THE People of the State of Wisconsin represented in Senate and Assembly, do enact as follows:

SECTION 1. That H. S. Allen, Stover Rines, Moses Rines, their heirs, associates and assigns be, and they are hereby authorized to construct, erect, and maintain a boom in the Chippewa river, in the county of Chippewa, beginning said boom at the head of Chippewa falls, immediately above where Allen's mills (commonly so called) stand; and from thence extend the same up said stream, so far as may be necessary, not exceeding however two miles from the place of beginning, by the meander line of said rivAnd they may sell or lease the right to use said boom to any person or persons whomsoever, for any term of time whatsoever, within the time limited for the continuing of the privileges herein and hereby granted either in whole or in part.

SEC. 2. The said boom shall be so constructed as not to obstruct the passage of rafts, or any water craft that may pass up or down said river; and the channel of said river shall be in no wise or manner obstructed or encroached upon by said boom.

SEC. 3. Any and every person shall have the right and privilege of running and leaving their property within said boom, by paying therefor the boomage provided by this bill. And any person or persons, who shall allow or permit his, her or their lumber, timber, shingles, logs, or other property to float or pass down said river into said boom, shall be liable to pay the same boomage, as though he, she, or they had run and left the same intentionally within said boom.

SEC. 4. The owners or maintainers of said boom shall have a lien for his, her, or their boomage respectively, upon all property that shall pass into and lie within said boom, until the same shall be fully paid and discharged, after and according to the rates proIvided in this bill.

In all cases where the owner or owners of any property, notified. so lying within said boom, shall be known to him, her, or those hav-i ing a lien thereon, as is provided in the fourth section of this bill, or any other portion thereof, such owner or owners, or some of them shall be requested to discharge such lien, by paying the boomage due thereon, by the person or persons entitled to receive the same, or by his, her, or their agent or attorney. And if such boomage

shall remain unpaid for the space of one day after being so due Chap 26. and demanded, then and in every such case, it shall and may be lawful for the person or persons so entitled to demand and receive the said boomage to, and they are hereby authorized to sell such property, or so much thereof as will discharge such property from the lien thereon. Before any such sale shall take place, the person or persons, or some one of them so entitled to sell, shall post up or cause to be posted up three written or printed notices, Notice to be signed by them or some one of them, in three of the most public given places in the vicinity of said boom, that on a certain day, not less than six nor more than thirty days from the time such notices are posted up, and at some place within sight of the property to be sold, the property described in such notices will be sold at public vendue for the purpose of obtaining payment of the boomage due thereon, which notices shall be in the form following, filling the blanks up as therein indicated:

SEC. 9. In all cases where any person or persons shall be obliged to sell any property as provided in this bill, it shall and may be lawful for him, her, or them so selling, to sell for the boomage due thereon, up to the time of making such sale. And such sales may be made from time to time as circumstances may require.

SEC. 10. When words in this bill are used in the singular number they may be construed to be in the plural number; and so vice versa, wherever the same becomes necessary for the protection of the rights herein intended to be secured.

SEC. 11. The rights, privileges and immunities granted by this bill shall continue and remain in force for the term of twenty-five years next after the passage thereof, unless sooner altered, modified, or changed by the legislature.

SECTION 1. That there be and hereby is appropriated to Rhenof any money in the state treasury, the sum of fifteen hundred and forty-eight dollars and 5-100 in full payment for printing the journals of the two houses and the laws of last session of the legislature.

Chap 48. An act to authorize the city of Racine to aid in the construction of a plank

road.

THE People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. The mayor and common council of the city of Ra

cine are hereby authorized to borrow upon the credit of said city, May borrow ten thousand dollars or less, for five years, in such sums as they money. may deem proper, on interest not exceeding twelve per cent., payable annually, for the purpose of investing the same in the capital stock of the Racine and Rock river plank road company or in case the said money, or any part of it should not be so borrowed, to subscribe for so many shares of said capital stock in said plank road company, that the amount of the same at their par value, together with the money borrowed, shall not exceed ten thousand dollars, and to pay for the same in the bonds of said city, payable in five years as above stated: Provided, that said city shall have no vote in said company upon the shares thus subscribed.

SEC. 2. The shares of stock in said plank road company, thus Shares pledg taken by said city, and all dividends arising from the same, are ed. hereby pledged for the payment of the interest and principal of the bonds authorized to be issued by the first section of this act: Provided, however, that the mayor and common council may sell such shares at par or more, but the proceeds thereof and interest shall still be pledged to pay the interest and principal on said bonds.

SEC. 3. The mayor and common council of said city shall Tax to be levannually levy a tax upon the taxable property of said city, suffi- ied. cient to pay the interest on such bonds, and in one thousand eight hundred and fifty-four shall levy an additional tax sufficient to pay the principal of said bonds.

SEC. 4. This act shall take effect when a majority of the legal voters of said city, voting upon said question, shall vote in favor of the same, at any election called by the mayor and common council for that purpose.

SECTION 1. The sum of eight hundred and twenty dollars is N. W. Dean. hereby appropriated to be paid out of the state treasury to N. W.

Dean in full for building water closet for the use of the Capitol.

An act to vacate the town plat of the town of Oconomowoc. THE People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. That the town plat of the town of Oconomowoc, as laid out by David Finley, on the west 'half of section thirtythree, town eight north of range number seventeen east, be and the same is hereby vacated and annulled, and that all lots pieces or parcels of land, which have been described and conveyed according to 'the record of said plat, shall hereafter be described and known, according to the survey and record of a plat made of the same premises in the month of January, one thousand eight hundred and fortyeight, by I. A. Farnham.

Chap 51. An act to vacate a part of the town plat of the village of Janesville, in

Rock county.

THE People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows :

SECTION 1. That block number forty-two, on main street, and block number fifty-two, on water street, in the village of Janesville, in the county of Rock, heretofore reserved as public landings, be and the same are hereby vacated and all the ground embraced within said blocks may be disposed of in such manner, and for such purposes as the board of supervisors of Rock county, or a majority of them may direct.
