By Mr. Barstow. A petition of Lindsey Ward and others, of the town of Milwaukee, for a division of the county of Milwaukee;

Which was laid on the table.

By Mr. Phelps. A petition of citizens of the county of Green, relative to collecting taxes for the support of schools; Which was referred to the committee on Schools.

By Mr. Brawley. A remonstrance of inhabitants of Portage county against any part of said county being attached to Sauk county;

Which was referred to the committee on Corporations.

Mr. Brawley moved that the petitions on the same subject which was laid on the table at a former day of this session be referred to the same committee;

Which was agreed to.

By Mr. Barstow. A remonstrance of citizens of Milwaukee county, against the discontinuance of a certain highway in Walworth county ;

Which was referred to the committee on Roads.

By Mr. Brawley. A petition of inhabitants of Portage county, asking for the establishment of a territorial road; Which was referred to the committee on Roads.

On motion of Mr. Crawford,

No. 3, (H. of R.) "Resolution requiring the Superintendent of Territorial Property to discontinue all territorial suits now pending ;"

Was taken up and returned to the general file.

Mr. Thomas introduced the following resolution :

"Resolved, That the 39th standing rule of this House be so altered that nine o'clock A. M. shall be the stated time of the meeting of the House for the remainder of the present session."

The Chair decided that as the resolution contemplated an alteration of one of the standing rules of the House, it would necessarily lay over one day.

Notices were given for leave to introduce bills, as follows: By Mr. Brown. "A bill to authorize Abraham Brawley to build a dam and boom on the Wisconsin river at Stephens' Point."

By Mr. Hoard. "A bill to authorize Jemeson Hamilton to build and maintain a bridge across the Pecatonica river at New Bedford."

By Mr. Morrow. "A bill to attach a part of Portage county to the county of Sauk."

Mr. Burnett, from the select committee to which the subject had been referred, reported

No. 46, (H. of R.) "A bill to vacate a part of Second street in the town of Potosi, in the county of Grant, and for other purposes."

Also, agreeably to previous notice and by leave, introduced. No. 47, (H. of R.) "A bill to amend an act entitled 'an act to incorporate the village of Fair Play,' approved Feb. 24, 1845."

Mr. Mooers, from the committee on the Militia, to which the subject had been referred, reported

No. 48, (H. of R.) "A bill to provide for paying the Adjutant General of the Militia for his former services and disbursements ;"

Which were read the first and second times, and

On motion of Mr. Burnett,

The rule requiring bills, &c. to be printed before being acted upon in the committee of the whole was suspended with reference to these bills.

Mr. Hoard, from the select committee to which the subject had been referred, reported

No. 49, (H. of R.) "A bill to divide the county of Iowa and establish the counties of La Fayette and Montgomery ;" Which was read the first and second times.

Mr. Billings, from the committee on Elections, to whom the petition of citizens of Sheboygan county, praying a legislative interference in their last annual election, had been referred, reported adversely to the prayer of the petitioners, and asked to be discharged from the further consideration of the subject. The report was accepted and the committee discharged.

Mr. Cruson, from the committee on Engrossed Bills, reported

No. 30, (H. of R.) "A bill to repeal certain acts regulating taverns and groceries ;" and

No. 44, (H. of R.) "A bill to provide for the canvasing the votes cast at the general election held on the 4th Monday in September 1845, in the county of Marquette,"

As correctly engrossed.

Mr. Phelps, from the committee on Enrollment made the following report:

The joint committee on Enrollment report as correctly enrolled,

"An act to amend the election law concerning justices of the peace, and for other purposes;"

"An act to amend an act concerning divorce;" and

"A memorial to Congress on the subject of certain mail routes."

The said acts and memorial were signed by the Speaker. The message of the Council of yesterday was taken up, and

No. 36, (C.) “A bill to incorporate Beloit College,"

Was read the first and second times.

No. 10, (H. of R.) 'A bill giving further time to appeal from the decisions of judges of probate,"

Was taken up, and the amendments of the Council thereto concurred in.

Mr. Morrow, agreeably to previous notice and by leave, introduced

No. 50, (H. of R.) "A bill to divide the county of Portage and organize the county of York ;"

Which was read the first and second times,

No. 30, (H. of R.) "A bill to repeal certain acts regulating taverns and groceries,"

Was read the third time, when

Mr. Burnett moved a call of the House,

Which was ordered, and Mr. Earll reported as absent.

Mr. Fisher moved that all further proceedings under the call of the House be dispensed with;

Which was disagreed to.

The Sergeant-at-Arms having reported all the members in attendance,

On motion of Mr. Burnett,

Further proceedings under the call were dispensed with. And the question having been put on the passage of said -bill,

It was decided in the negative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Barstow, Billings, Clapp, Crawford, Croswell, Dennis, Earll, Graves, Hoard, MaGone, Mooers, Parker and Thomas,-13.

Those who voted in the negative were,

Messrs. Brawley, Brown, Burnett, Cruson, Fisher, Jackson, Jones, Morrow, Phelps, Pole, Sheldon, Wooster and Darling, (Speaker,)-13.

No. 44, (H. of R.) "A bill to provide for the canvassing the votes cast at the General election held the fourth Monday in September 1845, in the county of Marquette ;" and

No. 30, (C.) "A bill to amend an act entitled 'an act to authorize the construction of certain dams across the Rock river,' approved April 1st, 1843;"

Were read the third time, passed, and their titles agreed to. A message from the Governor, by Geo. P. Delaplaine, his Private Secretary:

'Mr. Speaker-I am directed by the Governor to inform you that he did, on the 23d inst., approve, sign and deposit in the office of the Secretary of the Territory,

"An act to change the form of government in the county. of Dodge, and for other purposes;"

"An act to amend an act entitled ' an act to incorporate the Wisconsin River Navigation Company;'"

"An act to organize the county of Sheboygan for judicial purposes;" and

"An act for the relief of John J. Driggs."

A message from the Council, by their Secretary:

Mr. Speaker-The Council has concurred in the amendments of this House to

No. 4, (C.) "Memorial to Congress on the subject of a collection district and a port of entry."

And have instructed me to request the House to return to the Council,

No. 11, (H. of R.) A bill to amend an act entitled 'an act to provide the means to pay the public debt of the Territory,' approved Feb. 24, 1845;'"

Which was rejected by them on yesterday.

No. 22, (C.) "A bill in relation to the formation of a state government in Wisconsin,"

Was taken up; when

Mr. Phelps withdrew his amendment to said bill.

Mr. Mooers moved to amend by adding the following scc

tion :

"Sec.

Should any of the duties required of any officer by this act not be performed as herein provided, it shall be the duty of the Governor to cause the same to be performed and executed by some other person;"

Which was agreed to.

Mr. Hoard moved to amend section 20, as follows:

"Strike out all after the words 'I have' to and including the word 'believe,' and insert the following, viz.: ‘Resided in this Territory six months and in this county ten days immediately preceding this election. I am twenty-one years of age as I verily believe. I am a citizen of the United States, (or have filed an application to become such according to the laws of Congress on the subject of naturalization,) and I have not voted at this election ;"

Which was agreed to.

Mr. Earll moved to re-consider the vote by which section 4 was amended by striking out all after the word "Secretary;" Which was agreed to.

The question then recurred on concurring in the said amendment, which was as follows:

"Strike out all after the word 'Secretary,' in the 15th line of the 4th section."
