In which the concurrence of this House is requested.

The Council concur in the 1st amendment of this House to No. 52, (C.) A bill to change the form of government of the county of Dane;'

And non-concur in the 2d and 3d amendments of the House thereto.

The Council have also concurred in the amendments of this House to

No. 68, (C.) A bill fixing the salaries of the Auditor and Treasurer of the Territory;'

And insist upon their amendments to

No. 5, (H. of R.) ' Resolution instructing the Attorney General to commence legal proceedings against the Wisconsin Marine and Fire Insurance Company.'

And have also concurred in the amendments of this House

No. 54, (C.) A bill to incorporate the Carrollton Manufacturing Company at Ormsbeeville, Wisconsin.'

And have passed

No. 32, (C.) A bill to incorporate the Lake Michigan and Mississippi Rail Road Company;'

No. 12, (C.) Joint resolution providing for the payment to William W. Brown out of the canal funds the sum therein named ;'

No. 16, (C.) Resolution concerning a light house on Grassy Island, near the mouth of Fox river;'

No. 90, (C.) A bill to provide for the payment of Edward V. Whiton's account against the Territory;'

No. 74, (C.) A bill to incorporate the Rochester Cemetery Company;'

'

No. 86, (C.) A bill relating to certain streets in the city of Milwaukee;"

No, 84, (C.) A bill to pay the county of Iowa the sum therein named;"

No. 92, (C.) A bill to exempt firemen from certain liabilities ;'

No. 91, (C.) 'A bill to vacate the town plat of the City of the Second Lake;' and

No. 79, (C.) A bill making appropriations out of the territorial treasury to pay certain debts therein named ;'

In which the concurrence of this House is requested.
The Council have also passed

No. 33, (H. of R.) A bill to incorporate the Lisbon and Milwaukee Plank Road Company.'

And have concurred in the amendments of this House to No. 31, (C.) A bill to authorize certain counties to levy a special tax.'

And have rejected

No. 27, (H. of R.) A bill to repeal certain acts therein named, and to revive the act of the Revised Statutes entitled an act relating to the militia.'"

The message of the Council was then taken up, and

No. 71, (C.) "A bill relating to bridges in the city of Milwaukee,"

Was read the first and second times.

No. 5, (H. of R.) "Resolution instructing the Attorney General to commence legal proceedings against the Wisconsin Marine and Fire Insurance Company;"

Was taken up; when

Mr. Dennis moved to amend the amendments of the Coun

cil by adding the following words :

"And that hereafter no compensation shall be allowed to any other attorney;"

Which was decided in the affirmative.

And the ayes and noes having been called for,

Those who voted in the affirmative were,

Messrs. Billings, Brawley, Brown, Burnett, Clapp, Cros

well, Cruson, Dennis, Earll, Fisher, Graves, Hoard, Jones, Mooers, Parker, Phelps, Pole, Thomas and Darling, (Speaker,)-19.

Those who voted in the negative were,

Messrs. Crawford, Jackson, MaGone, Morrow, Sheldon and Wooster,-6.

Mr. Burnett called for a division of the question on concurring in the amendments of the Council, as amended.

Mr. Morrow moved that the further consideration of said bill be postponed indefiinitely;

Which was decided in the negative.

And the ayes and noes having been called for,
Those who voted in the affirmative were,

Messrs. Barstow, Brown, Jones, Mooers, Morrow, Parker, Sheldon and Wooster,-8.

Those who voted in the negative were,

Messrs. Billings, Brawley, Burnett, Clapp, Crawford, Cruson, Dennis, Earll, Fisher, Graves, Hoard, Jackson, MaGone, Pole, Thomas and Darling, (Speaker,)—16.

And the question having been put on concurring in the amendments of the Council, as amended,

It was decided in the negative.

And a division having been called for,

There were ayes 7-noes 13.

No. 13, (C.) "A bill to incorporate the village of Madi

son,"

Was taken up; when

Mr. Burnett moved that the further consideration thereof be postponed until this afternoon ;

Which was agreed to.

On motion of Mr. Mooers,

The rule having been suspended for that purpose,

No. 61, (H. of R.) "A bill relative to a certain territorial road,"

Was then taken up, and the amendments reported by the committee on Roads were concurred in.

Said bill was then ordered to be engrossed for its third reading.

On motion of Mr. Dennis,

The House resolved itself into committee of the whole for the consideration of

No. 52, (C.) "A bill to change the form of government of the county of Dane;"

Mr. Fisher in the chair.

And after some time spent therein, rose and by their chairman reported the same back to the House with amendments. The amendments of the committee of the whole to said bill were then concurred in.

On motion of Mr. Dennis,

Said bill was ordered to its third reading now.

The said bill was then read the third time, passed, and the title thereof agreed to.

No. 50, (H. of R.) "A bill to divide the county of Portage and organize the county of York;"

Was taken up, and the amendments of the committee of the whole thereto were concurred in.

Mr. Brawley moved to amend said bill, by adding a new section, as follows:

"Sec. That the county of Columbia, so set off, shall pay to the county of Portage the proportion of the debts now owing by the county of Portage, in proportion to the number of inhabitants as shall be shown by the census to be taken in June next; which sum shall be collected and paid over to the county of Portage by the county of Columbia on or before the 15th day of April, 1847;"

Which was agreed to.

Mr. Phelps, from the joint committee on Enrollment made the following report:

The joint committee on Enrollment report that they did, on this day, to wit. the 31st day of January, A. D. 1846, present the following bills and resolution to the Governor for his approval, to wit:

"An act to authorize school district No. 5, in the town of Elkhorn, Walworth county, to renew a tax warrant ;"

"An act granting to James F. Chapman the right to keep and maintain a ferry across the Mississippi river at Potosi ;"

"An act in relation to the formation of a State Government

in Wisconsin ;"

"An act to authorize school district No. 1, in Platteville school district to build a school house,"

"An act to authorize school district No. 1, in the town of Rochester, to levy a tax ;"

Resolution for the appointment of a committee to examine the Bank of Mineral Point;"

"An act to incorporate the city of Milwaukee;"

"An act to amend an act entitled an act to incorporate the village of Fair Play,' approved Feb. 24, 1845;"

"An act to provide for paying the Adjutant General of the Militia for his former services and disbursements ;"

"An act to vacate a part of Second street, in the town of Potosi, in the county of Grant, and for other purposes ;" and Resolution providing for a final settlement of the claims of Daniel Baxter."

Mr. Morrow moved that the 18th rule be suspended in ref

erence to

No. 35, (C.) "A bill to incorporate the village of Sheboygan ;"

And that said bill be taken up and acted upon by the House; Which was agreed to.

And the question having been put on concurring in the amendments reported by the select committee to said bill, It was decided in the affirmative.

The said bill was then ordered to its third reading.
And on motion,

The said bill was read the third time, passed, and the title thereof agreed to.
