Mr. Mooers moved further to amend the motion by adding the following thereto;

"If in the opinion of the committee the Legislative Assembly have a right to repeal the same;"

Which was disagreed to.

Mr. Hoard moved further to an end the motion by adding thereto the following:

"That the said committee be instructed to introduce a bill directing the Attorney General to institute legal proceedings against the Wisconsin Marine and Fire Insurance Company;"

Which was decided in the negative.

The journal was read and corrected.

Petitions were presented and referred as follows, viz:

By Mr. Fisher. The petition of Champion Pelton and others, inhabitants of Crawford county, praying for a law submitting the question of license or no license to sell intoxicating liquors, to the electors of the different towns and precincts in the Territory;

Which was referred to the committee on the Judiciary. By Mr. MaGone. The petition of Elisha B. Strong and others, praying for an act incorporating a Marine and Fire Insurance Company;

Which was referred to the committee on Corporations.

By Mr. Jones. Five remonstrances from the towns of Beloit and Clinton, in Rock county, against a division of said

towns;

Which were referred to the committee on Corporations.

By Mr. Dennis. The petition of S. H. Haines and other inhabitants of township No. 9, range No. 13, Dodge county, praying to be organized into a town by the name of Portland; Which was, on motion of Mr. Dennis, laid on the table. By Mr. Phelps. The petition of Arnold Browning and other inhabitants of Dane and Green counties, praying for the

establishment of a territorial road from Exeter in Green coun

ty to Fort Winnebago;

Which was referred to the committee on Roads.

Mr. Brawley gave notice that he would, on to-morrow, or some subsequent day, ask leave to introduce a bill to divorce William Lawrence from his wife Clarissa Lawrence.

* Mr. Cruson from the committee on Engrossed Bills reported as correctly engrossed the following, to wit:

No. 6, (H. of H.) "A bill to amend an act entitled 'an act concerning replevin;'"

No. 9, (H. of R.) "A bill to change the form of govern ment in the county of Dodge, and for other purposes."

The message from the Council was taken up, and the following entitled bills were read the first and second times, to wit: No. 4, (C.) A bill to define the time when liens on real estate shall take effect;"

No. 6, (C.) "A bill relating to the purchase and redemption of real estate sold on execution;"

No. 12, (C.) "A bill to provide for the payment of certain claims against the Territory;"

No. 17, (C.) "A bill to provide means for the payment of the interest on certain liquidated territorial bonds therein named;"

No. 18, (C.) "A bill to provide for the payment of M. M. Jackson's account for services as Attorney General."

No. 9, (H. of R.) "A bill to change the form of govern ment in the county of Dodge, and for other purposes,"

Was taken up and read the third time, when

Mr. Dennis asked and obtained the unanimous consent of the House to make the following amendments, viz:

That in the 5th section of said bill, the name of the town mentioned therein be changed from Montgomery to Portland. Also in the 15th section the name of the town mentioned therein, be changed from Burnett to Fairfield. Also in the 17th section the name of the town therein mentioned, be changed to Burnett.

Mr. MaGone asked and obtained the unanimous consent of the House to change the name of the town mentioned in the 12th section, from MaGone to Hustis' Ford.

The bill was then passed and the title thereof agreed to. The following entitled bills were read the third time, passed, and the titles thereof agreed to, viz:

No. 6, (H. of R.) "A bill to amend an act entitled 'an act concerning replevin,'" and

No. 10, (C.) "A bill for the relief of Benton & Garfield." Mr. Phelps, from the committee on Enrollment, reported

No. 8, (H. of R.) "A bill for the establishment of a terri torial road from Burlington, in Racine county, to Delavan, in Walworth county,"

As correctly enrolled.

The said bill was signed by the Speaker.

Mr. MaGone moved to take up

No. 12, (H. of R.) "A bill to incorporate the city of Milwaukee;"

Which was agreed to, when

Mr. Parker moved that the said bill be referred to a select committee consisting of the members from Milwaukee county; Which was decided in the affirmative.

And a division having been called for,

There were ayes 13-noes 4.

A message from the Governor by Geo. P. Delaplaine, Esq. his Private Secretary:

"Mr. Speaker The Governor did, on the 14th inst. approve, sign and deposite in the office of the Secretary of the Territory,

'Resolution relative to a light house at Sauk Harbor ;'

Memorial to Congress relative to the canal lands;' and

'Memorial to Congress relative to the even sections on the canal reserve;'

No. 20, (H. of R.) "A bill to repeal the fourth section of an act entitled an act to amend an act entitled an act for assessing and collecting county revenue," approved February 19th, 1841;"

No. 12, (C.) "A bill to provide for the payment of certain claims against the Territory;"

No. 18, (C.) "A bill to provide for the payment of M. M. Jackson's account for services as Attorney General;"

Without amendment, and

No. 4, (C.)

The amendments to Nos. 4, 6 and 17, (C.) were concurred in, and Nos. 6, 12 and 18 (C.) were ordered to a third reading, and Nos. 10, 15, 16 and 20 (H. of R.) were ordered to be engrossed for a third reading.

On motion of Mr. Dennis,
No. 17, (C.) was laid on the table.

Mr. MaGone moved that the resolution instructing the committee on the militia be laid on the table;
