the bill entitled "An act ceding jurisdiction to the United States over David's Island," reported that they have made some amendments thereto, and amended the title so as to read "An act ceding to the United States jurisdiction over David's Island, in the harbor of New Rochelle, and exempting the same from taxes and assessment," and as amended, recommend its passage; said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to authorize the Bloss Coal Mining and Railroad Company to hold real estate," reported that they have made some amendments thereto, and amended the title by adding thereto the words "in this State, to a limited amount, for the purposes of its business," and as amended, recommend its passage; said bill was committed to the committee of the whole.

The Assembly returned the bill entitled "An act to authorize the extension of the time for the collection of taxes in the several towns and cities of this State, for the year 1868," with a message that they had passed the same, with the following amendment:

Amend the title by striking out the word "eight" and inserting the word "seven."

Mr. Folger moved to concur in said amendment, with the further amendment, by striking out of the title all after the word "State."

The President put the question whether the Senate would agree to concur in said amendments, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being prescnt, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendment thereto, with a further amendment.

The Assembly sent for concurrence the bill entitled as follows:

"An act to incorporate the Rensselaer Park Association," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Palmer gave notice that he would, on some future day, ask leave to introduce a bill to amend "An act authorizing notaries public of the State of New York to perform the duties now performed by commissioners of deeds," passed April 15, 1859.

Also, a bill to amend the 14th section of title 1, chapter 5 of the Revised Statutes, in relation to notaries public.

Mr. Creamer gave notice that he would, on some future day, ask leave to introduce a bill to amend the registry law.

By unanimous consent, Mr. Palmer asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act in relation to theatres in the city of New York,' passed March 18, 1859; and to extend the same," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

In pursuance of previous notice, Mr. Edwards asked and obtained leave to introduce a bill entitled "An act to incorporate the Shelter Island Wharf and Improvement Company," which was read the first

time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

By unanimous consent, Mr. Hale asked and obtained leave to introduce a bill entitled "An act to aid in the construction of the Whitehall and Plattsburgh Railroad Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Mattoon, from the committee on public printing, to which was referred the resolution to print extra copies of the list of members, officers and reporters of the Legislature, reported in favor of the adoption of the following resolution:

Resolved, That there be printed 500 copies of the list of members, officers and reporters of the Legislature, for the use of the Senate, and 25 on card board.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Messrs. Mattoon and Cauldwell, from a majority of the committee on public printing, to which was referred the resolution to print extra copies of the report of the special committee on the management of the canals of the State, reported in favor of the adoption of the following resolution:

Resolved, That 3,000 copies of the report of the committee of the last Senate upon the conduct of the canals, with the evinence taken by them, be printed for the use of the Senate.

Mr. Nichols moved to amend by striking out "3,000" and inserting "4,000."

The President put the question whether the Senate would agree to said motion to amend, and it was decided in the affirmative, as follows:

In pursuance of previous notice, Mr. Chapman asked and obtained leave to introduce a bill entitled "An act to amend section 16 of chapter 783, entitled 'An act in relation to the powers and jurisdiction of surrogates' courts,' passed April 25, 1867," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Pierce asked and obtained leave to introduce a bill entitled "An act to incorporate the People's Mutual Warehousing and Security company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on commerce and navigation.

In pursuance of previous notice, Mr. Pierce asked and obtained leave to introduce a bill entitled "An act to amend an act entitled 'An act for the improvement of Brooklyn Heights,' passed April 17, 1866; and supplemental thereto," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

leave to introduce a bill entitled "An act to incorporate the National Burglar Insurance Company, in the city of New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on insurance.

By unanimous consent, Mr. Nichols asked and obtained leave to introduce a bill entitled "An act to protect, improve and keep in repair the Buffalo and Williamsville McAdam road, in the county of Erie," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

By unanimous consent, Mr. Van Petten asked and obtained leave to introduce a bill entitled "An act to repeal chapter 440 of the Laws of 1864," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary. Mr. Cauldwell offered the following resolution:

Resolved, That there be printed of the annual report of the Inspectors of State Prisons, 700 copies for the use of the Inspectors, and 500 for the use of the Senate.

The Assembly returned the following entitled bill, with a message that they had concurred in the further amendment of the Senate thereto: "An act to extend the time for the collection of taxes in the several towns and cities of this State."

Mr. Cauldwell moved to reconsider the vote upon the final passage of the bill entitled "An act to amend an act entitled 'An act to create a board of trustees for the town of Morrisania, in the county of Westchester, and to define their powers,' passed April 22, 1864; and the several acts amending the same."

The President put the question whether the Senate would agree to said motion to reconsider, and it was decded in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

On motion of Mr. Cauldwell and by unanimous consent, said bill was amended by striking out subdivision 1 of section 3, printed bill. Said bill, as amended, was then read a third time.

MONDAY, FEBRUARY 3, 1868.

The Senate met pursuant to adjournment.

Prayer by Rev. Mr. Reese.

The journal of Friday was read and approved.

Mr. Thayer presented a petition of citizens of the county of Essex, for State aid for the Whitehall and Plattsburgh Railroad Company, which was read and referred to the committee on finance.

Also, a petition of D. D. Briggs and others, in favor of the repeal of law constructing pier bridge at Rouse's Point, which was read and referred to the committee on commerce and navigation.

Also, a petition of citizens of Lansingburgh, in favor of a law submitting to the people the question whether the Capital Police law shall continue in force, which was read and referred to the committee on municipal affairs.

Mr. Folger presented a petition of John S. Mills, of New York city, for privilege to run cars through certain streets and avenues in said city, which was read and referred to the committee on railroads.

Mr. Humphrey presented a petition of Z. W. Barrett, for damages to his land caused by the overflowing of waters on the Genesee Valley canal, which was read and referred to the committee on claims.

Mr. Stanford presented a remonstrance of citizens of Canajoharie, against the repeal of the Metropolitan Excise law, which was read and referred to the committee on internal affairs of towns and counties.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act for the relief of Robert Gordon, and Frances Gordon, his wife," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to enable Robert Gordon, and Frances Gordon, his wife, and each of them to hold and transmit such real estate in this State as they or either of them shall actually occupy for his or her own use," and as amended, recommend its passage; said bill was committed to the committee of the whole.

The President presented the annual report of the trustees of the Astor Library, for the year 1867, which was laid on the table and ordered printed.

Mr. Bradley offered the following resolution:

Resolved, That 500 copies of said report be printed for the use of the

trustees.

Ordered, That said resolution be referred to the committee on public printing.

Mr. Folger gave notice that he would, on some future day, ask leave to introduce a bill relative to the disposition of surplus moneys arising upon sales on foreclosure of mortgage by advertisement under the

statute.

In pursuance of previous notice, Mr. Palmer asked and obtained leave to introduce a bill entitled "An act to amend an act entitled ‘An act authorizing notaries public of the State of New York to perform duties now performed by commissioners of deeds,' passed April 15, 1859,"
