Mr. Whiteley moved that the House take a recess until three o'clock. Upon which motion the yeas and nays being demanded and ordered, resulted-yeas 34, nays 18, as follows:

THREE O'CLOCK, P. M.

Mr. Roedter moved a call of the House, which was ordered. Whereupon Messrs. Bigger, Breslin, Brewer, Dodds, Dresbach, Julian, Lee, Marsh, Morris, Morse, Phillips, Potter and Smith of Brown, were absent.

On motion of Mr. Edson,

All further proceedings under the call were ordered to be dispensed with.

Mr. Whitely offered the following resolutions.

Resolved, That for the purpose of effecting an organization of this House, the two partial organizations already existing be united, and that Mr. Leiter of Stark, act as chairman, and Mr. McClure of Summit, as clerk, to whom the certificates and other evidences of claims to seats, heretofore handed to Messrs. Smith and Swift, shall be delivered; and that the House immediately proceed to the consideration of the following resolutions :

Resolved, That George E. Pugh and Alexander N. Pierce are entitled to seats in the organization of this House. Upon which resolution neither the said Pugh or Pierce, or Spencer or Runyan shall vote; but the same shall be decided by the other seventy certificated members; and, on the consideration thereof, the certificates of the said Pugh and Peirce, and Spencer and Runyan, and any other evidences of claim which either party may present, shall be read and considered, and all parties may be heard by counsel, or otherwise, as they may prefer. And in case said resolution shall not be decided affirmatively by a majority vote, the House shall proceed to consider the following resolution :

Resolved, That Oliver M. Spencer and George W. Runyan are entitled to seats in the organization of this House.

On which resolution the other seventy certificated members shall vote as on the preceding one. In case neither of said resolutions shall be decided affirmatively by a majority, Messrs. Pugh, Pierce, Spencer and Runyan shall withdraw their claims to seats until the organi

zation of the House shall have been effected; and nothing in these proceedings shall be construed to interfere with, or in any manner affect the right of Messrs. Spencer and Runyan or Messrs. Pugh and Pierce, to claim seats after such organization.

Mr. Holcomb moved that the House adjourn until to-morrow morning at ten o'clock, A. M. which was agreed to.

FRIDAY, DECEMBER, 29, 1849.

Mr. Smith, of Brown, moved a call of the House, which was ordered.

Whereupon, the House being called, it appeared that Messrs. Brewer, Dodds, Dresbach, Julian, Long, Marsh, Morris, Morse, Phillips, Potter, and Smith of Madison, were absent.

On motion of Mr. Hammond,

All further proceedings under the call were dispensed with.

Mr. Riddle moved that the House take up, for consideration, the resolutions offered by Mr. Whiteley.

Upon which motion the yeas and nays being demanded and orderdered, resulted as follows:

YEAS-Messrs. Armstrong, Bigger, Brainerd, Breslin, Burt, Chaffee, Copeland, Durbin, Giddings, Green, Gregory, Hammond, Hardesty, Johnson of Cuyahoga, Jones, Lee, Monfort, Morris, Pennington, Randall, Reber, Riddle, Roedter, Smart, Smith of Madison, Thompson, Townshend, Truman, Van Buskirk, Van Doren, Watt, and Whiteley-32.

So the motion was decided in the affirmative.

Mr. Mott moved that the House adjourn until Monday next, 10 o'clock, A. M. and that the foregoing resolutions be made the special order of the day for that day.

Mr. Holcomb moved a division of the question, and the question being, shall the House adjourn?

Upon which question the yeas and nays being demanded and ordered, resulted as follows:

Mr. Smith of Madison, moved that the resolutions heretofore offered by Mr. Whiteley, in the Hamilton county matter, be taken up for con

sideration.

Which motion, being put, was carried.

Mr. Holcomb moved that the House take a recess until three o'clock; which motion was lost.

Mr. Chaffee moved that the House take a recess until two o'clock; which motion prevailed.

TWO O'CLOCK, P. M.

Mr. Bigger moved that the House adjourn until 10 o'clock, tomorrow morning.

Upon which motion, the yeas and nays being demanded and ordered, resulted as follows:

Mr. Monfort moved a call of the House; which was ordered. Whereupon the House being called, it appeared that Messrs, Giddings, and Townshend were absent.

On motion of Mr. Holcomb,

All further proceedings under the call were ordered to be dispensed with.

Mr. Thompson moved that the resolution affirming the right of Messrs. Pugh and Pierce to seats in the organization of this House, be taken up for consideration; which was agreed to.

Mr. Whiteley moved that the House take a recess until two o'clock, P. M.; which motion prevailed, and

TWO O'CLOCK, P. M.

Mr. Mott moved a call of the House; which was ordered. Whereupon the House being called, it appeared that Messrs. Breslin, Johnson of Medina, Keller, Norris, Potter, Riddle, Roedter, and Smith of Brown, were absent.

Mr. Ringwood moved that all further proceedings under the call, be dispensed with; which was agreed to.

Mr. Townshend moved that the House adjourn until ten o'clock, to-morrow morning.

Upon which motion the yeas and nays being demanded, and ordered, resulted as follows:
