SEC. 5. And if either of the boards of county commissioners mentioned in this act, shall be of opinion that any territorial road which shall be laid out and surveyed, before they proceed to the Discretionary discharge of their duties under this act, is the proper route for any part of the road which they are appointed to lay out, they are at liberty to commence and terminate their survey at such points in the line of the road so previously laid out and surveyed as they shall think proper.

NO. 10.

AN ACT to provide for the construction of a bridge across the Milwaukee
River in the town of Milwaukee.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That the Board of Trustees of the town of Milwaukee in conjunction with the board Trustees of town of Trustees of the town of Milwaukee on the west side of the river bridge. be, and they are hereby authorised to locate and construct, or cause to be located and constructed a draw-bridge across the Milwaukee River in the town of Milwaukee, from the foot of Chesnut-street on the West side to the foot of Division-street on the east side thereof: Provided, that the said bridge shall be so constructed and attended as to prevent any unreasonable detention of any ship, vessel, or other water craft, passing up or down said river.

SEC. 2. That the expenses to be incurred in the erection and Expenses how paid. completion of said bridge, shall be paid in equal amounts from the treasuries of the two corporations above named, and the Trustees of each of said corporations are hereby from time to time empowered to levy and collect a tax on the real and personal estate within their corporate limits, sufficient to pay all expenditures necessary to be incurred for the erection of said bridge and keeping the same in repair.

SEC. 3. That the said bridge when completed, shall be and Free of toll. forever remain free, and no person or persons crossing the same shall be required to pay any toll thereof [therefor.]

SEC. 4. An act entitled "an act to provide for the construction of a bridge across the Milwaukee river in the town of Milwaukee," approved Dec. 6, 1836, is hereby repealed; Provided the bridge between Chesnut and Division-streets, contemplated by this act, shall be completed in one year from June next.

NO. 11.

AN' ACT to amend "An act to establish and regulate Ferries in the County of Milwaukee, and the counties thereto attached for judicial purposes."

SECTION 1. Be it enacted by the Council and House of Repre sentatives of the Territory of Wisconsin, That the county commissioners of said county of Milwaukee, shall declare all Ferries across the Milwaukee river within three miles of the mouth of said stream, to be free for the passage of all persons, teams or property of any description, and may make such regulations in Ferries to be regard to said free ferries as they may deem proper, and appropriate such monies from the county Treasury for the support thereof as may be deemed necessary; Provided, that the licences already granted for ferries across said stream shall not be revoked, unless the said commissioners shall first purchase the scows and other ferry-boats belonging to the proprietors thereof, at the appraised value to be fixed by three disinterested persons to be appointed by said commissioners.

SEC. 2. So much of the act of which this is amendatory, as contravenes the provisions of this act is hereby repealed.

AN ACT to provide for laying out a Territorial Road from Milwaukee to
Beloit.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That Byron Kilbourn, Freeman Hibbard and Lucius G. Fisher, are appointed commissioners to lay out a territorial road from Milwaukee by Troy and Direction of road Elkhorn in Walworth county, to Beloit, in the county of Rock;

Provided, that said commissioners shall have power to adopt a portion of a territorial' road which they may find to have been previously located on said route.

SEC. 2. Said board or a majority of them shall meet at Milwaukee, at such time as they may agree upon, and proceed to the discharge of the duties assigned them by this act, agreeably to the provisions of an act to provide for laying out and opening territorial roads, approved January 3, 1838, and the road so

AN ACT to provide for laying out and establishing certain Territorial Roads therein named.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That Thomas Brayton, Lyman E. Boomer and Benoni W. Finch be, and hereby are, appointed commissioners to lay out and establish a territorial road, commencing at a point on the south line of the Territory in the Road from Beloit town of Beloit, thence on the nearest and most practicable route by Janesville, Aztalan and Watertown, to the outlet of Fox Lake, thence returning on the most practicable route to Aztalan.

P. Brower, and Mason C. Darling be, and hereby are, appointed commissioners to lay out said roads.

SEC. 5. Said commissioners shall proceed to the discharge of their duties agreeably to the provisions of an act entitled an act to provide for laying out and establishing territorial roads— Approved January 3d, 1838.

AN ACT authorising the Commissioners of Milwaukee County to procure certain records of titles therein mentioned.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That the county commissioners of Milwaukee county be and they are hereby authorised to procure at the expense of said county, correct copies of all deeds, mortgages and bonds, in relation to lands within said county now on record in the Register's office of Brown county.

SEC. 2. The Register of Milwaukee county is hereby required to preserve the records aforesaid in his office in the same manner as other records are kept, and also to prepare a correct index thereto.

AN ACT to provide for laying out and establishing a Territorial Road from
Racine, in Racine County, to Madison in the county of Dane, in Wisconsin
Territory.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That Enoch Chase, Charles Leet, and Simeon Mills, be and they are hereby appointed cine to Madison. commissioners to lay out and establish a territorial road commencing at the town of Racine, in the Territory of Wisconsin, thence by the best and most practicable route to Madison, in the county of Dane.

SEC. 2. The commissioners aforesaid shall meet at the town of Racine on or before the first day of March next, 1839, and shall proceed to the discharge of the duties assigned them by this act,

AN ACT to incoporate the Dodgeville Mining Company.

SECTION 1. Be it enacted by the Council and House of Representatives of the Territory of Wisconsin, That William J. Madden, Henry L. Dodge and George W. Jones, and such other persons as they may associate with them, be and they are hereby declared to be a body corporate and politic for the term of fifty years, unless this charter be sooner repealed by the Legislature, by the name and style of the Dodgeville Mining Company; and by Style of Compa this title shall be capable of sueing and being sued, of pleading and being impleaded, of defending and being defended, in all courts and Their powers places whatsoever, and may have a common seal, and may change the same at pleasure.

SEC. 2. The capital stock of said company shall be divided into

Madden shall form a part of the said capital stock; and the said company shall be authorised to purchase, old and convey any other lands for the purpose of conducting their mining and smelting operations; Provided, they shall not hold or possess during the continuance of this charter, more than four thousand acres of land; and all deeds executed by the President in the name of said company, or to said company by their corporate name, shall be sufficient in law to convey the title to the land therein described.
