The Senate met pursuant to adjournment. Mr. Speaker Senter in the Chair.

House Message No. 203, to-wit:

Mr. Speaker:-I am directed by the House of Representatves, to transmit herewith, House Joint Resolutions Nos. 202, 203, and 204, adopted; and return House Bill No. 399, Senate amendment concurred in, except the authorizing the employment of a clerk; and House Bill No. 317, amendments Nos. 2 and 3 concurred in, and No. 1 non-concurred in; and Senate Bill No. 207, amended and passed; and Senate Bill No. 219, Senate amendment to House amendments concurred in; and Senate Bill No. 127, Senate amendment to House amendments concurred in; and Senate Bill No. 174, passed.

Senate Bill No. 2, on Report No. 237, was taken up, on House amendments on amendments offered by the committee, to-wit: Strike out "twenty," and insert seventy.

House Bill No. 136, was taken up on its third reading, and passed over informally.

House Bill No. 185, was taken up on its third reading, and passed over informally.

House Bill No. 361, was taken up on its third reading, and passed.

House Bill No. 433, was taken up on its third reading, and passed.

House Bill No. 132, was taken up on its third reading, and referred to the Judiciary Committee.

House Bill No. 420, on Report No. 227, was taken up on its third reading.

Mr. Aldridge moved to lay the Bill and amendments on the table, and called for the ayes and noes, with the following result:

House Bill No. 507, was taken up on Senate amendment No. 3, non-concurred in by the House of Representatives.

Mr. Eckel moved that the Senate recede from said amendment.

Mr. Garner called for the ayes and noes, with the following result:

Mr. Nelson moved to amend by striking out the seventeenth section of the Bill.

Adopted.

Mr. Cate offered the following amendment, to-wit:

SEC.. Be it further enacted, That An Act to incorporate the National Discount and Deposit Bank of Chattanooga, passed December 6, 1866, be, and the same is hereby amended, so as to read "five hundred thousand dollars," instead of "five hundred dollars," the amount of capital stock, as provided in said charter. Adopted.

Mr. Wisener offered the following amendment, to-wit:

SEC.. Be it further enacted, That the Legislature reserves the right and power to alter, amend, or repeal, the charter granted by this Act.

Adopted.

The question was taken on the passage of the Bill.

Mr. Garner called for the ayes and noes, on its passage, with the following result:

Mr. Cate had leave to offer Senate Joint Resolution No. 85, to-wit: "Directing the Comptroller to issue his warrant on the Treasury to John Watkins and others, for two hundred and fifty dollars."

Rules suspended, and Resolution taken up.

The question was taken on the adoption of the Resolution, and

So the Resolution was adopted, and its transmission ordered to the House of Representatives.

Report No. 239, from the Select Committee on House Bill No. 515, to-wit:

Mr. Speaker:-The Special Committee to whom was referred House Bill No. 515, have examined the Bill, and recommend its passage, with the accompanying amendments.

House Bill No. 515, on Report No. 239, was taken up on its third reading, on amendments, to-wit: Strike out all after the enacting clause, and insert the following: "That by and with the consent in writing, signed by the parties, and filed with the Secretary of State, of the lessees of the Penitentiary, J. L. Hyatt and C. M. Briggs, the contract with said lessees is hereby canceled and abrogated, and the Act of 1865, Chapter, and the Act of 1866, Chapter, are hereby repealed."

SEC. Be it further enacted, That the State will take from said lessees, any property, material, or machinery of the lessees, at a liberal price, to be ascertained by four disinterested persons, two to be selected by the Governor, and two by the lessees, and the fifth to be selected by these four appointed, whose award as to the value of said materials, machinery, and property, be binding upon the parties.

SEC. Be it further enacted, That the indebtedness of said lessees to the State, if any, may be discharged, pro rata, with said property, materials, or machinery, at its value, ascertained as aforesaid; and if it be worth more than their indebtedness, the rest to be paid in cash. Said settlement to be made by the Directors of the Penitentiary; and that they are hereby continued in office, at their present compensation, until said settlement be completed.

SEC.

Be it further enacted, That this Act take effect from and after its passage.

Mr. Lindsley moved a non concurrence in amendment No. 2, and called for the ayes and noes, with the following result:
