SEC. 9. The Legislature or either branch thereof, may at any time examine the affairs of said corporation by a committee or otherwise, and may alter, amend or repeal this act at pleasure, Provided, that no repeal shall take place, unless it shall appear to the Legislature that this charter has been violated, and that notice has been given to some officer or member of the corporation.

H. Goodhue and James Rogan, their heirs and assigns, are hereby authorized to construct such mill races on said section numbered four, and erect such other devices and fixtures as will facilitate the use of said water power, and erect such mills or other machinery as from time to time they may think proper..

SEC. 2. That Charles F. H. Goodhue and James Rogan, their heis or assigns, shall (within six years from the passage of this act, or as soon as said Rock River shall be made navigable for steamboats) erect in said dam, or at some convenient point, for the free passage of boats or other water craft, navigating said stream, a good and substantial lock of suitable materials, not less than ninety feet long between the gates and fifteen feet wide, in the clear of the chamber, and said lock shall be kept constantly in repair for the safe passage of boats or craft of any kind, on the passage of which no tax or other charge shall be demanded or collected, and in default of the building of such lock, within the time herein prescribed, or being so built, shall not be kept in repair as aforesaid, and suitably attendel for the safe and speedy passage of any boat or water craft navigating said stream, said Charles F. H. Goodhue and James Rogan, their heirs or assigns,being in possession of the works hereby authorized,shall pay to any person or persons who may be injured by delay, all damages which such person or persons shall sustain, together with any and all costs which may accrue in sueing for or collecting such damages. The Legislature of the Territory or the State of Wisconsin, may at any time so alter or amend this act, or any of its provisions, as to facilitate or improve the navigation of Rock River, in such manner as may be deemed expedient: Provided, that the aforesaid Charles F. II. Goodhue and James Rogan, or their successors, shall on or before the first day of September, 1839, build Blide or chute for or cause to be constructed, a slide or chute, so called, so constructed and situated as to facilitate the ascent and descent of fish, and shalt be subject to all laws that are or may be made for the protection of fishing and navigation,

McMartry, be, and they are appointed commissioners to lay out and establish a Territorial road, from Mineral Point, on the best and most eligible route, by the residence of John Armstrong, on the Peckitonica, to the State line of Illinois, in the county of Green, on the best route to Brewster's Ferry.

SEC. 13. That Hoel S. Wright, H. B. Kelsoe and Horace Conroe, are hereby appointed commissioners to lay out and establish a territorial road commencing at the mouth of Plumb Creek, creek to Manitou. on Fox river, running thence on the best and most eligible ground to the town of Manitouwoc Rapids, and a road from Lafontaine on the most direct and eligible route to intersect the above road at to intersect said the nearest practicable point, and if either of the said commissioners shall negleet or refuse to perform said duty, the county commissioners of Brown County, are hereby authorized to supply the vacancy, occasioned by such neglect or refusal at any time, after the expiration of three months from the passage of this act.

SEC. 15. That the commissioners, appointed by an act entitled "an act to lay out a Territorial road from Racine to Madison," Relating to a road passed at the last session of the Legislature, be required to meet Madison. at Racine, for the performance of their duties on or before the first day of June next, and that so much of the act alluded to, as conflicts with this section is hereby repealed.

SEC. 16. If either of the boards of commissioners mentioned in this act shall be of opinion that any Territorial road which shall be laid out and established, before they proceed to perform their Commissioners may adopt part of duties under this act, is the proper route for any part of the roads roads previously laid out. hereby established, they shall have power to commence and terminate their survey at such points on the line of said road so previously laid out as they shall think proper, and the provisions of this section shall be applicable to any and all acts for the location of Territorial roads and not yet carried into effect.

SEC. 17. That the three commissioners named in each of the preceding sections, may meet respectively at such place and time as they or a majority of them shall agree upon, and proceed to the discharge of their duty agreeably to the provisions of "An act Their duties. to provide for laying out and opening territorial roads," approved January 3d, 1838: Provided that the damage and expense of Expenses when laying out and opening any of said roads, or any other authorized by former acts of the Territorial Legislature, not yet laid out, shall not be paid out of the treasury of any county through which the same may pass, without the county commissioners of such county shall have approved and audited the acccount for said damage and expense.

SEC. 18. This act shall take effect from and after its passage.
