AN ACT to provide for laying out and establishing Territorial Roads therein named.

SECTION 1. Be it enacted by the Council and House of RepreRoad from Green sentatives of the Territory of Wisconsin, That a territorial road shall be laid out and established, running from a point in the town of Green Bay, near the residence of R. M. Eberts, along the high ground between Fox and Manitoo rivers, to the town of Depere ; and that W. Dickinson, L. Grignon and C. R. Brush, be and hereby are appointed commissioners, to lay out said road.

A territorial road shall be laid out and established, running on the most direct and eligible route from the Little Butte Morts to Fon du des Morts, by the entrance of Fox river into Lake Winnebago, to Fond du Lac; and that Samuel Irwin, Webster Stanly and George C. Wright be, and hereby are appointed commissioners, to lay out said road.

SEC. 3. A territorial road shall be laid out and established, running from the Fox river, at or near Knagg's dwelling, on the most direct and eligible route to the out-let of Fox Lake; and Clark Dickinson, David Evans and William Powell be, and hereby are appointed commissioners, to lay out said road.

SEC. 4. A territorial road shall be laid out and established, From U. S. Road running from the United States road at or near Wright's dwelling, above Plum Creek, on the most direct and eligible route by La Fontaine, to Cliffton on Lake Winnebago; and that J. D. Doty, Paul Beaulieu and Hole S. Wright be, and hereby are appointed commissioners to lay out said road.

SEC. 5. A territorial road shall be laid out and established, running from Fon du Lac, on the most direct and eligible route by the way of Fox Lake to Madison; and that M. C. Darling, J. P. Brower and John Catlin be, and are hereby appointed Commissioners, to lay out said road.

SEC. 6. A territorial road shall be laid out and established, running from the town of Sheboygan on Lake Michigan, to Rochester and from thence on the most direct and eligible rcute to Fon du Lac; and that Charles D. Cole, David Giddings and John

SEC. 7. A territorial road shall be laid out and established, From Manitou. running from the town of Manitouwoc on Lake Michigan, to Manitouwoc Rapids; from thence to Thayer's mill, on the best and most direct route; from thence to Cliffton on Lake Winnebago, on the best and most direct route; and Benjamin Jones, Plinny Pierce and Horace Conroe are hereby appointed commissioners to lay out said road.

SEC. 8. No part of the expense of laying out said roads, shall be paid from the treasury of any of the counties through which said roads may pass; nor shall any part thereof be paid out of the territorial treasury.

NO. 5.

AN ACT to organize the Counties of Manitouwoc and Sheboygan.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That the counties of Manitouwoc and Sheboygan, shall be organized for all the purposes Organization for County Governof county government from and after the taking effect of this act, ment. and the inhabitants therein shall be entitled to, and enjoy all the rights and privileges which the inhabitants of the several organized counties of the Territory now enjoy, except as hereinafter provided.

SEC. 2. The first election for township and county officers in said counties, shall be held on the first Monday of March, A. D. First electiɔn. 1839, at the several places in said counties where the last general election was held, and thereafter the elections in each of said counties shall be at the times and places provided by law. SEC. 3. At the first election in said ounties, returns shall be made to the clerk of the board of county commissioners of Brown county, who shall proceed to canvass the votes and issue certifi- made. cates to the several persons who may be elected to office at said election, in the manner provided by law.

SEC. 4. NO. 6.

AN ACT to provide for laying out and establishing a Territorial Road from the northern boundary line of the State of Illinois, to Madison, Wisconsin Territory.

SECTION 1. Be it enacted by the Council and House of RepreCommissioners. sentatives of the Territory of Wisconsin, That Joseph Griffin, William Bowman, and Anson W. Pope, be, and are hereby appointed commissioners to lay out and establish a territorial road, commencing at a point near or on section thirty-one, in town one, in range nineteen east, thence on the most eligible route to Big Foot or the outlet of Geneva Lake, thence to the seat of Justice of Walworth county, thence on the most eligible route to Madison. SEC. 2. Said commissioners shall proceed to the discharge of the duties assigned them, agreeably to the provisions of an act entitled *" an act to provide for laying out and opening territorial roads," approved January 3, 1838.

NO. 7.

AN ACT to repeal so much of an act entitled "an act to divide the County of Iowa," as establishes the seat of justice of the County of Green at New Mexico, and to provide for the location of the seat of justice of the County of Green.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That so much of the second section of an act entitled "an act to divide the county of Iowa" as establishes the seat of justice of the county of Green at New Mexico, be, and the same is hereby repealed.

SEC. 2. James L. Thayer, J. F. Ostrander and George W. Hickox are appointed commissioners to locate and establish the seat of justice of said county of Green.

SEC. 3. The commissioners aforesaid, or a majority of them, shall meet at the dwelling house of Joseph Payne in said county, on the second Monday of February next, or as soon thereafter as practicable, and before proceeding to the discharge of the duties assigned them by this act, shall severally take an oath before some Oath of person legally authorised to administer the same, to perform the duties of their appointment faithfully, without fear, favor or affection, or any reward or hope thereof: and if either of the commissioners shall violate the above oath, he shall be liable to all the pains and penalties of perjury.

SEC. 4. It shall be the duty of said commissioners to make a Their duties. careful examination of said county, having regard to its present and probable future population, and to locate the seat of justice of the same, where in their opinion, it will be for the best interest of the county.

State line of Illinois.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That James Biggs, John Slothour and Isaac H. Palmer, are appointed commissioners

to lay out a territorial road from Madison, the seat of Government, thence by or near James Biggs residence in Green county, thence by or near Adam Collins farm, thence by or near George Carrols farm, in the county of Iowa, thence by the nearest and best route to the State line of Illinois, so as to intersect the road from Gratiots Grove in this Territory, to Galena, Illinois.

SEC. 2. That said commissioners shall proceed to perform their duties as directed by an act, entitled *an act to provide for laying out and opening territorial roads, approved January 3, 1838. Approved Dec. 20, 1838.

NO. 9.

AN ACT to lay out and establish certain Territorial Roads.

SECTION 1. Be it enacted by the Council and House of RepreCommissioners sentatives of the Territory of Wisconsin, That Elisha Newhall, to lay out a road from Chicago Christopher Douglas and Elias Ogden, be and they are hereby State road to Madison, appointed commisssioners to lay out and mark a Territorial road, commencing at or near the head of Geneva Lake, to where the Chicago State road terminates at the State line, from thence the nearest and best route through Prairie du Lac, to the outlet of Lake Kushkanong, from thence the nearest and best route to Madison, in the county of Dane.

SEC. 2. The commissioners aforesaid, shall meet at the house of Christopher Douglas, in the county of Walworth, and proceed to the discharge of the duties assigned them agreeably to an act, *"entitled an act for the laying out and opening territorial roads," approved January 3, 1835.

SEC. 3. That E. Peck, David Humes and Christopher Douglas, be and they are hereby appointed commissioners to lay out and mark a territorial road commencing at Madison, in the county of Madison to Big Dane, thence by the best and most practicable route to the dwelling house of David Humes, on Rock River, thence by the best and most practicable route to the south line of the Territory, at or near Big Foot Prairie, (so called) in the county of Walworth.

SEC. 4. The commissioners, mentioned in the third section of this act, shall meet at Madison, in the county of Dane, and proceed to the discharge of the duties assigned them, according to the provisions of an act entitled, *"an act to provide for laying out and opening territorial roads," approved January 3, 1839.
