SENATE MESSAGES CONSIDERED.

House file No. 52, with Senate amendments, a bill for an act to amend section 5373 of the code, relative to the offering of evidence on the part of the state in the trial of criminal cases.

Amendments read first and second time.

Senate file No. 43, a bill for an act to amend section 2576 and section 2582 of the code, relating to the examination of persons beginning the practice of medicine.

Read first and second time and referred to committee on Public Health.

Substitute for Senate file No. 67, a bill for an act to amend section 729 of the code, in relation to the powers of library trustees.

Read first and second time and referred to committee on Judiciary.

Senate file No. 128, a bill for an act to amend section 1222 of the code, relating to appeals in certain cases.

Read first and second time and referred to committee on Judiciary.

Mr. Eaton was called to the chair.

Mr. Kendall asked that House file No. 75, be re-referred to the committee on Banks and Banking. There being no objection it was so referred.

Because of the absence of Mr. Warren, the Speaker announced that House file No. 73, would go over, and retain its place on the Calendar.

House file No. 48, a bill for an act to amend section 2401 of the code, realative to conducting business under permits, with report of committee recommending amendment and passage was taken up, considered and the report of the committee adopted.

On motion of Mr. Overfield, the following amendments as recommended by the committee were adopted:

Add "and for whose acts the permit holder shall be held responsible the same in all respects as for his clerks."

Further, that the title be changed by inserting the numerals "2401" after the word "one" (1) in title.

Also, insert numerals after word "one" (1) in line one (1) of section one (1).

Mr. Overfield moved that the rule be suspended, and that the bill be considered engrossed and read a third time now, which motion prevailed, and the bill was read a third time.

House file No. 38, a bill for an act to amend section 2992 of chapter 9, title 14 of the code of Iowa, relating to landlord and tenant, with report of committee recommending it be indefinitely postponed was taken up, considered, and on motion of Mr. Temple the report of committee was adopted and the bill was indefinitely postponed.

Senate file No. 112, a bill for an act to amend chapter 1 of the acts of the Twenty-seventh General Assembly of Iowa, relating to the publication of the laws of the state, with report

of committee recommending that the same do pass was taken up, considered, and the report of the committee adopted.

Mr. Temple moved that the rule be suspended, and that the bill be considered engrossed and read a third time now, which motion prevailed, and the bill was read a third time.

On motion of Mr. Blakemore, House file No. 94, a bill for an act to legalize the incorporation of the town of Athelston, Taylor county, Iowa, with report of committee recommending amendment and passage was taken up, considered and the report of the committee adopted.

On motion of Mr. Blakemore, the following amendments recommended by the committee were adopted:

Insert at the beginning of section one (1), the words and figure, section one (1).

Strike out of line one (1), section one (1), the words "declared valid", and by striking out of line six (6), section one (1), after the word "respects" the word "been."

Mr. Blakemore moved that the rule be suspended, and that the bill be considered engrossed and the reading just had be considered the third reading, which motion prevailed.
