on the Mississippi river, in Wisconsin ;"

Was read the first and second times, and

On motion of Mr. Burnett,

It was referred to a select committee consisting of the members from Grant county.

No. 2. (H. of R.) "A bill to amend the election law concerning justices of the peace;"

Was taken up and the amendments of the Council were concurred in.

No. 4, (H. of R.) "A memorial to Congress upon the subject of a penitentiary;"

Was read the third time, passed, and title agreed to. No. 6, (H. of R.) "Resolution instructing the Superintendent of Territorial Property to procure a room for an armory: Was taken up and read the third time and passed. Mr. Burnett moved to amend the title of said resolution by striking out all after the word "to," and insert "prepare a room for the safe keeping of the public arms and equipments;" Which was agreed to.

The following entitled bills were then read the third time, passed and their titles agreed to, to wit;

No. 35, (H. of R.) "A bill to authorize school district No. 5, in the town of Elkhorn, Walworth county, to renew a tax warrant;"

No. 34, (H. of R.) "A bill to authorize school district No. 1, in Sheboygan county, to levy a tax for building a school house;" and

No. 37, (H. of R.) "A bill to legalize the acts of the officers therein named,"

No. 39, (H. of R.) "A bill for the benefit of Adelbert H. Bishop ;"

Was read the third time and passed, when

Mr. Hoard moved to amend the title of said bill as follows, by striking out the word "benefit," and insert the word "relief;"

Which was disagreed to.

The title of said bill was then agreed to.

No. 38, (H. of R.) " A bill to provide for laying out a terri

torial road from Comb's settlement, in Richland county, to Kickapoo Copper Mines ;"

Was read the third time and passed, when

Mr. Dennis moved to amend the title of said bill by striking out all after the word "laying," and insert, "certain territorial roads therein named;"

Which was agreed to.

The title of the bill as amended was then agreed to.

No. 4, (C.) A memorial to Congress on the subject of a collection district and a port of entry;"

No. 20, (C.) A bill to authorize school district No. 7, in Snake Hollow school town, in Grant county, to levy an additional tax to build a school house;"

No. 29, (C.) "A bill to amend an act entitled 'an act concerning masters in chancery;" and

No. 34, (C.) "A bill to authorize school district No. 3, in the county of Dane, to levy a tax to build a school house;" Were severally read the third time, passed, and their titles agreed to.

Mr. Phelps, from the joint committee on Enrollment, made the following report:

The joint committee on Enrollment report as correctly enrolled,

"Resolution relative to the termination of the present session of the Legislative Assembly;"

"Resolution requiring the Secretary of the Territory to redeem certain bonds and scrip in the hands of the Treasurer of the Territory;"

"An act to organize the county of Sheboygan for judicial purposes."

Which was agreed to.

Mr. MaGone moved a call of the House,

Which was ordered, and Mr. Brawley reported absent, and the Sergeant-at-Arms sent to inform Mr. Brawley that his attendance was required in the House.

The Sergeant-at-Arms having reported all the members in attendance,

On motion of Mr. MaGone,

Further proceedings under the call were dispensed with. And the question having been put,

It was decided in the affirmative.

Mr. Mooers moved that the 18th rule be suspended in ref

erance to

No. 44, (H. of R.) "A bill to provide for the canvasing the votes cast at the general election held on the 4th Monday in September 1845, in the county of Marquette,"

And that said bill be now taken up and considered by the House;

Which was agreed to.

The said bill was then ordered to be engrossed for a third reading.

Mr. Mooers moved that the order of the day, it being

No. 22, (C.)" A bill in relation to the formation of a state government in Wisconsin,"

Be now taken up;

Which was agreed to.

And the question being on concurring in the amendments of the committee of the whole to said bill,

A division of the question was called for,

And the question having been put on concurring in the first amendment of the committee,

It was decided in the affirmative.

And the question having been put on concurring in the second amendment of the committee;

It was decided in the affirmative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Mr. Pole moved to amend the bill as follows:

"Amend the bill by striking out of the third line in the fourteenth section the word 'either;' and also by striking out of the same section all between the words 'United States,' in the third line and the word 'shall,' in the fourth line." Which was disagreed to.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Brown, Burnett, Cruson, Hoard, Jones, Phelps and Pole-7.

Those who voted in the negative were,

Mr Burnett moved further to amend the bill by adding immediately after the word "such," in the eleventh line of section fourteen, the following words "according to the laws of the United States on the subject of naturalization ;"

Which was agreed to.

Mr. Phelps moved further to amend the bill by striking out

the word " Secretary," where it occurs in the bill, and insert "Auditor;"

Which was agreed to.

Mr. Sheldon moved further to amend the bill by striking

out all of section four, after the word "Secretary," in the fifteenth line.

Which was agreed to.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Brawley, Clapp, Croswell, Dennis, Earll, Fisher, Graves, Jackson, Jones, Mooers, Phelps, Pole, Sheldon and Wooster-14.

Those who voted in the negative were,

Messrs. Barstow, Billings, Brown, Burnett, Crawford, Cruson, Hoard, MaGone, Morrow, Parker, and Thomas-11. Mr. Parker moved to re-consider the vote by which the amendment of Mr. Phelps was agreed to.

Mr. Mooers moved a call of the House,

Which was ordered, and

Messrs. Phelps and Darling reported absent.

The Sergeant-at-Arms having reported all the members in attendance,

On motion of Mr. MaGone,.

All further proceedings under the call of the House were dispensed with.

And the question having been put on re-considering the said, vote,

It was decided in the affirmative.

The question then recurred on the amendment of Mr. Phelps, which had been re-considered; when

Mr. MaGone demanded the previous question.

And the question having been put,

It was decided in the negative.

Mr. Burnett then raised a question of order, whether (the previous question having been decided in the negative,) the House could now further consider the subject.
