And thereupon the President of the Convention declared. that David Merrill having received a majority of all the votes given was duly elected Receiver of the Milwaukee and Rock River Canal for the ensuing year.

On motion of Mr. Billings,

The Convention dissolved.

On notion of Mr. Billings,

The House adjourned until three o'clock P. M.

A message from the Council, by their Secretary: "Mr. Speaker--The Council have passed

No. 35, (H. of R.) A bill to authorize school district No. 5, in the town of Elkhorn, Walworth county, to renew a tax warrant;' and

No. 62, (C.) A bill to provide for the payment of Horatio N. Well's account against the Territory;"

In which the concurrence of this House is requested. [

The Council have concurred in the amendments of this House to

No. 32, (C.) ' A bill to incorporate Carroll College ;'

And insists upon its amendment to

No. 7, (H. of R.) 'Resolution for the appointment of a committee to examine the bank of Mineral Point.""

Mr. Brown moved a call of the House;

Which was ordered, and the absent members sent for;
And pending the report of the Sergeant-at-Arms,

On motion of Mr. Brown,

Further proceedings under the call were dispensed with. The special order of the afternoon, being

No. 45, (H. of R.) "A bill to amend the several election laws concerning justices of the peace,"

Was taken up;

And the question being on concurring in the amendments. of the committee of the whole to said bill,

Mr. Burnett called for a division of the question.

And the question having been put on concurring in the first. amendment of the committee of the whole to said bill, It was decided in the affirmative.

And the ayes and noes having been called for,
Those who voted in the affirmative were,

Messrs. Barstow, Billings, Brawley, Croswell, Cruson, Dennis, Earll, Fisher, Graves, Hoard, Jackson, Mooers, Parker, Phelps, Pole, Sheldon, Wooster and Darling, (Speaker,)—18. Those who voted in the negative were,

Messrs. Brown, Burnett, Clapp, Crawford, MaGone and Thomas,-6.

And the question having been put on concurring in the second amendment of said committee,

It was decided in the negative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Barstow, Dennis, Earll, Jackson, Parker, Pole, Sheldon, Wooster and Darling, (Speaker,)-9.

Those who voted in the negative were,

Messrs. Billings, Brawley, Brown, Burnett, Clapp, Crawford, Croswell, Cruson, Fisher, Graves, Hoard, Jones, MaGone, Mooers, Morrow, Phelps and Thomas,-17.

Mr. Brown moved further to amend the bill by striking out all of the 14th section to the word "thus ;"

Which was decided in the negative.

And the ayes and noes having been called for,
Those who voted in the affirmative were,

Messrs. Barstow, Brawley, Brown, Earll, Jackson, Jones, Parker, Phelps, Sheldon, Wooster and Darling, (Speaker,) -11.

Those who voted in the negative were,

Messrs. Billings, Burnett, Clapp, Crawford, Croswell, Cruson, Dennis, Fisher, Graves, Hoard, MaGone, Mooers, Morrow, Pole and Thomas-15.

The question then recurred on ordering said bill to be engrossed for its third reading.

And having been put,

It was decided in the affirmative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Billings, Burnett, Clapp, Crawford, Croswell, Cruson, Dennis, Fisher, Graves, Hoard, Jones, MaGone, Mooers, Morrow and Pole,-15.

Those who voted in the negative were,

Messrs. Barstow, Brawley, Brown, Earll, Jackson, Parker, Phelps, Sheldon, Thomas, Wooster and Darling, (Speaker,) -11.

Mr. Dennis moved that

No. 13, (C.) "A bill to incorporate the village of Madison,"

Be now taken up;

Which was agreed to.

On motion of Mr. Burnett,

The House resolved itself into committee of the whole for the consideration of the said bill;

Mr. Barstow in the chair.

And after some time spent therein, the committee rose, and reported the said bill back to the House, with amendments.

And the question being on concurring in the amendments of the committee of the whole to said bill,

Mr. Phelps called for a division of the question.

And the question having been put separately on concurring in the 1st, 2d, 3d, 4th and 6th amendments of said committee,

It was decided in the affirmative.

And the question having been put on concurring in the 5th amendment of said committee,

It was decided in the negative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Billings, Brown, Burnett, Cruson, Hoard, Jones,

Morrow, Pole and Wooster,-9.

Those who voted in the negative were,

Messrs. Barstow, Brawley, Clapp, Crawford, Croswell,

Mr. Fisher moved that the House adjourn;
Which was decided in the negative.

And a division having been called for,

There were ayes 11-noes 12.

Mr. Dennis moved to amend section 31st, by striking out all after the word "sold," in the 10th line thereof, and insert, "Which conveyance shall rest in the person or persons to whom given an estate in fee simple; and the said conveyance shall be prima facie evidence that the sale was regular according to the provisions of this act ;"

Which was agreed to.

Mr. Mooers moved to amend the 35th section by striking out the words " at the rate of twenty-five per cent. per annum for the benefit of such purchaser ;"

Which was agreed to.

Mr. Burnett moved that the further consideration of said bill be postponed until to-morrow;

Which was agreed to.

Mr. Phelps, from the joint committee on Enrollment made the following report:

The joint committee on Enrollment report that they did, on this day, to wit. the 29th day of January, A. D. 1846, present the following bills and memorials to the Governor for hist approval, to wit:

"An act fixing the salary of the Attorney General;

'An act relative to the county of Crawford and the counties thereunto attached for judicial purposes;"

"A memorial to the Congress of the United States relative to a mail route from the Falls of St. Croix to La Pointe, on Lake Superior ;" and

"A memorial to Congress for an appropriation to complete the improvement of the steamboat landing at Potosi, on the Mississippi river, in Wisconsin."

The Journal was read and corrected.

Petitions were presented and referred as follows, to wit: By Mr. Dennis. A petition of Edmund P. Butts and 44 others, inhabitants of towns 6 and 7, range 11, east, for the organization of a town by the name of Chatham;

Laid on the table.

Also, a petition of inhabitants of the counties of Jefferson and Dodge, asking for a division of said county;

Referred to the committee on Corporations.

By Mr. Burnett. A petition of citizens of school district. No. 1, in the school town of Wisconsin, in Grant county, asking for the passage of a law to raise an additional tax;

Referred to the committee on Schools.

By Mr. Cruson. A petition of citizens of the county of Grant, asking for a division of said county;

Referred to the select committee on that subject.
