Mr. Earll moved that the Clerk of this House be directed to return to the Council, for their further action,

No. 3, (H. of R.) "A bill to change the time of holding courts in certain counties in the second judicial district;", Which was agreed to.

Mr. Phelps, from the joint committee on Enrollment made the following report:

The joint committee on Enrollment report that they did, on this day, to wit. the 31st day of January, A. D. 1846, present the following bills to the Governor for his approval, to wit:

"An act to incorporate Carroll College;"

"An act to divide the county of Iowa, and establish the counties of La Fayette and Montgomery ;"

"An act to provide for the improvement of Grant river, at Potosi, in Grant county;" and

"An act to provide for the division of the county of Milwaukee."

The joint committee on Enrollment report as correctly en

rolled :

"An act to incorporate the town of Potosi ;"

"An act to provide for the payment of Iloratio N. Well's account against the Territory,"

"An act to incorporate Beloit College;"

"An act to incorporate the Lisbon and Milwaukee Plank Road Company;"

"An act to amend an act entitled 'an act to provide for the government of the several towns in this Territory, for the revision of county government and for other purposes;'"

"An act to authorize certain counties to levy a special tax;" "An act to change the form of government in the county of Dane ;"

"An act to provide for the payment of J. Gillett Knapp's account against the Territory;"

"An act fixing the salaries of the Auditor and Treasurer of the Territory;"

"An act relating to certain streets in the city of Milwaukee;"

"An act to provide for the payment of the claim of Edward V. Whiton against the Territory;"

"An act authorizing proceedings in chancery against corporations ;"

"An act to organize certain towns in Jefferson county;" and

"A memorial to the Congress of the United States relating to a road from Prairie du Chein to La Pointe."

No. 7, (H. of R.) "Memorial to Congress for the appropri ation of Fort Howard to the Territory of Wisconsin for educational purposes;"

No. 9, (H. of R.) "Memorial to Congress for an appropriation for the erection of a light house at Grassy Island, near the mouth of Fox river;"

No. 65, (H. of R.) "A bill to amend an act entitled 'an act to provide for the selection of certain lands reserved by act of Congress for the use and support of a University in the Territory of Wisconsin ;"

No. 5', (H. of R.) "A bill to authorize Abraham Brawley to build a dam or boom across the Wisconsin river;"

No. 50, (H. of R.) "A bill to divide the county of Portage and organize the county of York;"

No. 68, (H. of R.) "A bill to authorize school district No. 1, in Grant county, to levy an additional tax for paying a debt incurred in building a school house;" and

No. 67, (H. of R.) "A bill to prescribe the qualification of voters in Brown county."

On motion of Mr. Billings,

No. 84, (C.) "A bill to pay the county of Iowa the sum therein mentioned,"

Was taken up; when

Mr. Burnett moved to amend by adding the following proviso, to wit:

"Provided, that before the sum appropriated by this act shall be paid by the Treasurer, or any warrant issued therefor by the Auditor, a written relinquishment by the said John F. ONeill of the said appropriation formerly made to him, or his assignment of the claim to the county of Iowa, shall be filed in the Auditor's office; and the Auditor shall also be satisfied. that the sum appropriated to the said O Neill has not been paid, before any warrant shall issue or payment be made, by virtue of this act;"

Which was agreed to.

And the ayes and noes having been called for,

Mr. Morrow voted in the negative.

On motion said bill was ordered to its third reading now, and was read the third time, passed, and the title thereof agreed

to.

Bill No. 7, (H. of R.) was read the third time, passed, and the title thereof agreed to.

Memorial No.7, (H. of R.) was read the third time, passed, and the title thereof agreed to.

No. 68, (H. of R.) was read the third time and passed: when

Mr. Burnett moved to amend the title thereof by inserting after the words "No. 1," the words "in the school town of Wisconsin;"

Which was agreed to.

The title of said bill, as amended, was then agreed to.

The following bills and memorials were then read the third time, passed, and the titles thereof agreed to:

Memorials Nos. 6 and 9, (H. of R.) and bills Nos. 65 and 51, (H. of R.)

No. 50, (H. of R.) "A bill to divide the county of Portage and organize the county of York,"

Was taken up; when

Mr. Morrow, by the unanimous consent of the House, amended section six by striking out all after the word "district," and inserting the words "at such times as he may determine, until otherwise ordered by law."

Mr. MaGone moved to re-commit said bill to the committee of the whole;

Which was disagreed to.

Said bill was then read the third time, passed, and the title thereof agreed to.

No. 62, (H. of R.) "A bill for the purposes therein named;"

Was taken up; when

Mr. Croswell moved that said bill be laid on the table;
Which was agreed to.

A message from the Council, by their Secretary:

"Mr. Speaker-I am directed to inform you that the House of Representatives have passed the following bills:

No. 81, (C.) A bill to incorporate the Milwaukee, Madison and Mississippi Rail Road Company;'

No. 82, (C.) A bill to incorporate the Sheboygan and Mississippi Rail Road Company;'

No. 83, (C.) A bill to incorporate the Milwaukee, Janesville and Mississippi Rail Road Company;' and

No. 93, (C.) A bill in relation to common schools in the city of Milwaukee.'

I am also instructed to request the House of Representatives to return to the Council,

I am directed to inform you that the Governor has notified the Council that he did, on the 31st ultimo, sign and deposit in the office of the Secretary of the Territory,

'An act granting to James F. Chapman the right to keep and maintain a ferry across the Mississippi river, at Fotosi ;'

in Wisconsin;'

'An act to authorize school district No. 1, in Platteville school district to build a school house,' 4

'An act to authorize school district No. 1, in the town of Rochester, to levy a tax ;'

'An act to incorporate Carroll College;' and

Resolution providing for a final settlement of the claims of Daniel Baxter.'

The Council have concurred in the amendments of this House to

No. 12, (C.) 'Joint resolution instructing the Superintendent of Territorial Property to perform certain duties;'
