Mr. Morrow, from the committee on Territorial Affairs, to which had been referred

No, 3, (H. of R.) "Resolution requiring the Superintend

ent of Territorial Property to discontinue all territorial suits now pending;"

Made the following report:

MADISON, W. T., Jan. 20, 1846. The committee on Territorial Affairs, to which was recommitted the resolution requiring the Superintendent of Territorial Property to discontinue all suits now pending, in which the Territory is interested as plaintiff, have given the subject a more full examination than in their first report, and ask leave now to submit the following, although substantially the same as previously reported:

There are but three suits of this nature, in which the Territory is interested, now pending. These are severally, yet not explicitly, referred to in the Superintendent's report-upon advising with whom, your committee is informed that it is believed and expected that a part of them, if not all, will terminate favorably and in behalf of the Territory.

Your committee, at this time, have no means of ascertaining the costs that have been incurred in these suits; indeed this could not be done with certainty until said suits are brought to a close, as the services of several attorneys have been employed, and it could not well be known what their charges are or will be until after the same are decided.

Your committee are satisfied, however, that any action on the part of the Legislature with a view to their discontinuance at this time, would be inexpedient and uncalled for. Nor with the knowledge which they have been able to possess themselves of, would they desire a public disclosure of all the facts relating to the same.

They have, therefore, good and substantial reasons for recommending that no further action be had on this subject, and ask the acceptance of this report, and their discharge from any further investigation of the same.

Mr. Wooster moved that the report be accepted and the committee discharged.

Mr. Burnett asked to be excused from voting on the said question.

He was so excused.
