discovered them and called to them to bring it back, which they refused to do. The Captain, with several other men, came over to this shore, found the Indians who took his boat, and chastised one or two of them with a stick, and in the melee one of his men was severely hurt with a club in the hands of one of the Indians. The Indians then ran, and the citizens, a number of whom had by this time collected, followed them a little way and returned. In a short time the Indians came back also. All the citizens having by this time assembled, Capt. James B. Estes and Booth advanced towards them, unarmed, and in a peaceable manner, making friendly manifestations-all of which time the Indians threatened by drawing their knives, throwing off their blankets, waiving their guns in the air, and pointing them towards the whites. Finding it impossible to pacify or appease them, they separated, and in a moment they fired upon the citizens-the next minute their fire was returned and four of them fell.

The Indians have sent their runners in various directions to collect their scattered bands. We have also sent to several places for aid, and have already received a considerable reinforcement,

These, sir, are the facts as they occurred; and we now ask • your assistance, if any you have to offer, or if it be not in your power to send it, we are determined to defend ourselves. Nor will we rest until we kill or drive every Indian on the Wisconsin to their own ground west of the Mississippi.

We have organized in a proper manner by electing our officers, viz: James B. Estes, captain; Stephen P. Hollenbeck, 1st lieutenant; Robert McCloud, 2d, and Andrew R. McFarland, orderly sergeant, The meeting would respectfully ask your approval of the officers elected. The number of men here collected and under arms at this time are upwards of forty.

A message from the Council by their Secretary:

"Mr. Speaker-I am directed to inform you that Moses M. Strong, Esq. has been appointed on the part of the Council a member of the joint committee on the following resolution: No. 7, (H. of R.) Resolution for the appointment of a committee to examine the Bank of Mineral Point.""

The Speaker announced the appointment of Armstead C. Brown of the committee under the above named resolution.

Mr. Sheldon, from the joint committee appointed under a joint resolution of the two Houses "to examine, count and cancel all evidences of indebtedness in the territorial treasury and Auditor's office, which the Secretary of the Territory is not instructed to pay;" made the following report. [See Appendix.]

On motion of Mr. MaGone,

Ordered, that the said report be transmitted to the Council for their consideration.

Mr. Burnett from the committee on the Militia to which had been referred the message of the Governor on that subject, by the unanimous leave of the House reported,

No. 70, (H. of R.) "A bill to repeal certain acts therein named and to revive the act of the Revised Statutes entitled ' an act relating to the militia ;'

And the rule having been suspended for that purpose the said resolution and bill were severally read the third time, passed, and the titles thereof agreed to.

A message from the Council, by their Secretary:

'An act to provide for laying out certain territorial roads ;' 'An act in relation to common schools in the city of Milwaukee;'

"Mr. Speaker-The Governor has informed the Council that he has this day approved, signed and deposited in the office of the Secretary of the Territory:

Mr. Mooers introduced the following resolution;

Resolved, That a committee of two be appointed to be joined by a similar committee to be appointed on the part of the Council to wait upon his Excellency the Governor and inform him that the two Houses have disposed of the business before them, and are now ready to adjourn, and to enquire if he has any further communication to make to them.

The chair appointed Messrs. Hoard and Mooers of the committee on the part of the House under the above resolution. A message from the Council by their Secretary:

"Mr. Speaker-I am directed to inform you that Messrs. Catlin and Frank have been appointed a committee on the part of the Council to wait upon his Excellency the Governor and inform him that the two Houses have completed the business before them, and are now ready to adjourn, and ask him if he has any further communication to make to them.

Mr. Burnett offered the following resolution:
