," be amended by adding after the word "Infantry," where the same occurs in the said act, the words "th retired list of the Army being increased in number to that extent. Received by the President February 12, 1891.

[NOTE BY THE DEPARTMENT OF STATE.-The foregoing act having been presented to the President of the United States for his approval, and not having been returned by him to the house of Congress in which it originated within the time prescribed by the Constitution of the United States, has become a law without his approval.]

CHAP. 294.-An act to authorize the proper accounting officers of the Treasury to audit and pay the claim of the county of Schuylkill, in the State of Pennsylvania, for money advanced by it under allotments made by soldiers from said county during the late rebellion, by virtue of section twelve of the act of Congress entitled "An act to authorize the employment of volunteers to aid in enforcing the laws and protecting public property," approved July twenty-second, eighteen hundred and sixty-one.

Whereas, the county of Schuylkill, in the State of Pennsylvania, Preamble. during the late rebellion advanced money upon allotments made by soldiers from the said county then in the service of the United States to the families of said soldiers and to others, under and by virtue of section twelve of the act of Congress entitled "An act to authorize Vol. 19, p. 871. the employment of Volunteers to aid in enforcing the laws and protecting public property," approved July twenty-second, eighteen hundred and sixty-one, and the orders and regulations of the Secretary of War made in pursuance of said section of said act of Con gress; and

Whereas, the said county claims that the whole sum so advanced by it has not heretofore been refunded to it by the United States: Therefore

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the proper Schuylkill County, accounting officers of the Treasury be, and are hereby, authorized Pa and directed to audit the claim of the said county of Schuylkill, and paid. and when audited to pay, out of any money in the Treasury not otherwise appropriated, to the said county such portion of the sum advanced upon allotments as aforesaid by the said county which the accounting officers aforesaid may thereby ascertain has not heretofore been refunded to said county by the United States: Provided Proviso. That no sum shall be so refunded when it shall appear to said accounting officers that the soldier making such particular allotment or allotments shall have been also paid by the United States,
