Root, Supervisors of said county, remonstrating against the cutting off from said county certain townships, agreeably to the prayer of certain petitioners and a bill for that and other purposes now before the Council. Read, and, on motion of Mr. Rumsey, referred to the committee on Territorial Affairs.

Mr. Drake, from the committee of Enrolment, reported as correctly endolled, bills with the following titles, viz:-"An act for the relief of John Curtis ;"" an act for the relief of Elizabeth A. Phillips ;""an act in addition to an act, entitled 'an act to regulate the admission and practice of Attorneys and Counsellors at Law," (approved April 12, 1827,) and "an act to lay off certain townships, and for other purposes;" and the President signed the same.

Mr. Irwin, from the committee on Claims, to whom was referred the claim of Th. J. Drake, reported,

A bill authorising the Treasurer of the county of Oakland to pay certain claims; which was read the first time; and, on motion of Mr. Irwin, said bill was then read the second time by its title and laid on the table.

Mr. M'Donell, from the committee on Territorial Affairs, to whom was referred the petition of sundry inhabitants of the township of Bucklin, in the county of Wayne, reported,

A bill to set off and organise the townships of Lima and Richland, in the county of Wayne; which was read the first time, and, on motion of Mr. M'Donell, said bill was then read the second time by its title and laid on the table.

Mr. M'Donell, from the committee on Territorial Affairs, to whom was recommitted .he memorial to the Congress of the United States, relative to an additional body to the Legislature of the Territory, reported the same with amendments; and said memorial, as amended by the committee, was then read and laid on the table.

Mr. Irwin, from the committee on Internal Improvement, to whom was referred the memorial and petition of John P. Arndt, and others, reported,

A bill to incorporate the President, Directors, and Company of the Portage Canal and Road Company; which was read the first time; and, on motion of Mr. Irwin, said bill was read the second time by its title and laid on the table.

Mr. Rumsey, from the committee on Territorial Affairs, reported, A bill to provide for laying out a certain Territorial Road; which was read the first time; and, on motion of Mr. Rumsey, said bill was then read the second time by its title and laid on the table. A message by Mr. E. A..Brush:

Mr. President-The Governor of the Territory approved and signed on the 7th inst. "An act to amend an act, entitled' an act to provide for the election of a Delegate in the Congress of the United States; "an act to authorise the set dement of certain accounts by the Supervisors of the county of Crawford ;” “ an act to amend

an act, entitled an act concerning appeals and writs of error, certiorari, and habeas corpus," (adopted by the Governor and Judges on the 21st day of December, 1820;) and "an act for the relief of overseers of Highways." On the 9th inst. he approved and signed an act to organise the county of Iowa, and for other purposes;" and to-day he has approved and signed, "an act in addition to au act, entitled 'an act to regulate the admission and practice of Coun sellors and Attorneys at Law," (approved April 12, 1827;) and, "an act to prevent the abatement of actions in certain cases.

The bill to amend "an act regulating Highways," was taken up and read the second time.

Mr. Trowbridge moved that the bill be amended by adding at the close of the second section, the following, viz:-" Provided, that the overseers, as aforesaid, shall not be liable for taxes which are not collectable ;"—and the motion was decided in the affirmative. On motion of Mr. Trowbridge, said bill was then ordered to be engrossed and read a third time o Monday next.

Mr. M'Donell moved that the “bill to amend an act to prevent Private Lotteries; the "bill to raise a sum of money by Lottery for the purpose of establishing a free communication by land betwee the city of Detroit and the village of Monroe;" and the "bill to amend an act, entitled an act for the relief and settlement of the Tour"—be recommitted to the committee on Territorial Affairs; and the motion was agreed to.

The bill to amend an act, entided "an act allowing and regula ting writs of replevin," was taken up and read the second time; and having been considered in committee of the whole, said bill was ordered to be engrossed and read a third time on Monday next.

The bill to incorporate the rectors, wardens, and vestry-men of Christ's Church in the township of Green Bay, was taken up and read the third time;

Mr. Irwin then moved that the bill be amended, by inserting, before the name of "Daniel Whitney," in the second line of the first section, the following, viz: "Richard F. Cadle as rector, and ;” and the motion was agreed to;

And said bill, as amended, was then passed.

A message on Executive business was received by the hands of Mr. E. A. Brush.

On motion of Mr. Noble, the Council went into the consideration of Executive business, and having disposed of the same,

TUESDAY, Oct. 13, 1829.

Prayer by the Rev. Mr. Richard.

Mr. irwin presented the petition of Abraham Wendell, and others, inhabitants of the coumy of Michulimackanac, rying that the provisions of the "act to licence groceries and ordinaries within the

township of Green Bay, in the county of Brown," may be extended to the county of Michilimackinac. Read and referred to the committee on Territorial Affairs.

Mr. M'Donell presented the claim of Mary Friskett and William Burbank (assigned to Orville Cook) for remuneration as witnesses, in the case of the United States vs. Levi Willard. Referred to the

committee on Claims.

Mr. Lawrence presented the claim of E. D. Ellis, for balance due him for printing done for the 2d Legislative Council, and for pubJishing the laws of the 1st session of the 3d Council. Referred to the committee on Expenditures.

Mr. M'Donell presented the petition of William Lewis, of Detroit, praying for remuneration for losses and expenses in the pursuit of John Reid. Read and referred to the committee on Claims.

Mr. Schoolcraft, from the committee on Expenditures, reported, A bill to provide for the compensation of the officers of the Legislative Council, and for other purposes; which was read the first time; and, on motion, said bill was read the second time by its title and laid on the table.

The bill respecting marks and brands for horses, cattle, sheep, and hogs, was taken up as in committee of the whole.

Mr. Drake moved that the bill be amended by striking out the 3d line in the 3d section, and inserting in lieu thereof the following, viz :—“ When required, twelve and a half cents;" and the motion was agreed to.

On motion of Mr. M'Donell, said bill, as amended, was ordered to be engrossed and read a third time on Monday next.

On motion of Mr. Irwin, the Council went into the consideration of Executive business; and having disposed of the same, On motion of Mr. Durocher, adjourned.

WEDNESDAY, Oct. 14, 1829.

Prayer by the Rev. Mr. Richard.

Mr. Rumsey resented the memorial of Geo. Cornelius, and others, inhabitants of the county of Washtenaw; that of Thomas B. Noble and others, and of Rufus Crossman and others, of said county, remonstrating against an alteration of the boundaries of said county. Also, the petition of Ed. Clark, and others, John Mann, and others, John Gorham, and others, and of William Hatt, and others, praying that the "bill to organise the counties of St. Joseph and Kalamazoo, and for other purposes," now before the Legislative Council, may become a law of the Territory. And said memorials and petitions were, on motion of Mr. Rumsey, referred to the committee on Territorial Affairs.

Mr. M'Donell presented the petition of Oliver Newberry, and others, and of Lewis Davenport, and others, inhabitants of the county of Wayne, praying that a law may be passed to enable the

Supervisors of said county, by increasing the maximum of taxation, &c. to redeem the debts of the county. Read and referred to the committee on Territorial Affairs.

Mr. Drake presented the petition of Delia Alvord, praying that a law may be passed to dissolve her marriage with William Alvord. Referred to the committee on the Judiciary.

Mr. Drake, from the committee on the Judiciary, to whom was referred the petition and papers in behalf of Peter Schoonover, of the county of Oakland, made a verbal report adverse to the prayer of the petitioners; and the petition and accompanying papers were then laid on the table.

Mr. Drake presented the report of Alexander Graham and John P. Sheldon, Directors of the "Clinton River Navigation Company" which was laid on the table.

Mr. Drake, from the committee on the Judiciary, to whom had been referred the petition of Susanna Hutchinson, reported,

A bill to dissolve the marriage contract existing between William Hutchinson and Susanna Hutchinson; which was read the first time and laid on the table.

Mr. Drike, from the committee of Enrolment, reported as correctly enrolled, a bill entitled "an act to incorporate the rectors, wardens, and vestry-men of Christ's Church, in the townshup of Green Bay ;" and the President signed the same.

Mr. Irwin, from the committee on Territorial Affairs, to whom the petition from the inhabitants of Michilimackinac upon the subject had been referred, reported,

A bill to amend an act, entitled "an act to authorise the licencing of victualling houses, ordinaries, and groceries, within the township of Green Bay ;" which was read the first and second times; and having been considered as in committee of the whole, said bill was ordered to be engrossed and read the third time to-morrow.

Mr. Schoolcraft moved that "a bill to provide for the compensation of the officers of the Legislative Council, and for other purposes," now on the table, be committed to the committee on Expenditures; and the motion was agreed to.

Mr. M'Donell, from the committee on Territorial Affairs, to whom had been recommitted a bill to raise a sum of money by Lottery, for the purpose of establishing a free communication by land between the city of Detroit and the village of Monroe," reported the same with amendments, which were read; and said bill (with the amendments) was then, on motion of Mr. M'Donell, laid on the table.

Mr. M'Donell, from the committee on Territorial Affairs, to whom had been committed a bill to amend an act, entitled an act for the relief and settlement of the Poor," reported the same with amendments, which were read, and, on motion of Mr. M'Donell, said amendments were accepted.

Mr. M'Donell then moved that said bill, as amended, be engross

ed and read a third time on Monday next; and the motion was agreed to.

The bill to incorporate the President, Directors, and Company of the Portage Canal and Road Company; was taken up as in committee of the whole.

On motion of Mr. Irwin, the following amendments were made to the bill, viz:-The word "erecting" was stricken from the 3d line of the 1st section, and the word "cutting" inserted in lieu; the name of "Joseph Watson" was inserted in the 3d line of the 2d section; the words "and direct," after the word "expedient," were stricken out in the 37th line of the 3d section; the words, "by means of said Canal," were inserted after the word "flowing," in the 5th line of the 6th section; and the word "such" was inserted, after the word "make," in the 2d line of the 8th section.

On motion of Mr. Schoolcraft, said bill was further amended by adding, at the close of the 8th section, the following proviso:— "Provided, that nothing in this act contained, shall be so construed as to authorise the Company to demand any toll of the troops or property of the United States' government, or mails of the United States, which may pass the said canal or road"

Mr. Drake then moved that the bill be laid on the table; and having required the ayes and nays on the motion, they were taken as follows:

Ayes-Messrs. Brown, Connor, Drake, Edwards, Lawrence, Rumsey-6.

Nays-Messrs. Durocher, Irwin, M'Donell, Noble, Schoolcraft, Trowbridge-6.

So the motion was lost.

On motion of Mr. Lawrence, the further consideration of said bill was then postponed until Saturday next.

Mr. Drake gave notice that, on a future day, he should ask leave to bring in a bill authorising the guardian of Imri Fish to remove said Imri from the jail of the county of Oakland, to some place without the Territory.

The bill authorising the Treasurer of the county of Oakland to pay a certain claim, was taken up; and having been considered in committee of the whole, was, on motion of Mr. Irwin, ordered to be engrossed and read the third time on Friday next.

On motion of Mr. M'Donell, the Council then adjourned.

Mr. Schoolcraft presented the claims of John P. Sheldon for work and materials in printing 600 copies of the Laws of the 1st session of the 3d Council; and of H. L. Ball for publishing said laws in the Detroit Gazette. Referred to the committee on Expenditures.
