Mr. Schoolcraft, from the committee of Enrolment, reported as correctly enrolled, the bill entitled "an act to prevent the abatement of actions in certain cases ;" and the President signed the

same.

Mr. Trowbridge, from the select committee appointed to prepare a bill to amend the Road Laws of the Territory, reported,

A bill to amend the "act regulating Highways," which was read the first time and laid on the table.

Mr. Irwin presented the memorial of George Sherman, and oth ers, inhabitants of the county of Washtenaw, remons rating against the taking away from said county certain tiers of townships, agreeably to sundry petitions heretofore presented. Read and referred to the committee on Territorial Affairs.

Mr. M'Donell, from the committee on Territorial Affairs, reported,

A bill respecting marks and brands for horses, cattle, sheep and hogs; which was read the first time; and,

On motion of Mr. M'Donell, said bill was then read the second time by its title and laid on the table.

Mr. Trowbridge presented the claim of Th. J. Drake, for services as counsel, assigned by the court to defend Platt Winchell, accused of larceny. Referred to the committee on Claims.

Mr. Noble, from the committee on the Judiciary, reported,

A bill to amend an act, entitled "an act allowing and regulating writs of replevin ;" which was read the first time and laid on the table.

The bill to amend the several acts to organise the Militia, was taken up, as in committee of the whole;

The question being on the motion of Mr. Stockton to amend the bill by str king out the words, "and September," after the word May," in the second line of the 4th section.

Mr. Lawrence moved that the amendment be amended, so that the said 4th section will read as follows:- That hereafter, the Militia shall rendezvous on the first Tuesday in May, annually, by regiments or battalions, and the muster of the commissioned and non-commissioned officers and musicians shall be between the first and last days of September, annually." The motion to amend the amendment was decided in the negative; and Mr. Lawrence requiring the ayes and nays thereon, they were taken as follows: Ayes—Messrs. Durocher, Lawrence-2.

Nays-Messrs. Brown, Connor. Drake, Edwards, Irwin M'Donell, Noble, Rumsey, Schoolcraft, Stockton, Trowbridge-11. The question was then taken on the motion of Mr. Stockton to amend, and it was decided in the affirmative.

Said bill as amended, was then on motion, ordered to be engrossed and read the third time on Thursday next.

The bill to organise the county of Galilee, and for other purposes, was taken up.

Mr. Schoolcraft moved that the bill be amended by striking out the word "Galilee," wherever it occurs in the bill, and by inserting in lieu thereof the word " Iowa ;" and the motion was agreed to, And said bill, as amended, was then passed.

The bill for the relief of Elizabeth A. Phillips, was taken up, read the third time and passed.

The bill to amend an act, entitled "an act to prevent Justices of the Peace from keeping tavern, and for other purposes," was taken up, read the third time, and again laid on the table.

The bill to lay off certain townships, and for other purposes, was taken up and read the third time

Mr. Irwin then moved that the bill be amended by striking out the word "Mindota," wherever it occurs in the bill, and insert in lieu thers of the word "Iowa ;" and the motion was agreed to.

On motion of Mr. Noble, the bill was further amended by adding therets the following section, viz:

"SEC. 7. That all that part of the present township of Raisinville, in the county of Monroe, lying west of Range No. 7, including one tier of sections out of range 7, east, be set off and made a separate township by the name of " Allen ;" and that the first township meeting be holden at the house of Morris Wells in said township."

Said bill as amended was then, on motion of Mr. Irwin, passed. On motion of Mr. Trowbridge, the Council then went into the consideration of Executive business; and having disposed of the

same,

The bill for the elf of John Curtis was taken up and read the third time.

Mr. Drake moved that the bill be amended by inserting the words," of the county of Washtenaw," after the word "Curtis," in the fourth line thereof; and the motion was agreed to;

And, on motion of Mr. Rumsey, said bill was then passed.

The bill to diss Ive the marriage contract between John Lawrence, late of the county of Monroe, and Lucy Lawrence, his wife; was taken up, the question being on the passage of said bill, where

upon,

Mr. Noble moved that the bill be laid on the table, and that the further consideration thereof be postponed until Thursday the 22d inst.; and the motion was agreed to.

On motion of Mr. M'Donell,

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so amending the criminal law, that corporeal punishment may be inflicted upon persons committing lar ceny and other crimes.

On motion of Mr. Noble,

Resolved, That the daily hour to which the Council shall stand adjourned, shall be 10 o'clock, A. M. until otherwise ordered. On motion of Mr. Durocher, the Council then adjourned.

FRIDAY, Oct. 9, 1829.

Mr. Stockton presented the petition of James B. Woolverton, and others, inhabitants of the county of St. Clair, praying that a law may be passed, declaring certain streams in said county to be public highways; which was read; and,

Mr. Stockton moved that said petition be referred to a select committee of five members; the motion was agreed to, and the following Members were appointed said committee, viz :

Messrs. Stockton, M'Donell, Irwin, Trowbridge, and Durocher. Mr. Durocher presented the petition of Musgrove Evans, and others, inhabitants of the county of Lenawe, praying that townships 4, south, in ranges two, three, and four, east, may be set off, by law, and attached to the county of Lenawe. Read and referred to the committee on Territorial Affairs.

Mr. Durocher also presented the claim of J. B. Vallee, for translating the message of the Governor of the Territory to the Legislative Council (at the commencement of the present session.) Referred to the committee on Expenditures.

Mr. Schoolcraft, from the committee of Enrolment, reported as correctly enrolled, the bill entitled "an act to organise the county of Iowa, and for other purposes;" and the President signed the

same.

Mr. Noble, from the committee on the Judiciary, reported,

A bill in addition to an act, entitled "an act to provide for the appointment, and to regulate the duties of District Attorneys," and the act to amend the said act; which was read the first time and laid on the table.

The bill amendatory to an act, entitled "an act to regulate the assessment and collection of Territorial taxes," was taken up as in committee of the whole.

Mr. M'Donell moved that the bill be amended by striking out the word "five," in the 11th line of the 2d section, and inserting in lieu thereof the word "ten;" and the motion was decided in the negative.

Mr. M'Donell then moved that the word "five" in said 11th line be stricken out, and that the word "eight" be inserted in lieu thereof and having required the ayes and nays on the motion, they were taken as follows:

Ares-Messrs. Brown, Durocher, Edwards, M'Donell, Noble, Trowbridge-6.

Nays-Messrs. Connor, Drake, Irwin, Rumsey, Schoolcraft, Stockton-6.

So the motion was lost.

Mr. Irwin moved that the bill be amended by inserting, after the words, "to place," in the 11th line of the 2d section, the words, "except Indian traders in the Indian country ;" and the motion wa agreed to.

Mr. M'Donell moved, that the blank in the 13th line of the 10th section, be filled by inserting the word "ten ;" and the motion was agreed to.

On motion of Mr. Stockton, the committee then rose, and the bill was recommitted to the committee on Territorial Afï i s.

Mr. Stockton gave notice that he should, on a fature day, ask leave to bring in a bill to attach a part of the township of Ceturelville, in the county of St. Clair, to the township of Clay, in sail county.

The bill in addition to an act, entitled "an act to regulate the admission and practice of Attorneys and Counsellors at Law, (approved April 12, 1827,) was taken up, read the third time, and passed.

The bill concerning the Treasurer of the Territory of Michigan, and for other purposes, was taken up, and,

Mr. M'Donell moved that said bill be committed to the committee on Territorial Affairs; and the motion was agreed to.

Mr. Irwin moved that the question taken yesterday, on the passage of the "bill to lay off certain townships, and for other purposes," be reconsidered, and the motion was decided in the affirmative; and said bill then being betere the Council,

Mr. Durocher moved that the word "Allen," in the fourth line of the 7th section, be stricken out, and that the word "Flumen," be inserted in lieu thereof. The motion was agreed to, and the bill, as amended, then passed.

Mr. M'Donell moved that the memorial to the Congress of the United States upon the subject of an additional body to the Legislature of the Territory, heretofore reported from the committee on Territorial Affairs, with amendments, be recommitted to said com mittee; and the motion was agreed to.

On motion of Mr. Schoolcraft,

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of abolishing or restricting the jurisdiction of the County Court in the county of Chippewa, and providing for a term of the Circuit Court of the separate Circuit for the connties of Michilimackinac, Brown and Crawfead; said term to be held on the Monday next following the July term at Michilimackinac. On motion of Mr. Schoolcraft,

Resolved, That the committee on the Judiciary be instructed to inquire and report, whether the present statute does not invest the Territorial Courts with power to declare a dissolution of the mar riage contract, for other cause than the violation of the marriage vow, and if not, that they be instructed so to modify it, as to grast this authority in cases where, from gross and continued ill usage on the part of the husband, confirmed habits of intoxication, se nal abandonment, or other good cause shown, on application of the wife, it may appear reasonable in the discretion of the Judges.

The resolution relative to making the provisions of the act ecur

ing to mechanics and others, pay for labor and materials, general, submitted by Mr. Noble on the 6th inst., was taken up and adopted. The resolution relative to the Bank of Michigan, submitted by Mr. Irwin on the 30th ultimo, was taken up and adopted.

On motion of Mr. Drake, the Council then adjourned.

SATURDAY, Oct. 10, 1829.

Prayer by the Rev. Mr. Brown.

At 1 o clock A. M. the President directed a call of the Council, and it appeared that the following Members were absent, viz: Messis, Connor, Durocher, Lawrence, Rumsey, Stockton.

And there not being a sufficient number of Members present to form a quorum, the President declared the Council to be adjourned unt.] Mʊnday next.

MONDAY, Oct. 12, 1829.

The President laid before the Council the petition of T. S. Smith, and others, inhabitants of the Territory, praying that a Territorial Road may be laid out and established, from the village of Ypsilanti, in the county of Washtenaw, westwardly, through Ann Arbor, &c. to a point near the mouth of the River St. Joseph. Read, and, on motion of Mr. Rumsey, referred to the committee on Territorial Affa rs.

Mr. Drake presented the petition of Wm. Thompson, and oth ers, inhabitants of the county of Oakland, praying that the law in relation to taxes may be so amended as to enable counties and towns to raise a sufficient sum of money to discharge the debts which said counties and towns may owe. Read and referred to the comm tee on Territorial Affairs.

Mr Noble presented the claim of T. S. Wendell for letter paper furnished the Council, which was referred to the committee on Expenditures.

Mr. Irwin presented the memorial and petition of John P. Sheldon, praying that a fine of one hundred dollars, which he had been sentenced to pay by the Supreme Court of the Territory, for an alleged contempt of said Court, may be remitted and returned to the committee of citizens by whom said fine was paid to the Sheriff of the county of Wayne. Said petition having been read,

Mr. Irwin moved that it be referred, together with the papers. and documents accompanying, to a select committee of five members. The motion was agreed to; and,

Messrs. Irwin, Drake, Schoolcraft, Noble, and M'Donell, were. appointed said committee.

Mr. Rumsey presented the memorial of John Allen, and others, inhabitants of the county of Washtenaw, and also the memorial of Chancey S. Goodrich, Robert Geddes, Job Gorton, and Augustus
