The unfinished business of the morning, it being the report. of the committee of the whole, was taken up, and the amendments reported by said committee to

No. 2, (C.) were concurred in, and bills Nos. 1 and 2 were ordered to a third reading.

And the question being on concurring in the amendments of the committee of the whole to bill No. 3, (C.)

Mr. Burnett called for a division of the question;

And the question having been put on the first amendment of the committee, which was to strike out the fifth section of the bill;

It was decided in the affirmative.

And the question having been put on agreeing to the second amendment of the committee, which was to strike out the 6th section of the bill;

It was decided in the negative.

A message from the Council by their Secretary:

"Mr. Speaker-The Council have passed bills of this House as follows:

No. 1, (H. of R.) Memorial to Congress relative to canal lands;'

'A memorial to Congress relative to the canal reserve;'

Resolution relative to a Light House at

No. 8, (H. of R.) A bill for the establishment of a territorial road from Burlington, in Racine county, to Delavan, in Walworth county;' "

Mr. Mooers moved to amend said bill No. 3, (C.) by inserting after the word "certificate," in the fifth line of section

first, the words " SO far as the persons named in the request appear upon record in connection with any such tract of land;" Which was disagreed to.

Mr. Mooers then moved to amend the second section by inserting after the word "certificate," in the fourth line, the words, so far as the records and papers on file in his office will enable him to do;"

Which was agreed to.

Mr. Mooers then moved further to amend the second section of the bill by inserting after the word "satisfied," in the ninth lire, the words, "so far as appears of record and from the papers on file in his office;"

Which was agreed to.

Mr. Mooers moved further to amend the bill by inserting after the word "stating," in the seventh line of the third section, the words, so far as appears from the records and papers on file in his office ;"

Which was agreed to.

Mr. MaGone moved further to amend the bill by inserting after the word "dollar," in the third line of the eighth section, the words, "for the first deed, mortgage or notice of lien, and for every additional deed, mortgage or notice of lien mentioned in said certificate in its chain of title, seventy-five cents,"

Mr. Burnett moved to amend the amendment by striking out the words "seventy-five," and insert the words "twentyfive," in lieu thereof.

Which was agreed to.

The question then recurred on the amendment of Mr. MaGone as amended,

And having been put,

It was decided in the affirmative.

Mr. Jackson then moved further to amend the bill, by striking out the words "one dollar, in the third line of the eighth section, and inserting the words "fifty cents," in lieu thereof; Which was disagreed to.

Mr. Burnett moved further to amend the bill by inserting in the fifth line of the eighth section, immediately after the word "person," the words, "or tract of land." Also by inserting in the same line immediately after the word "person,' where it secondly occurs, the words, "or tract of land." And

also, by adding at the end of the sixth line, in the same section, the words, "and embrace in such certificate;"

Mr. Brown moved further to amend the bill by adding thereto two sections as follows:

"Sec. 10. No officer shall be compelled to perform any duties as required by this act until his fees have been paid in advance.

Sec. 11. That this act shall take effect on the first day of July next."

And pending the question on said amendments,

On motion of Mr. Crawford,

The said bill was re-committed to a select committee consisting of Messrs. Crawford, Burnett and Hoard.

Mr. Burnett, by leave, introduced the following resolution; Which was adopted, to wit:

Resolved, That the Honorable Council be requested to transmit to this House a copy of the order of the Council directing the report of the Auditor of the Territory to be printed, and the date of the order and the time when it was sent to the printer; a copy of the resolution of the Council calling upon the Territorial Printer for a report of the reasons why the report of the Auditor had not been printed, and a copy of the report of the Territorial Printer in response to such resolution. On motion of Mr. Mooers,

No. 1, (H. of R.) "A bill to change the form of government in the county of Washington, and for other purposes ;" Was taken up, and read the third time, passed, and the title thereof agreed to.

The message from the Council was taken up, and

No. 10, (C.) 'A bill for the relief of Benton and Garfield,' Was read the first and second times.

On motion of Mr. MaGone,

The House resolved itself into committee of the whole on No. 12, (H. of R.) "A bill to incorporate the city of Milwaukee;"

Mr. Cruson in the chair;

And after some time spent therein the committee rose and

by their chairman reported said bill back to the House with amendments.

On motion of Mr. MaGone,

The said bill was laid on the table.

Mr. Barstow moved to re-consider the vote by which the House refused to pass,

No. 5, (C.) A bill respecting judgments in criminal cases ;'

Which was agreed to.

Petitions were presented and referred as follows, to wit: By Mr. MaGone. A memorial of John Anderson, in relation to balance due him from the Territory on a contract for the building of a dam on the Milwaukee and Rock River Canal;

Which was referred to the committee on Territorial Expenditures.

By Mr. Parker. The petition of Thomas Steele and 32 others, praying for an act to amend an act to authorize the commissioners of highways for the towns of Genesee and Maquango to lay out and alter a territorial road therein named ;

Which was referred to the committee on Roads.

By Mr. Morrow. The memorial and petition of John J. Driggs, praying for a divorce from his wife, Susan Driggs;

Which was referred to the committee on the Judiciary. By Mr. Cruson. The petition of the inhabitants of Grant county, praying for a division of the said county;

Which was, on his motion, referred to a select committee consisting of the members from Iowa and Grant counties.

Also, the petition of the inhabitants of Grant county, praying for an act submitting the question of "License," or "No License," for the sale of intoxicating liquors, to the several towns and precincts in the Territory;

Which was referred to the committee on the Judiciary.

By Mr. Hoard. A remonstrance of Charles G. Rodolph and 31 others, inhabitants of Iowa county, against the division of said county;

Which was referred to a select committee consisting of the members from Iowa county.

By Mr. Dennis. The petition of Horace D. Patch and others, inhabitants of towns 10 and 11, in range 13, in Dodge county, praying to have said towns organized;

Which was referred to the committee of the whole House.

Mr. Hoard gave notice that on to-morrow, or some future day, he would ask leave to introduce a bill to locate and establish a territorial road from the Blue Mounds, in Dane county, to Wingville, in Grant county.

Mr. Morrow, from the committee on Territorial Affairs, to whom had been referred resolution No. 3, (H. of R.) reported that in the opinion of the committee the resolution ought not to be adopted, and asked to be discharged from the further consideration of the subject.

Mr. Mooers moved that the resolution be re-committed to the same committee with instructions to give the subject a more thorough investigation, and report the same at length to the House;

Which was agreed to, and the resolution re-committed accordingly.
