So the bill passed.

The "bill in addition to "an act making certain appropriations, to be paid out of the contingent fund of the Legislative Council for the year eighteen hundred and twenty-eight," and for other purposes," was taken up.

On motion of Mr. Irwin, the item to Davenport and Durell was amended, so as to read as follows, (commencing in the 33d line,) "the sum of four hundred and seventy-four dollars and fifty cents, four hundred and fifty-six dollars of which has been advanced by the Bank of Michigan, in addition to the five hundred dollars heretofore appropriated, which latter sum was advanced to the claimants by the Treasurer of the Territory of Michigan."

On motion of Mr. Irwin, the item to Lewis Davenport was amended so as to read, "the sum of eleven hundred and thirtynine dollars;" and the ayes and nays being required on the motion by Mr. Drake, they were taken as follows:

Ayes....Messrs. Brown, Durocher, Edwards, Irwin, Lawrence, I'Donell, Noble, Rumsey, Stockton....9.

Nuys....Mr. Drake.

On motion of Mr. Lawrence, the following was added at the close of the 2d section, viz: “To Charles Dubois, for services as Messenger, ten dollars."

Mr. Lawrence then moved that that part of the bill which relates to issuing scrip, be stricken out; and also, that the 4th and 5th sections be stricken out; and the motion was agreed to.

The question "shall the bill pass ?" was then put; and the ayes and nays being ordered by the President, they were taken as follows:

Ayes....Messrs. Connor, Durocher, Irwin, M'Donell, Noble, Stockton, Trowbridge....7.

Nays.... Messrs. Brown, Drake, Edwards, Lawrence....4.
So the bill passed.

A message by Alr. Brush:

Mr. President....The Governor has this day approved and signed an act authorising administrators de bonis non, to prosecute suits commenced by the Executor or Administrator of the estate, and for other purposes," "an act to repeal a part of the act entitled "an act for the support and regulation of Mills," " an act to prevent Justices of the Peace from keeping taverns, and for other purposes," "an act to improve the navigation of the Huron River of Lake Erie," " an act to provide for the collection and settlement of taxes due previous to the passage of the present township laws," "an act to amend an act, entitled "an act to regulate and define the powers of Justices of the Peace and Constables in civil cases, and for other purposes," "an act to district the Territory of Michigan, and to provide for the election of Members of the Legislative Council," an act making certain appropriations to be paid out of the

contingent fund of the Legislative Council for the year eighteen hundred and twenty-eight," "an act to authorise the Boards therein named, to take charge of the School lands in this Territory;" also, "a resolution for the distribution of the volume of Revised Laws."

On motion of Mr. Noble, the Council went into the consideration of Executive business; and having disposed of the same;

The bill making certain appropriations, to be paid out of the Territorial Treasury, for the year one thousand eight hundred and twenty-eight," was taken up and passed.

On motion of Mr. Noble, the Council took a recess until 3 o'clock P. M.

3 o'clock, P. M.

Mr. Stockton, from the committee on Territorial Affairs, to whom vas recommitted "a bill amendatory to "an act for defraying the public and necessary charges in the respective counties in this Ter ritory, and for other purposes," reported said bill with amendments, which were accepted by the Council; and said bill was then read a third time and passed.

The "bill to provide for certain expenses in criminal cases, in the Supreme, Circuit, and County Courts, in the county of Wayne," was taken up in committee of the whole.

On motion of Mr. Drake, the bill was amended by striking out the words, "yearly, and each year hereafter," commencing in the 2d line, and that the following be inserted in lieu thereof, viz: "for services heretofore rendered." The ayes and nays on the question being required by Mr. Drake, were taken as follows:

Ayes--Messrs. Brown, Connor, Drake, Edwards, M'Donell, Rumsey, Trowbridge-7.

Nays-Messrs. Durocher, Irwin, Lawrence, Noble, Stockton, Schoolcraft-6.

The bill was then reported, read the third time and passed.

Mr. Stockton moved that the Council reconsider the question on the passage of the "bill in addition to "an act making certain ap propriations to be paid out of the contingent fund of the Legislative Council for the year eighteen hundred and twenty-eight," and for other purposes." The motion was agreed to; and the ayes and Days being required by Mr. Drake, they were taken as follows: Ays-Messrs. Connor, Durocher, Edwards, Irwin, M'Donell, Noble, Schoolcraft, Stockton, Trowbridge-9.

Nays-Messrs. Brown, Drake, Lawrence, Rumsey-4.
Said bill then being before the Council,

Mr. Schoolcraft moved that the 3d, 4th and 5th sections, which had been, on motion, stricken from the bill, be again resto red; and the ayes and nays on the question being required by Mr. Drake, they were taken as follows:

Ages-Messrs. Connor, Durocher, Edwards, Irwin, M'Donel; Noble, Rumsey, Schoolcraft, Stockton, Trowbridge-10.

Nays-Messrs. Brown, Drake, Lawrence-3.

Mr. Schoolcraft moved that the bill be further amended by stri Bing out the word "script," wherever it occurs in the bill, and insert in lieu thereof the word "certificates ;" and the motion was agreed to.

The President, at the request of Mr. Stockton, having called Mr. Lawrence to the Chair,

Mr. Stockton moved that after the word "to," in the 1st line of the 5th section, the following be inserted, viz: "the President of the Council and ;" that the word "each" be inserted in the 2d line of said section; and that the words, "President of the Legislative Council," be stricken from the 3d line of said section, and the word "Governor," be inserted in lieu. The motion was lost by the following vete; the ayes and nays being called for by Mr. No ble:

Ayes-Messrs. Connor, Durocher, Irwin, M'Donell, Schoolcraft, Stockton-6.

Nays-Messrs. Brown, Drake, Lawrence, Noble, Rumsey, Trowbridge-6.

On motion of Mr. Schoolcraft, the question "shall the bill pass ?" was then put, and was decided in the affirmative as follows; Mr. Drake calling for the ayes and nays:

Ayes....Messrs. Connor, Durocher, Edwards, Irwin, M'Donell, Noble, Rumsey, Stockton, Schoolcraft, Trowbridge....10. Nays....Messrs. Brown, Drake, Lawrence.....

So the bill passed.

On motion of Mr. Irwin, the "bill for the adjournment of the first session of the third Legislative Council," was taken up and read a third time.

Mr. Noble moved that the blank in said bill be filled so as to read, "the first Monday in September ;" and the motion was agreed to.

On motion, the bill then passed.

Mr. Drake, from the committee of Enrolment, reported as correctly enrolled, bills with the following titles: "An act for the relief of Sheldon & Wells and John D. Cray," "an act to amend an act, entitled "an act concerning judgments and executions," "an act to provide for certain expenses in criminal cases in the Supreme, Circuit, and County Courts, in the county of Wayne;" and the President signed the same.

On motion of Mr. Noble, the Council took a recess until g o'clock.

8 o'clock, P. M.

Mr. Noble, from the committee of Enrolment, reported as correctly enrolled, bills with the following titles, viz: "A bill making certain appropriations, to be paid out of the Territorial Treasury, for the year one thousand eight hundred and twenty-eight," " an act amendatory to "an act to set off and organise the township of Pa

nama, in the county of Washtenaw," "an act amendatory to an act for defraying the public and necessary charges in the respective counties in this Territory, and for other purposes," " an act in addition to "an act making certain appropriations to be paid out of the contingent fund of the Legislative Council, for the year eighteen hundred and twenty-eight," and for other purposes," and "an act for the adjournment of the first session of the third Legislative Council;" and the President signed the same.

On motion of Mr. Lawrence, the Council went into the conside ration of Executive business, and having disposed of the same;

Mr. Irwin moved that a committee of two members be appointed, to inform the Governor of the Territory that the Council were about to adjourn, and to ask if he had any further communications to make. The motion was agreed to, and,

Messrs. Irwin and Trowbridge were appointed said committee. The "bill amendatory to "an act relative to the City of Detroit," and to the act, entitled "an act to amend an act relative to the City of Detroit," was taken up as in committee of the whole, and again laid on the table.

Mr. M'Donell moved the adoption of the following resolution: Resolved, That the resolution, adopted the day of May last, xing the compensation of Clerks and other officers of the Legisla tive Council, be so far amended, as to allow the recording Clerk of this Council, hereafter, at the rate of three dollars per diem, as a compensation for his services; and that any resolution heretofore passed upon this subject, contravening the provisions of this resolution be, and the same is hereby repealed.

Mr. Drake moved that the resolution be amended so as to make the compensation of all the Clerks of the Council, "three dollars per day, each." The motion was decided in the negative. And the aves and nays being required by Mr. Drake, they were taken as follows:

Ayes-Messrs. Drake, Lawrence, Trowbridge-3.

Nays-Messrs. Brown, Connor, Durocher, Edwards, Irwin, M'Donell, Noble, Rumsey, Stockton, Schoolcraft-10.

The question on the adoption of the resolution was then put, and was decided in the affirmative by the following vote; the ayes and nays being called for by Mr. Drake :

Ayes-Messrs. Brown, Connor, Durocher, Edwards, Irwin, M'Donell, Stockton, Schoolcraft-8.

Nays-Messrs. Drake, Lawrence, Noble, Rumsey, Trow bridge-5.

Mr. Irwin, from the committee appointed to inform the Governor that the Council were about to adjourn, reported,

"That the Governor of the Territory had informed the committee, that he had no further communications to make to the Legisla tive Council."

On motion of Mr. Irwin,

The Council adjourned, sine die.
