Fitch, and John McCalla, be appointed commissioners to lay out a road, by the nearest and most eligible route, to intersect the road from St. Louis to Vintrace to St. Louis cennes, where said road crosses the little Wabash; and that they be authorised to lay out a road from Fairfield, to intersect said road, at any point they may think best, on the way to Vandalia: that Cornelius de Long, George W. a road from John McCalla's dwelling, to the west bank of the Wabash river, opposite to Vincennes, by the nearest and most eligible route: that Samuel B. Birkbeck, James O. Wattles, and David King, be appointed commissioners to lay out a road from Fairfield, by way of Albion, to the west bank of the Wabash river, opposite to Harmony, on the nearest and most eligible route: that William Henry, John Craw, and Risden B. Slocumb, be appointed commissioners to lay out a road from Fairfield to Carmi, by the nearest and most eligible route; the said roads to be four rods wide, and that said commissioners cause a survey and map of the said roads, to be lodged with the clerks of the several counties through which the same shall be so laid out; and that all

the said roads when so laid out as aforesaid, shall be deemed and considered as public highways, and shall be opened and kept in repair in the manner hereinafter pointed out.

Sec. 2. Be it further enacted, That as soon as the aforesaid roads, or any one of them, shall he surveyed and marked out, the county commissioners' court of any county (except the county of Fayette) through which the same may run, are hereby authorised and required, to appoint supervisors over such parts thereof as shall pass through their respective counties, and shall cause the same to be cut out, worked, and kept in repair.

Sec. 3 Be it further enacted, That when any part of said roads shall be laid through any improved lands, the owner or owners thereof shall be paid his or her damages by the county in which

Sec. 4. Be it further enacted, That the sum of one thousand nine hundred and fifteen dollars is hereby appropriated for the purpose of carrying into effect the provisions of this act; and that the auditor of the state is hereby authorised to draw Auditor to issue. his warrants on the treasury, in favor of the said commissioners respectively, for the following sums, to wit: To the commissioners for laying out the road to Shawneetown, the sum of two hundred and fifty dollars; to the commissioners for laying out the road to Kaskaskia, the sum of two hundred dollars; to the. commissioners for laying out the road to Palestine, the sum of one hundred and fifty dollars; to the commissioners for laying out the road to Alton, the sum of two hundred dollars; to the commissioners for laying out the road to America, the sum of two hundred and fifty dollars; to the commissioners for laying out the road to Golconda, the sum of two hundred and fifty dollars; to the commissioners for laying out the road to Illinois on the Mississippi river, the sum of two hundred dollars; to the commissioners for laying

out the road to intersect the road from St. Louis to Vincennes, where the said road crosses the little Wabash, and from Fairfield, the sum of one hundred and fifty dollars; to the commissioners for laying out the road to Vincennes, the sum of one hundred dollars; to the commissioners for laying out the road to Carmi, the sum of seventy-five dollars; to the commissioners for laying out the road to the west bank of the Wabash river opposite Harmony, the sum of ninety dollars.

Sec. 5. Be it further enacted, That the said commissioners, or a major part of them, shall proceed as soon as practicable after the passage of this act, to survey and mark out the said roads: And Thomas Cox, Robert K. M'Laughlin, Eleazer M. Townsend, Martin Jones, John F. M'Collum, and Frederick Hollman, are hereby appointed commissioners, a majority of whom shall, as soon as the said roads are surveyed and marked out, cause the same to be cut out and worked to the boundary line of the county of Fayette: and for this pur pose shall employ the necessary workmen, and keep the said roads in repair, and so construct the said roads to the boundary line of the said county of Fayette, as to make the same passable at all seasons of the year, by erecting bridges, dams, and embankments, where the same may be necessary: and the further sum of six thousand dollars shall be, and the same is hereby allowed to be, paid out of any money in the treasury arising from the former or future sales of lots in the said town of Vandalia not otherwise appropriated, to be applied under the direction of the said Thomas Cox, Robert K. M'Laughlin, Eleazer M. Townsend, Martin Jones, John F. M'Collum, and Frederick Hollman, to the construction of said roads from the said town of Vandalia, to the said county line of Fayette, and to the keeping of the same in repair: and the auditor is hereby authorised and required to issue his warrant on the treasurer of the state, on the order of a majority of the said last named commissioners, from time to time, for such sums as they may require, not exceeding in the whole the said sum of six thousand dollars.

Sec. 6. Be it further enacted, That all the aforesaid commissioners shall be allowed for each days service necessarily spent by them in carrying this

act into effect, such compensation as the next general assembly shall deem reasonable and right.

AN ACT to amend an act entitled, "An act regulating administrations, and the descent of intestates' estates, and for other purposes.

Sec. 1.
