EIGHTEENTH DAY.

AFTERNOON SESSION.

HOUSE OF REPRESENTATIVES.

Santa Fe, N. M., February 13th, 1907.

Wednesday, 3 o'clock.

House met pursuant to adjournment with the Speaker in the chair.

All members being present except Mr. Walters who was excused, the House proceeded to business.

The Chaplain being excused, prayer was omitted.

Mr. Beach moved that the reading of the Journal be dispensed with, and that it be approved by the Speaker, which motion prevailed.

On motion of Mr. Holt, duly seconded, the rules were suspended for the purpose of receiving the following communications:

A letter under date of February 9th, 1907, from Santiago Madril, member of the Board of County Commissioners, Torrance county, New Mexico, protesting against the passage of Council Bill No. 15. Referred to the Committee on Counties and County Lines. "The Hon. R. L. Baca,

"My Dear Sir: If it is convenient for the House of Representatives to so arrange I would suggest that a joint session of the Legislature be held this afternoon to consider the matter of the establishment of a School of Archaeology at Santa Fe. Judge McFie. Judge Abbott, Professor Hewitt, and others will be there to present the matter to the Legislature.

Mr. Holt moved that the House do favorably consider the suggestion made by the Governor of New Mexico, and that a committee of three members of this House be appointed by the Speaker for the purpose of notifying the Honorable Legislative Council of the action taken, and inviting that Honorable Body to meet with us in joint session this afternoon, as soon as convenient, for the purposes mentioned, which motion prevailed.

The Speaker thereupon appointed the following committee for the above purposes: Messrs. Holt, Mirabal and Sanches (Taos). Under the regular order, Mr. Abbott (Santa Fe), presented a petition from the citizens of Estancia and vicinity protesting against the passage of Council Bill No. 15, or any similar measure,

as to the change of the county seat of Torrance county, which petition was received and referred to the Committee on Counties and County Lines.

Mr. Ruppe, by request, presented a petition by citizens of Artesia, in regard to the new county of Artesia, which was received and referred to the Committee on Counties and Conuty Lines.

The following bills were introduced :

House Bill No. 74, introduced by Mr. Lucero: "An Act for the improvement of the Rio Grande." Read first and second times by title, ordered translated and printed, and referred to the Committee on Territorial Affairs.

House Bill No. 75, introduced by Mr. Ruppe, by request: "An Act creating the county of Artesia, and for other purposes." Read first and second times by title, ordered translated and printed and referred to the Committee on Counties and County Lines.

House Bill No. 76, introduced by Mr. Biernbaum: "An Act entitled an act relative to the issuance of worthless checks." Read first and second times by title, ordered translated and printed and referred to the Committee on Judiciary.

House Bill No. 77, introduced by Mr. Gallegos: "An Act entitled an act to provide for judicial proceedings in cases of lunacy." Read first and second times by title, ordered translated and printed and referred to the Committee on Judiciary."

House. Bill No. 78, introduced by Mr. Gallegos: "An Act entitled an act to repeal that portion of Section 1756 of the Compiled Laws of 1897 relating to railroads." Read first and second times by title, ordered translated and printed and referred to the Committee on Railroads.

House Bill No. 79, introduced by Mr. Gallegos, by request: "An Act entitled an act to provide funds for the construction of a bridge across the Pecos River at Santa Rosa, and for other purposes." Read first and second times by title, ordered translated and printed and referred to the Committee on Finance.

House Bill No. 80, introduced by Mr. Trujillo: "An Act entitled an act in reference to marriage." Read first and second times by title, ordered translated and printed and referred to the Committee on Judiciary.

House Bill No. 81, introduced by Mr. Abbott (Santa Fe): "An Act entitled an act to fix the salaries of Probate Judges." Read first and second times by title, ordered translated and printed, and referred to the Committee on Finance.

House Bill No. 82, introduced by Mr. Sanches (San Miguel): "An Act repealing Chapter 116 of the laws approved March 16th,

1905, entitled 'An Act to define the qualifications and regulate the drawing of jurors,' and re-enacting Chapter 112 approved March 19th, 1903, entitled 'An Act to amend Sections 1, 2, 5, 9 and 11, Chapter 66 of the Laws of New Mexico of 1899." " Read first and second times by title, ordered translated and printed, and referred to the Committee on Judiciary.

House Bill No. 83, introduced by Mr. Studley: "An Act entitled an act to amend Section 2402, Sub-Section 18, of the Compiled Laws of 1897." Read the first and second times by title, ordered translated and printed, and referred to the Committee on Judiciary.

By unanimous consent, Mr. Holt of the committee appointed to invite the Honorable Legislative Council to meet with the House in joint session, reported that the committee had conferred with a like committee of the Honorable Legislative Council, and that the hour of 4 o'clock has been agreed upon for the joint session, a knowledge of which agreement was communicated to the Governor of New Mexico.

On motion of Mr. Beach, duly seconded, the report of the committee was adopted, and the committee discharged.

The Speaker announced that he had signed Council Bill No. 27: "An Act for the relief of the County of Torrance."

Under the regular order, a communication under date of February 13th, 1907, addressed to Captain B. Ruppe, Chairman of Military Committee, by A. P. Tarkington, Adjutant General, extending an invitation to the members of the House to attend a target practice, in skirmish firing, of a squad of men from Company F, First Infantry, next Sunday morning at 10 o'clock.

Mr. Holt moved that the invitation be received, and that it shall be optional with the members of this House as to whether or not they, as individuals, will accept it, which motion prevailed.

Under the order of business on the Speaker's table, Council Substitute for Council Bill No. 11: "An Act for the assessment and collection of taxes on sleeping cars, and repealing Sections 4118, 4119, 4120, and 4121 of the Compiled Laws of 1897, was read first and second times by title, and referred to the Committee on Judiciary.

The House was called to order by the Speaker, and, there being no further business, on motion of Mr. Mirabal, the House adjourned until tomorrow afternoon at 3 o'clock.

Prayer was offered by the Chaplain.

Mr. Abbott (Colfax), moved that the reading of the Journal be dispensed with, and that it be approved by the Speaker, which motion prevailed.

Under the regular order, Mr. Mullens presented petitions for and against the esablishment of Artesia county, which were received and referred to the Committee on Counties and County Lines.

The following report of the Committee on Finance was received:

"Your Committee on Finance, to whom has been referred House Bill No. 2, has had the same under consideration, and I am directed to report the said bill favorably to the House, with the recommendation that it be passed with the amendments hereto attached. "H. B. HOLT, Chairman."

House Bill No. 21, was taken up for conisderation on its third reading, and the report of the committee, recommending its passage with amendments, read.
