Mr. Graham moved that the Senate resolve itself into a committee of the whole on the Assembly bill entitled "An act to incorporate the Cornwall Suspension Bridge Company, for the purpose of constructing and maintaining a suspension bridge, appurtenances and approaches to the same, over the Hudson river, at a point or points at or below Butter Hill, in the highlands, to some proper point opposite thereto on the east side of said river."

Mr. Mattoon moved to lay said motion on the table.

The President put the question whether the Senate would agree to said motion to lay on the table, and it was decided in the negative, as follows:

The conference committee to which was referred the points of difference on the bill entitled "An act making appropriations for certain public and charitable institutions," report that they have considered the same, and agreed to recommend the following amendments to the engrossed bill:

In the item, on page 1, line 4, striking out the word "fifty" and inserting the word "eighty" the Assembly concur.

Same section, line 8, after the word "equalization" insert the words "of assessments," Assembly concur.

Page 4, striking out the words as follows:

"For the Masonic Asylum, at Havana, $1,000.

"For the Jane Gray School, at Mount Morris, $3,000.

"For the Day Home, $5,000.

"For the Female Seminary, at Gainesville, $1,000.

"For the Ingham University, at Le Roy, $4,000.

"For the Evangelical Lutheran St. John's Orphan Home, at Buffalo, $2,000.

"For the St. Mary's Boy's Orphan Asylum, in Rochester, $5,000. "For the St. Vincent's Orphan Asylum, in Albany, $10,000. Assembly concur in all excepting "Day Home, at Troy," "Masonic Asylum, at Havana," "St. John's Lutheran Home, at Buffalo."

St. Mary's Orphan Asylum, at Rochester, was amended so as to read "one thousand dollars;" St. Vincent's Orphan Asylum, at Albany, "three thousand dollars;" Troy Catholic Male Orphan Asylum, "six thousand

five hundred dollars."

Striking out item as follows: "but including the Women's Hospital, the Mount Sinai Hospital, the Homoeopathic Infirmary for Women, the New York Infirmary for Indigent Women and Children, the Hospital of the Poor of St. Francis, the Ladies' Relief Association, at Elmira, for the Soldier's Home, the Brooklyn Hospital, the Long Island College Hos

pital, the Troy Hospital, the Marshall Infirmary, the Albany Hospital, the Rochester City Hospital, the St. Mary's Hospital at Rochester, the Buffalo General Hospital, the St. Mary's Lying-in Women's and FoundJing Hospital at Buffalo, the Buffalo Hospital of the Sisters of Charity," Assembly concur.

In item, "to hospital," Assembly concur with Senate in striking out the word "forty," and inserting the words "fifty-five."

In item, to New York Ophthalmic Hospital, amended to read "two thousand five hundred dollars."

In item, inserting the words "of New York," after the word "Dispensary," Assembly concur with Senate.

In the item striking out the words "requiring Dispensary to report," on page 5, lines 34 and 35, Assembly concur with Senate.

In item, for Rochester City Hospital, Senate recede.

In item, for St. Mary's Lying-in Women's Hospital at Buffalo, Assembly concur.

Assembly concur with Senate in inserting after line 6, page 6, the words "for the Buffalo General Hospital, five thousand dollars."

In striking out the item for the Society for Protection of Destitute Roman Catholic Children at Buffalo, on page 6, lines 27 and 28, Assembly concur.

In item, for Troy Hospital, page 7, line 1, Senate recede.

In the item for the Union Home and school for the orphan children of our volunteers, it is agreed it shall read as follows:

"For the Union Home and school for the orphan children of our volunteers, the sum of fifty dollars per head (not to exceed ten thousand dollars) for each orphan maintained by it, or in that proportion for the time such orphan is maintained; and the amount received by it under this appropriation is hereby declared to be a lien in favor of the State upon the real estate owned by it."

It is further agreed that the following item shall read as follows:

"To the New York Ladies' Educational Union, five thousand dollars." (Patriot Orphan Home), "the sum of five thousand dollars, which sum, if received, is hereby declared to be a lien upon the real estate owned by it." It is further agreed that the following item shall read as follows: "For the Colored Orphan Asylum of the city of New York, twentyfive thousand dollars, to be paid out of the Metropolitan excise fund." Also the following item:

"For the Ladies' Benevolent Society of the city of Schenectady, five hundred dollars, for the education and maintenance of indigent children under their charge, to be paid to their treasurer for the purpose aforesaid." It is also agreed that the item on page 2, lines 12, 17 and 18, on page 3, lines 3, 15, 20 and 31, on page 4, line 1, be stricken out of the bill. The following to be added at the end of section 2:

"For the charity week-day schools of the State, to be paid on the warrant of the Comptroller, pro rata according to the number of scholars instructed in them without charge during the last fiscal year, to be divided by the Comptroller on the 1st day of July next, on certificates duly verified by affidavit, fifty thousand dollars.

"Where the Comptroller has reason to believe that a false report or return has been made by any institution or school entitled to draw a share of the public moneys herein appropriated, he is hereby authorized to appoint, at the expense of the State, an agent to investigate the facts in the case, and if such report or return is found to be false in any particular, he is further authorized to modify or withhold entirely the portion to which such institution or school would have been entitled, and to divide the same among the remaining institutions."

All of which is duly submitted.

The President put the question whether the Senate would agree to the report of the conference committee, and it was decided in the affirmative, two-thirds of all the members elected to the Senate voting in favor thereof, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have agreed to the report of the committee of conference.

The Assembly returned the following entitled bills, with a message that they had non-concurred in the passage of the same :

"An act for the relief of Eli A. Bronson."

"An act to reimburse the Second Regiment of the National Guard for expenses and losses sustained by its members."

The Assembly returned the bill entitled "An act to incorporate the Mutual Benefit Savings Bank, in the city of New York," with a message that they had receded from the amendments made thereto by the Assembly.

Ordered, That the Clerk deliver said bill to the Governor.

The Assembly returned the bill entitled "An act to provide for the completion of the improvement of Third street, in the city of Brooklyn, and for the collection of the expense thereof," with a message that they had concurred in the passage of the same, with the following amend

ments:

Section 1, line 12, engrossed bill, after the word "than" add as follows: "The said commissioners shall include in their report, aforesaid, all claims heretofore accrued for work, labor and materials furnished which they shall deem just and equitable, on the improvement and widening of Third street, under and by virtue of the act to provide for the widening and improvement of Third street, in said city, passed April 17, 1860, and the act amendatory thereof, passed April 17, 1861; and said claim or claims, if allowed by them, shall form a part of the expenses of said improvement."

Add after the word "cost" in the 5th line of section 2, engrossed bill, as follows: "Including the sum of forty-seven thousand four hundred and ninety dollars, advanced by the first twelve, and twentieth wards of the said city, for interest on the bonds issued for the purposes of said improvement."

Add at the end of section 2, engrossed bill, the following: "The said sum of forty-seven thousand four hundred and ninety dollars, when collected, shall be credited to the said twentieth, and first twelve wards of the city of Brooklyn."

The President put the question whether the Senate would agree to concur in said amendments, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:
