By unanimous consent Mr. Stover introduced the following

resolution:

Resolved: That the auditor is hereby requested to furnish the Council with the amount of outstanding territorial warrants excluding militia warrants issued prior to 1875-and the purposes for which they were drawn and the amount bearing in

terest.

Which upon motion of Mr. Stover was adopted.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole, with the President in the chair, to resume the consideration of Council Bill No. 81.

The committee of the whole arose temporarily to receive a messenger from the House who announced that that body had passed with amendments Council Bill No. 55, entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico, also House Bill No. 55, entitled An Act to amend An Act entitled An Act to prohibit the unlawful carrying of deadly weapons. The committee of the whole resumed.

On the committee of the whole arising the President as chairman of said committee reported that they had had under consideration Council Bill No. 81 and had come to no resolution thereon.

The President then announced that he had signed Council Bill No 77, also Council Bill No. 62, entitled An Act to provide for the printing of bills, documents, etc., in the Spanish language.

Council then adjourned until 2 p. m., upon motion of Mr. Perea.

By unanimous consent Mr. Chaves introduced the following bills:

Council Bill No. 100 entitled An Act in relation to assessments and taxing of property, amending section 2808, of the Compiled Laws of 1884; the bill was read a first time by title and under suspension of the rules read a second time and referred to the committee on finance; also

Council Bill No. 101-entitled An Act relating to gamblers, gambling and gambling devices; the bill was read a first time and under suspension of rules, read a second time in full.

Mr. Jaramillo moved that the rules be suspended and the bill be read a third time, which motion was lost.

Upon motion of Mr. Ancheta the bill was then referred to the committee on the judiciary.

Upon motion of Mr. Perea the Council then resolved itself

into a committee of the whole to resume the consideration of Council Bill No. 81, entitled An Act providing funds and making appropriations for the 42d and 43d fiscal year.

The committee of the whole arose temporarily to receive a messenger from the House, who announced that that body had failed to concur in the passage of Council Bill No. 34, entitled An Act to prevent the disposal and sale of liquors and tobacco by the use of "nickel in-the-slot-machines" and other similar devices.

The chair announced that he had signed the House substitute for House Bills No. 29 and No. 30, entitled An Act to repeal An Act entitled An Act to compel persons, companies or corporations, cultivating or irrigating lands, by means of water, raised or pumped from wells and in other ways to enclose the same with a fence, and for other purposes, becoming a law by limitation February 28, 1889.

The committee of the whole again arose temporarily to receive a messenger from the House, who announced that that body had passed House Bill No. 103, entitled An Act to amend Sec. 1, Chapter 63 of the Session Laws of 1889.

The committee of the whole again arose temporarily to receive a messenger of the House who announced that that body had failed to concur in the passage of Council Bill No. 3, entitled An Act to regulate the practice of dentistry and to punish violators thereof for the Territory of New Mexico.

The committee of the whole again arose temporarily to receive a messenger from the House who announced that that body had passed House Joint Resolution No. 4, providing for a joint session of both branches of the Legislature to be held February 7, 1891.

The committee of the whole now arose and the President as chairman of said committee reported that they had had under consideration Council Bill No. 81, and had come to no resolution thereon.

On motion of Mr. Jaramillo the Council then adjourned until 10 a. m. January 31, 1891.

Council met pursuant to adjournment.

Session opened by prayer by Rev. John Menaul. Roll call dispensed with, all members being present. The Journal of yesterday's proceedings was read and ap proved.

As a matter of privilege the committee on enrolled and engrossed bills through its chairman, Mr. Ancheta, reported Conncil Bill No. 5 as correctly enrolled, and upon motion of Mr. Richardson the report was adopted.

The President announced that he had signed Council Bill No. 5, entitled An Act regulating the sale of intoxicating liquors and licensing the same.

The chair presented an official communication from the Auditor which was read in full.

Mr. Catron arose to a question of privilege and introduced Council Joint Resolution No. 4, in relation to the payment of the additional employes of the 29th Legislative Assembly; the resolution was read a first time in full, and under suspension of the rules was read a second and third time, and put upon passage.

Mr. Richardson moved that Council Joint Resolution No. 4

pass and the ayes and nays were ordered, with the result that the resolution was passed unanimously.

By unanimous consent Council Bill No. 55, entitled An Act to provide funds for the issuance of county current expense bonds in the Territory of New Mexico with amendment of the House was taken up and read in full.

Upon motion of Mr. Richardson the bill was considered as engrossed and read a third time.

Mr. Richardson moved that Council Bill No. 55 now pass, and the ayes and nays were ordered with the following result: Ayes, Messrs. Ancheta, Catron, Contreras, Mills, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President—10. Nays, none.

Messrs. Jaramillo and Perea did not vote.
Therefore Council Bill No. 55 was duly passed.

A messenger from the Governor appeared and presented a message which was received.

By unanimous consent the following bills were introduced:

Mr. Richardson introduced Council Bill No. 102 - entitled An Act to regulate the right to practice law in this Territory, the bill was read a first time, and under suspension of the rules read a second time, ordered translated and printed, and referred to the committee on the judiciary; also,

Council Bill No. 103--entitled An Act regulating the drawing of jurors, the bill was read a first time, and under suspension of the rules read a second time, ordered translated and printed, and referred to the committee on the judiciary.

Mr. Mills introduced Council Bill No. 104-entitled An Act to repeal Section 1365, of the Compiled Laws of 1884, relating to wills; the bill was read a first time by title, and under suspension of the rules read a second time and referred to the committee on the judiciary.

Mr. Ancheta introduced Council Bill No. 105-entitled An Act to amend Section 742, of the Compiled Laws of New Mexico; read a first time by title, and under suspension of the rules read a second time in full, ordered translated and printed, and referred to the committee on the judiciary; also,

Council Bill No. 106-entitled An Act relating to the termination of leases on mines; the bill was read a first time by title, and under suspension of the rules, read a second time in full, ordered translated and printed and referred to the committee on judiciary; also.

Council Bill No. 107-entitled An Act for the protection of laborers, mines, leases and employes; the bill was read a first time by title, and under suspension of the rules read a second time in full, ordered translated and printed and referred to the committee on judiciary.

Mr. Catron introduced Council Joint Resolution No. 5, in relation to sending to Washington a commission of six persons and appropriating $900.00 for that purpose; the resolution was read a first time in full and under suspension of the rules, read a second and third time dy title, and put upon its passage.

Mr. Catron now moved that Council Joint Resolution No. 5 pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-11.

Therefore Council Joint Resolution No. 5 was duly passed. Under suspension of the rules, Mr. Catron as chairman of the committee on judiciary made a report on Council Bill No. 71, entitled An Act providing for the appointment of a district attorney in and for the counties of Lincoln, Chavez and Eddy in the Territory of New Mexico and for other purposes; recommending the passage of the bill.

Upon motion of Mr. Catron the rules were suspended and Council Bill No. 71 was read a third time by title

Mr. Catron now moved that Council Bill No. 71 pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore Council Bill No. 71 was passed unanimously.

A messenger from the House appeared and announced that that body had passed Council Joint Resolution No. 4 and House Joint Resolution No. 15.

The chair presented a message from the Governor which stated that he had approved Council Bills Nos. 77, 50, 56 and

62.

The chair also presented a petition from Pascual Baca and citizens of San Miguel county, praying exemption from taxation of vacant common land of community land grants, which was
