Mr. M'Donell then moved that the bill be amended by striking out the words, "first Monday of January," in the 2d section, and inserting in lieu thereof the words, "second Monday of May;" and,

Mr. Lawrence then moved that the bill be amended by striking out the word "January," in the second section, and inserting in lieu thereof the word "February ;" and the motion was decided in the negative by the following vote, the ayes and nays being required by Mr. Lawrence:

Nays-Messrs. Brown, Drake, Durocher, Noble, Rumsey, Stockton, Trowbridge-7.

Mr. Drake then moved that the bill be engrossed and read a third time on Monday next; and the motion was agreed to by the following vote, the ayes and nays being required by Mr. Lawrence: Ayes--Messrs. Brown, Durocher, Drake, Edwards, Lawrence, Rumsey-6.

Nays-Messrs. M'Donell, Noble, Stockton, Trowbridge--4. The bill to provide for the payment of certain claims from the Territorial Treasury, was taken up ; and,

On motion of Mr. M'Donell, said bill was committed to the committee on Claims.

On motion of Mr. Drake,

Resolved, That the committee on the Judiciary be required to inquire into the expediency of providing some means for the allowance of writs and other process in each of the Circuits during the vacation of Courts.

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of providing by law for the further recording of certain proceedings heretofore had in the Probate Court of the county of Oakland,

On motion of Mr. Rumsey,

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of amending the 6th and 14th sections of the act relative to the duties and privileges of townships, and to provide by law for the filling of vacancies, occasioned by death or otherwise, of township officers.

The bill to amend an act, entitled "an act to authorise the Legislative Council to punish for contempt, and to privilege the Mem

bers of the Council from arrest," was taken up and considered as in committee of the whole; and, on motion, said bill was ordered to be engrossed and read the third time on Friday next.

On motion of Mr. Drake, the Council went into the consideration of Executive business, and having disposed of the same,

The following messages, received this day from the Governor of the Territory, by the hands of Mr. E. A. Brush, were severally read and referred to the committee on Territorial Affairs :

To the Legislative Council:

At the last session of Congress an act was passed, extending to the citizens of Florida and Arkansas the privilege of electing almost all the officers, holding their offices under the Territorial laws, and authorising the local Legislature to appoint the few, not rendered eligible by the people. I see no reason why the principles of this act should not be extended to this Territory, and I submit for your consideration the expediency of an application to Congress for that purpose. I believe it will be found, that appointments thus made will be more satisfactory than when they are made upon the nomination of a single individual. The people in their respective counties are better acquainted with the qualifications of candidates for the offices of Sheriffs, Clerks, Justices of the Peace, and for other county offices, than any Executive magistrate can be, and more competent to determine upon them. This measure would give to the people a direct and proper influence in the management of their affairs. An influence, which at all times ought to be exerted in a Republican government, and which will be more fully exerted in that change of our political condition, to which we are rapidly ap proaching. At the request of his Excellency Gov. Cass, I herewith subjoia a statement of the situation of the Detroit Fund, exhibiting the debts due said fund, together with, as I conceive, a fair valuation of 74 City Lots remaining unsold, and the Council-House and Lot; also, the amount of claims due individuals by the said fund, as near as İ can ascertain from the documents and papers in my possession, and the claimants or their agents.

All which is respectfully submitted.

On motion of Mr. Noble, the report made yesterday from the committee on the Judiciary, relative to petitioning the Congress of the United States to increase the compensation of the present Judges of the Supreme Court of the Territory, was recommitted to the same committee.

On motion of Mr. M'Donell, the memorial to the Congress of the United States, relative to an additional body to the Legislature of the Territory, was recommitted to the committee on Territorial Affairs.

On motion of Mr. Drake, the Council then adjourned.

Mr. M'Donell gave notice that he should, on a future day, ask leave to bring in a bill to establish the Farmers and Mechanics? Bank of Michigan.

The memorial to the Congress of the United States, for an appropriation for a Light-House at the mouth of the River St. Joseph. and for rendering said river navigable, was taken up.

On motion of Mr. Stockton, the following resolution was added to said memorial, viz:

Resolved, That the Governor of the Territory be and he is bereby requested to transmit a copy of the foregoing to the President of the Senate, the Speaker of the House of Representatives, and the Delegate from this Territory, at the next session of Congress. On motion of Mr. Stockton, said memorial and resolution were then adopted.

The memorial to the Congress of the United States, asking for a grant of a township of land to enable the Territory to erect a Hospital for the relief of distressed emigrants, sailors, and disabled and discharged soldiers, was taken up ; and,

On motion of Mr. M'Donell, said memorial was adopted.

The memorial to the Congress of the United States, relative to additional appropriations for roads in the Territory of Michigan, was taken up; and,

On motion of Mr. Trowbridge, said memorial was adopted.

The bill to organise the counties of Cass and St. Joseph, was taken up and read a third time.

On motion of Mr. Noble, said bill was then amended by adding thereto three sections, to stand as the 8th, 9th, and 10th sections of said bill.

On motion of Mr. Noble, the title of said bill was then amended by adding thereto the following, viz: “and for establishing courts therein."

And said bill, as amended, was then, on motion, passed.

The bill defining the duties of the Treasurer of the Territory of Michigan, was taken up, with the amendments made thereto by the committee on Territorial Affairs; and,

On motion of Mr. M'Donell, said amendments were accepted, and the bill was then read the third time.

Mr. Trowbridge then moved that the blank in the 7th section of the bill be filled by inserting the word "sixty;" and the motion was agreed to.

Mr. Lawrence then moved that the bill be further amended, by striking out the words, "the Bank of Michigan," in the 3d section of the bill, and inserting in lieu thereof the following, viz:-"some specie paying bank at the seat of the Territorial government," and that the subsequent part of the same section be made to correspond with said amendment; and the motion was agreed to by the following vote, the ayes and nays having been required by Mr. Drake:
