Was then taken up and the amendments of the Council thereto were concurred in.

A message from the Council, by their Secretary: "Mr. Speaker-The Council have passed

No. 65, (H. of R.) 'A bill to amend an act entitled 'an act to provide for the selection of certain lands reserved by act of Congress for the use and support of a University in the Territory of Wisconsin ;'

No. 87, (C.) A bill to amend an act entitled 'an act to incorporate the city of Milwaukee ;*

In the latter of which the concurrence of this House is requested.

The Council have concurred in the amendments of the House to

No. 9, (H. of R.) "Joint resolution in relation to canal funds."

And the first amendment of the House to

No. 11, (C.) A bill to amend the act concerning proceedings in courts of rècord, and for other purposes,'

But non-concur in the second.

The Council have instructed me to return to this House, No. 43, (C.) A bill to change the time of holding the district court in the counties of Iowa and Crawford.""

No. 51, (H. of R.) 'A bill to authorize Abraham Brawley to build a dam and boom across the Wisconsin river;'

Was taken up, and the amendments of the Council concurred in.

No. 87, (C.) "A bill to amend an act entitled ' an act to incorporate the city of Milwaukee;"

Was read the first and second times.

No. 11, (C.) "A bill to amend the act concerning proceed

ings in courts of record, and for other purposes,"

Was taken up; when

Mr. Morrow inoved to lay the same on the table;
Which was agreed to.

Mr. Sheldon asked leave to withdraw the papers relating to the application of Thomas Foulston for a divorce;

Leave was granted.

No. 42, (H. of R.) "A bill to amend an act entitled an act to amend an act to establish the rate of toll for grinding,' Was taken up; and

Mr. Earll moved that the further consideration of said bill be postponed until the 1st day of July, 1850;"

Which was disagreed to.

And a division having been called for,

There were ayes 10-noes 12.

Mr. Brown moved to lay said bill on the table;

Which was agreed to.

And a division having been called for,

There were ayes 11-noes 10.

Mr. Cruson moved that

The House resolve itself into a committee of the whole

on the general file of bills;

Which was disagreed to.

Mr. Earll moved that

The House resolve itself into committee of the whole for the consideration of

No. 14, (C.) "Joint resolution relative to the offices of the Auditor and Treasurer of the Territory;"

Which was agreed to.

Mr. Parker in the chair.

And after some time spent therein, the committee rose and by their chairman reported the same back to the House with out amendment.

Said resolution was then ordered to its third reading now, And was read the third time, passed, and the title thereof agreed to.

Mr. Dennis moved to re-consider the vote by which the House refused to order No. 43, (C.) to a third reading; when Mr. Burnett moved a call of the House;

Which was ordered, and Messrs. Croswell, Mooers and Phelps reported absent.

The Sergeant-at-Arms having reported all the members in attendance,

On motion of Mr. Burnett,

All further proceedings under the call were dispensed with. And the question having been put on re-considering the said vote,

It was decided in the affirmative.

Mr. Hoard moved to re-consider the vote by which the amendment offered by him to said bill was adopted;

Which was agreed to.

And the question having been put on adopting said amend ment,

It was decided in the negative.

Mr. Burnett moved to amend the bill by striking out the word " fourth," in the 2d line of the 1st section, and insert the word "first."

Mr. Hoard moved to amend the amendment by striking out the word "first," and insert the word "third ;"

Which was agreed to.

And the ayes and noes having been called for,
Those who voted in the affirmative were,

Messrs. Barstow, Billings, Brawley, Brown, Clapp, Cros well, Dennis, Earll, Fisher, Graves, Hoard, Jackson, Mooers, Morrow, Phepls, Thomas and Darling, (Speaker,)—17. Those who voted in the negative were,

Messrs. Burnett, Crawford, Cruson, Jones, MaGone, Parker, Pole and Wooster,-8.

Mr. Fisher moved to amend the bill by striking out, section 2d

Which was agreed to.

A message from the Governor by Geo. P. Delaplaine, his Private Secretary:

"Mr. Speaker-I am directed by the Governor to inform you that he did, on the 2d inst., approve, sign and deposit in the office of the Secretary of the Territory,

'An act to amend an act entitled 'an act to provide for the government of the several towns in this Territory, for the revision of county government and for other purposes;' '

"An act to incorporate the Lisbon and Milwaukee Plank Road Company;'

An act to submit to the counties of Jefferson and Dodge the question of the division of said counties;"

'An act to organize certain towns therein named ;'

'An act to authorize school district No. 2, in Sheboygan county, to levy a tax for finishing a school house;'

'An act defining the time for taking appeals from the wote of school meetings, and for other purposes;'

An act to amend an act entitled' an act to incorporate the town of Platteville;'

'An act to authorize Jemison Hamilton to build a bridge across the Pecatonica river, at New Bedford ;'‚and

'Memorial to Congress on the subject of the reserved mineral lands."

No. 94, (C.) A bill to provide for the payment of the expenses of the Legislative Assembly for the year 1846.'

And recede from their amendment to

No. 7, (H. of R) Memorial to Congress for the appropri ation of Fort Howard to the Territory of Wisconsin for edu cational purposes.'

The Council have also passed

No. 61, (H. of R.) A bill in relation to the election district. composed of Milwaukee and Washington counties;' With amendment;

No. 16, (C.) Joint resolution relative to issuing certificates to the members of the Convention, and for other purposes;' and

In which the concurrence of this House is requested." Mr. Croswell, from the joint committee on Enrollment, reported as correctly enrolled the following, viz:

"An act to provide for the laying out of the territorial roads therein mentioned;"

"An act to divide the county of Portage and organize the county of Columbia ;"

"An act to incorporate the Rochester Cemetery Company;" "An act to authorize religious societies to lease or sell their real estate ;"

"An act to authorize school district No. 3, in the county of Grant, to levy a tax for the purpose of building a school house;"

"An act to incorporate the village of Madison;"

"Joint resolution instructing the Superintendent of Territorial Property to perform certain duties;"

"An act to provide for the payment of Moses M. Strong's account against the Territory;" and

"An act to provide for the payment to John Catlin, of interest on certain liquidated territorial bonds."

C. CROSWELL. The said acts and resolutions were severally signed by the Speaker.

The message of the Council was then taken up, and No. 16, (C.) "Joint resolution relative to issuing certificates to the members of the Convention, and for other purposes;" No. 94, (C.) "A bill to provide for the payment of the expenses of the Legislative Assembly for the year 1846," and No. 17, (C.) "Joint resolution to employ G. P. Delaplaine to draw a map ;"

Were read the first and second times.

No. 45, (H. of R.) "A bill to amend the several acts of this Territory concerning the supreme and district courts ;" Was taken up, when

Mr. Mooers moved that the further consideration of said bill

be postponed until the first day of July next;

Which was disagreed to.
