auditor's warrants for the sum of two thousand four hundred and fifty-five dollars and eighty-nine cents, bearing interest at the rate of twelve per centum per annum, from their date, upon the surrender by said Collier of bond numbered thirty. one, issued in pursuance of an act appropriating said sum to Collier and Pettus, approved February 19, 1841; and also that he issue to said Collier warrants for the sum of twelve hundred and seventy-eight dollars and seventy-nine cents, in full for the interest which has accrued upon said bond: Provided, no warrant issued under the provisions of this act shall be for a less sum than one hundred dollars.

AN ACT

To authorize Samuel B. Ormsby to build a dam on Sheboygan river.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That Samuel B. Ormsby, his successors and assigns, be and are hereby authorized to build and maintain a dam across the Sheboygan river, upon section twenty-eight, of town fifteen, range twenty-three, in the county of Sheboygan, for the purpose of propelling any machinery by water: Provided, that the said Samuel B. Ormsby, his successors

and assigns, shall be the lawful owners of land upon which said dam and its appurtenances are situated.

SEC. 2. The said dam and the owners thereof shall be subject to all the provisions of the act of the legislative assembly entitled "An act in relation to mills and mill dams," approved January 13, 1840.

SEC. 3. Any future legislature of this territory, or of the future state of Wisconsin, may alter, amend, or repeal this

Supplementary to "An act to incorporate the Sheboygan and Fond du Lac Rail Road Company.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. Whenever two thousand shares of the stock of the Sheboygan and Fond du Lac Rail Road Company shall have been subscribed, and the fact thereof certified, as required by the second section of the act to which this is supplementary, the governor shall, by letters patent, create and erect the subscribers thereto, as well as such as shall subsequently subscribe thereto, into a body corporate and politic, with all the powers conferred by said act.

SEC. 2. Said company shall have power to transport, take, and carry property and persons, by the power and force of steam, or animals, or any mechanical or other power, or of any combination of them; and they shall have power to make, construct, and erect all such side-tracks, turn-outs, and connecting tracks, and all such ware-houses, toll-houses, machine shops, carriages, cars, and other works and appendages as may be necessary for the convenience of said company in the use of the said rail road.

Resolved by the Council and House of Representatives of the Territory of Wisconsin:

That any payment that shall be made by the secretary of the territory of Wisconsin, of any (of any) appropriation in the legislative appropriation act passed at the present session of the legislative assembly of the said territory, which shall be disallowed by the treasury department of the United States, shall be paid to the said secretary out of the territorial treasury; and it shall be the duty of the auditor of the territory to issue warrants for the same to the said secretary, on

AN ACT

To provide for laying out certain territorial roads therein named.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin :

SECTION 1. That Frederick Sweet, Daniel S. Eldred, and Lemuel Bartholomew, be and they are hereby appointed commissioners to lay out a territorial road from Lake Mills to a point near where. the line between ranges thirteen and fourteen crosses the Dodge county line, thence to Lowell in Dodge county, and to alter so much of the Aztalan and Waupun road as the said commissioners may deem proper.

SEC. 2. That Robert R. Cowan, William A. Lawrence, to Madison and Alvin West, be and they are hereby apdointed commis sioners to lay out a territorial road, commencing at the Indian ford on Rock river, in the town of Fulton, and terminating at Madison, in Dane oounty.

In Jefferson county.

SEC. 3. That Emery Sampson, James Ostrander, and Archibald Burtch, are hereby appointed commissioners to lay out a territorial road, commencing at or near the northwest

corner of Jefferson county, thence running south on or near

the county line.

SEC. 4. That John S. Rockwell, Gustavus A. Foster, and Milwaukee to Dodge co. George Read, be and are hereby appointed commissioners to lay out a territorial road, commencing at a point on the line between ranges seventeen and eighteen where the territorial road crosses the same which runs from Milwaukee through Lisbon, Warren, and Oconomewoc, to Watertown, and running thence by the village of Oconomewoc to the bridge now constructed across Rock river, and thence to such point on the road from Watertown to Waupun as may be deemed best.

SEC. 5. The territorial road running from Hamburg to Road altered. Hustis' rapids, in Dodge county, is hereby altered so as to run directly on a straight line from the southeast corner of section sixteen, in the town of Rubicon, west to the road from Cotton's mills to Hustis' rapids.

SEC. 6. That F. K. Phoenix, John Fish, and O. M. Watertown Wilder, be and are hereby appointed commissioners to lay to Palmyra. out a territorial road from Watertown, in Jefferson county, by the way of Palmyra, to Delavan, in Walworth county. SEC. 7. That part of a territorial road lying between section twenty-three, town eleven, range fourteen, and the south line of said town, is hereby declared to be vacated.

SEC. 8. That Harrison W. Hamilton, George M. Barthol- Columbus to omew, and William Bradley, be and are hereby appointed Sauk county. commissioners to lay out a territorial road from Columbus, in Columbia county, to Sauk village, in Sauk county.

SEC. 9. Elbert Dickenson, A. Powell, and Charles Hait, Lake Puckaare hereby appointed commissioners to lay out a road.from way to MadLake Puckaway, by the way of Wyocena, to Madison, in

Dane county.
