Mr. Billings moved that

No. 23, (H. of R.) “A bill to repeal an act entitled ' an act to incorporate the Wisconsin Marine and Fire Insurance Company;"

Be now taken up; Which was agreed to. The question was then put on the passage of said bill, And was decided in the aflirmative. And the ayes and noes having been called for, Those who voted in the affirmative were, Messrs. Barstow, Billings, Brawley, Clapp, Crawford, Croswell, Dennis, Earll, Fisher, Graves, Hoard, Jackson, MaGone, Morrow, Phelps, Sheldon, Wooster and Darling, (Speaker,)-18.

Those who voted in the negative were,
Messrs. Brown, Burnett, Cruson, Jones, Movers, Parker,
Pole and Thomas--8.

The title of the bill was then agreed to.
A message from the Council by their Secretary :
“ Mr. Speaker--- The Council have passed

No. 22, (C.) “A bill in relation to the formation of a state government in Wisconsin ;' and

No. 19, (C.) ' A bill to incorporate the Rock River Mutual Insurance Company;'

In which the concurrence of this House is requested."

Mr. Billings moved that the 18th rule of this House be suspended with reference to

No. 5, (H. of R.) “A resolution instructing the Attorney General to commence legal proceedings against the Wisconsin Marine and Fire Insurance Company;"

And that the said resolution be now taken up and acted upon by the House ; , · Which was agreed to. Mr. Croswell moved to amend said resolution, as follows:

“ Insert after the word .commence,' in the fourth line, the words 'the most efficient;' and insert after the word deposit,' in the ninth line, the words or any other description of paper that may circulate as a currency.""

Mr. Parker moved to lay said resolution, with the amendment, on the table ;

Which was disagreed to.

The question was then put on the amendment offered by Mr. Croswell,

And was decided in the affirmative. Mr. Burnett moved to amend the resolution by striking out all after the enacting clause and inserting the following:

"That the Attorney General of the Territory be and he is hereby instructed to institute the necessary legal proceedings against the Wisconsin Marine and Fire Insurance Company, to enquire whether the said corporation has violated its charter; and in case of such violation being established, to procure a forfeiture of its franchises: And the district courts shall upon proper application, award a writ of injunction, or any other necessary and proper process, against the said corporation, to restrain it from exercising any corporate right, or any power under pretence of corporate right, pending any such legal proceedings ;"

Which amendment was accepted by Mr. Croswell as a modification of the original resolution.

Mr. Dennis moyed that the House adjourn to half-past two o'clock, P. M.; Which was disagreed to.

And after some further time spent in the consideration of said resolution,

Mr. Dennis again moved that the House adjourn to halfpast two o'clock;

Which was decided in the affirmative.
And the ayes and noes having been called for,

Those who voted in the affirmative were, Messrs. Billings, Brawley, Brown, Clapp, Croswell, Cruson, Dennis, Fisher, Graves, Hoard, Jackson, Morrow, Parker, Pole, Sheldon and Darling, (Speaker,)—16.

Those who voted in the negative were,

Messrs. Barstow, Burnett, Crawford, Earll, Mooers, Ma. Gone, Phelps, Thomas and Wooster—9.

So the House adjourned until half-past two o'clock P. M.

Mr. MaGone moved a call of the House ;
Which was ordered,

And Messrs. Barstow and Parker were reported as absent, and the Sergeant-at-Arms sent to notify them that their attendance was required in the House.

The Sergeant-at-Arms having reported all the members in attendance,

On motion of Mr. MaGone, Further proceedings under the call of the House were dispensed with.

The unfinished business of the morning, being

No. 5, (H. of R.) “A resolution instructing the Attorney General to commence legal proceedings against the Wiscon-sin Marine and Fire Insurance Company;":

Was then taken up; when Mr. Brawley moved to lay said resolution upon the table; Which was decided in the negative. And the ayes and noes having been called for, Those who voted in the affirmative were, Messrs. Barstow, Billings, Brawley, Jackson, Jones, Mor. row, Parker, Pole, Sheldon, Wooster and Darling, (Speaker,)

11. Those who voted in the negative were, Messrs. Brown, Burnett, Clapp, Crawford, Croswell, Cruson, Dennis, Earll, Fisher, Graves, Hoard, MaGone, Mooers, Phelps and Thomas-15.

Mr. Sheldon moved to amend said' resolution, by inserting the following proviso:

"Provided said institution shall after the passage of the act to repeal its charter, continue to issue or put in circulation its certificates of deposit or other evidences of debt.”

Mr. MaGone demanded the previous question ; And the question having been put, “Shall the main question be now put ?" It was decided in the negative. Mr. Magone moved to amend the amendment, by adding the following further proviso:

“Provided further, that if the bill repealing said company's charter should not become a law, then the Attorney General to be instructed as hereinbefore provided ;"

Which was agreed to.
And a division having been called for,
There were ayes 14-noes 11.

The question was then put on adopting the amendment as amended,

And was decided in the affirmative. And the ayes and noes having been called for, Those who voted in the affirmative were, Messrs. Barstow, Billings, Brawley, Clapp, Crawford, Croswell, Dennis, Earll, Fisher, Graves, Hoard, Jackson, MaGone, Morrow, Sheldon, Thomas, Wooster and Darling, (Speaker,)-18.

Those who voted in the negative were, Messrs. Brown, Burnett, Cruson, Jones, Mooers, Parker, Phelps and Pole-8.

The question was then put on ordering the said resolution to be engrossed for a third reading,

And was decided in the affirmative. And the ayes and noes having been called for, Those who voted in the affirmative were, Messrs. Barstow, Billings, Burnett, Crawford, Croswell, Cruson, Dennis, Earll, Graves, Hoard, MaGone, Mooers, Parker, Phelps, Thomas and Darling, (Speaker,)-16.

Those who voted in the negative were, Messrs. Brawley, Brown, Clapp, Fisher, Jackson, Jones, Morrow, Pole, Sheldon and Wooster-10.

Mr. Burnett moved that the House take up

No. 1, (C.) “ Resolution relative to the termination of the present session of the Legislative Assembly;" Which was agreed to.

And the question being on the amendment offered on a former day of the session, which was to strike out the words “ Monday the second," and insert “Tuesday the third;"'

Mr. Brown called for a division of the question..

And the question having been put on striking out the words “ Monday the second,"

It was decided in the affirmative. And the ayes and noes having been called for, Those who voted in the assirmative wero, Messrs. Billings, Brown, Burnett, Clapp, Crawford, Earll, Fisher, Graves, Hoard, Jones, MaGone, Mooers, Morrow, Parker, Pole, Thomas, Wooster and Darling, (Speaker,)-18.

Those who voted in the negative were, Messrs. Barstow, Brawley, Croswell, Cruson, Dennis, Jackson, Phelps and Sheldon-8.

And the question having been put on the second part of said amendment, which was to insert “ Tuesday the third ;"

It was decided in the affirmative. And the ayes and noes having been called for, Those who voted in the affirmative were, Messrs. Barstow, Billings, Brawley, Brown, Burnett, Clapp, Crawford, Cruson, Dennis, Earll, Fisher, Hoard, Jackson, Jones, Mooers, Parker, Pole and Darling, (Speaker,) --18.

Those who voted in the negative were,

Messrs. Croswell, Graves, MaGone, Morrow, Phelps, Sheldon, Thomas and Wooster-8.

Mr. MaGone moved to amend the said resolution by insertiag the following proviso:

“Provided the Legislature shall have completed their business ;'

Which was decided in the negative.
